De\u0219i sistemul CEDO este larg cunoscut ca un garant al drepturilor omului, drepturile protejate de acesta \u0219i condi\u021biile de admisibilitate ale unei pl\u00e2ngeri nu sunt suficient de bine cunoscute. Numai 3% din totalul pl\u00e2ngerilor \u00eempotriva Rom\u00e2niei, analizate de CEDO p\u00e2n\u0103 \u00een 2010, au fost declarate admisibile.<br \/>\nNum\u0103rul mare de pl\u00e2ngeri formulate la Curtea European\u0103 a Drepturilor Omului (CEDO) \u00eempotriva Rom\u00e2niei reflect\u0103, pe de o parte, lipsa \u00eencrederii \u00een justi\u021bia rom\u00e2n\u0103, iar pe de alt\u0103 parte neaplicarea la nivel na\u021bional a standardelor impuse de Conven\u021bia european\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00cencep\u00e2nd din 2010 CEDO a demarat un proces de reform\u0103 tocmai din cauza num\u0103rului mare de pl\u00e2ngeri pe care le prime\u0219te. Aceasta a \u00eensemnat ad\u0103ugarea unui nou criteriu de admisibilitate (prin Protocolul nr.14) \u0219i \u00eenfiin\u021barea unui mecanism de filtraj, aplicat la \u00eenceput numai pentru \u021b\u0103rile cu num\u0103r mare de pl\u00e2ngeri, inclusiv Rom\u00e2nia.<\/p>\n<p style=\"text-align: justify;\">De exemplu, <strong>pl\u00e2ngerile sunt respinse dac\u0103 sunt incomplete<\/strong>, acum inclusiv dac\u0103 nu au anexate toate hot\u0103r\u00e2rile judec\u0103tore\u0219ti interne. P\u00e2n\u0103 \u00een 2010, aceste documente puteau fi trimise \u0219i ulterior.<br \/>\nOr, din cauza perioadei mari \u00een care se redacteaz\u0103 hot\u0103r\u00e2rile \u00een Rom\u00e2nia, \u0219i necunosc\u00e2nd modific\u0103rile de practic\u0103 CEDO, reclaman\u021bii se adreseaz\u0103 CEDO \u00een 6 luni (<strong>ATEN\u021aIE, \u00eencep\u00e2nd din februarie 2022, <a href=\"https:\/\/apador.org\/en\/de-cand-se-schimba-termenul-de-sesizare-a-cedo-conform-protocolului-15\/\" target=\"_blank\" rel=\"noopener noreferrer\">termenul de adresare este de 4 luni<\/a><\/strong>) de la pronun\u021barea ultimei hot\u0103r\u00e2ri, f\u0103r\u0103 s\u0103 o trimit\u0103 \u0219i pe aceasta, rezultatul fiind respingerea pl\u00e2ngerii.<\/p>\n<p style=\"text-align: justify;\">Reforma CEDO continu\u0103 odat\u0103 cu intrarea \u00een vigoare a Protocoalelor nr. 15 \u0219i 16 la Conven\u021bia european\u0103, care scurteaz\u0103 termenul de trimtere a unei pl\u00e2ngeri, de la 6 luni la 4 luni, \u0219i introduc posibilitatea instan\u021belor na\u021bonale de a adresa \u00eentreb\u0103ri CEDO. \u00cen lipsa unei inform\u0103ri eficiente propor\u021bia pl\u00e2ngerilor declarate admise se va diminua \u0219i mai mult, f\u0103c\u00e2nd mecanismul CEDO inaccesibil pentru miile de peten\u021bi care i se adreseaz\u0103.<\/p>\n<p style=\"text-align: justify;\">Informarea CEDO este necesar\u0103 nu doar \u00een r\u00e2ndul peten\u021bilor, ci \u0219i \u00een r\u00e2ndul practicienilor. Din pl\u00e2ngerile \u00eempotriva Rom\u00e2niei care sunt admise \u0219i asupra c\u0103ror CEDO se pronun\u021b\u0103 pe fond, \u00een aproximativ 90% din cazuri CEDO a g\u0103sit cel pu\u021bin o \u00eenc\u0103lcare a unui drept stipulat \u00een conven\u021bie.<br \/>\nAceast\u0103 statistic\u0103 sugereaz\u0103 faptul c\u0103 exist\u0103 o slab\u0103 \u00een\u021belegere \u0219i aplicare a principiilor CEDO \u0219i la nivelul instan\u021belor de judecat\u0103 din \u021bar\u0103. Pentru ca protec\u021bia drepturilor omului s\u0103 fie real\u0103 este necesar ca instan\u021bele na\u021bionale s\u0103 cunoasc\u0103 \u0219i s\u0103 aplice principiile CEDO, iar ceilal\u021bi participan\u021bi la proces (avoca\u021bi, procurori) s\u0103 poat\u0103 s\u0103-\u0219i formuleze pozi\u021biile \u00een linie cu principiile CEDO.<\/p>\n\n<\/div>\n<\/div>\n<\/section>\n\n<section class=\"av_tab_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div aria-controls=\"ce-este-cedo\" role=\"tab\" tabindex=\"0\" data-fake-id=\"#ce-este-cedo\" class=\"tab \"  itemprop=\"headline\" >Ce este CEDO<\/div>\n<div id=\"ce-este-cedo-container\" class=\"tab_content \" aria-hidden=\"true\">\n<div class=\"tab_inner_content invers-color\"  itemprop=\"text\" >\n<h4 style=\"text-align: justify;\">Ce este CEDO (Conven\u021bia \u0219i Curtea)<\/h4>\n<p style=\"text-align: justify;\"><strong>Conven\u0163ia European\u0103 a Drepturilor Omului<\/strong> \u2013 semnat\u0103 \u00een 1950 (la Roma) de statele membre ale Consiliului Europei. A intrat \u00een vigoare \u00een 1953. Consacr\u0103 drepturile omului de prim\u0103 genera\u0163ie, respectiv cele civile \u015fi politice. A fost ratificat\u0103 de Rom\u00e2nia \u00een 1994, prin Legea nr. 30\/1994. De la data ratific\u0103rii, Conven\u0163ia a devenit drept intern pentru Rom\u00e2nia, \u00een sensul c\u0103 ea se aplic\u0103 direct, ca orice lege adoptat\u0103 de parlament, nefiind nevoie de emiterea altor acte normative prin care ea s\u0103 fie transpus\u0103 \u00een legisla\u0163ia na\u0163ional\u0103.<\/p>\n<p style=\"text-align: justify;\">Mecanismul de asigurare a respect\u0103rii Conven\u0163iei = <strong>Curtea European\u0103 a Drepturilor Omului (CEDO)<\/strong>. CEDO prime\u015fte pl\u00e2ngeri individuale pentru \u00eenc\u0103lcarea Conven\u0163iei \u015fi, foarte important, pronun\u0163\u0103 hot\u0103r\u00e2ri care au for\u0163\u0103 juridic\u0103 <strong>obligatorie<\/strong> pentru statele p\u0103r\u0163i la Conven\u0163ie. Func\u0163ioneaz\u0103, ca orice organism interna\u0163ional \u00een materie, pe baza principiului <em>subsidiarit\u0103\u0163ii<\/em>.<br \/>\nAceasta \u00eenseamn\u0103 c\u0103 ea nu poate fi sesizat\u0103 dec\u00e2t dup\u0103 ce statul vizat a avut ocazia s\u0103 remedieze \u00eenc\u0103lc\u0103rile Conven\u0163iei, dar nu a f\u0103cut-o. Procedural, aceasta \u00eenseamn\u0103 obligativitatea pentru cel care vrea s\u0103 sesizeze CEDO ca, \u00eenainte de sesizare, s\u0103 epuizeze c\u0103ile interne de atac \u00eempotriva actului de \u00eenc\u0103lcare a dreptului din Conven\u0163ie, adic\u0103 s\u0103 exercite toate modalit\u0103\u0163ile prev\u0103zute \u00een legisla\u0163ia na\u0163ional\u0103 (din statul vizat) pentru remedierea \u00eenc\u0103lc\u0103rii. Spre exemplu, s\u0103 se adreseze justi\u0163iei na\u0163ionale \u015fi s\u0103 parcurg\u0103, f\u0103r\u0103 vreo omisiune, toat\u0103 calea pe care o presupune desf\u0103\u015furarea unui proces, inclusiv cu urmarea tuturor c\u0103ilor de atac obi\u015fnuite de care dispune (mai pu\u0163in cele cu caracter extraordinar).<\/p>\n<p style=\"text-align: justify;\"><strong>Principiile Conven\u0163iei Europene a Drepturilor Omului<\/strong><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-1  el_before_av_hr  avia-builder-el-first \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#principiul-exercitarii-drepturilor-libertatilor-cu-buna-credinta\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"principiul-exercitarii-drepturilor-libertatilor-cu-buna-credinta-container\">1. Principiul exercit\u0103rii drepturilor \u015fi libert\u0103\u0163ilor cu bun\u0103-credin\u0163\u0103<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"principiul-exercitarii-drepturilor-libertatilor-cu-buna-credinta-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Are doua componente:<br \/>\na) <u>Interzicerea abuzului de drept<\/u> Potrivit art. 17 din Conven\u0163ie, niciuna dintre prevederile Conven\u0163iei nu poate fi folosit\u0103 \u00een scopul distrugerii drepturilor sau a libert\u0103\u0163ilor recunoscute de Conven\u0163ie sau de a aduce limit\u0103ri mai ample acestor drepturi \u015fi libert\u0103\u0163i dec\u00e2t cele prev\u0103zute de aceasta. De exemplu, discursul de tip fascist nu este protejat de libertatea de exprimare, pentru c\u0103 un astfel de discurs promoveaz\u0103 un sistem care anuleaz\u0103 drepturile \u015fi libert\u0103\u0163ile civile, inclusiv libertatea de exprimare. Din acela?i motiv, o adunare public\u0103 sau o organiza?ie care promoveaz\u0103 ideologia fascist\u0103 nu sunt protejate de libertatea de \u00eentrunire ?i de asociere.<br \/>\nb) <u>Interzicerea cererilor abuzive<\/u> Aceast\u0103 interdic\u0163ie, distinct\u0103 de cea prev\u0103zut\u0103 \u00een art. 17 din Conven\u0163ie, se refer\u0103 la exercitarea cu rea-credin\u0163\u0103 a dreptului procesual, prev\u0103zut \u00een Conven\u0163ie, de a se adresa Cur\u0163ii cu o cerere individual\u0103. Spre exemplu, folosirea \u00een cerere a unui limbaj insult\u0103tor la adresa Cur\u0163ii, formularea de cereri ?icanatorii (cereri repetate \u00een care sunt reiterate fapte prezentate \u00een cereri anterioare), cereri \u00een care \u00eenc\u0103lc\u0103rile reclamate sunt cauzate de conduit\u0103 culpabil\u0103 a reclamantului, cereri \u00een care reclamantul dezinformeaz\u0103 sau \u00eencearc\u0103 s\u0103 induc\u0103 \u00een eroare, \u00een orice mod, Curtea. \u00cen cazul unei cereri abuzive, solu\u0163ia Cur\u0163ii este de respingere ca inadmisibil\u0103, conform art. 35 par. 3 lit. a teza final\u0103 din Conven\u0163ie.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#principiul-teritorialitatii\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"principiul-teritorialitatii-container\">2. Principiul teritorialit\u0103\u0163ii Conven\u0163iei<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"principiul-teritorialitatii-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Art. 1 din Conven\u0163ie prevede c\u0103 de drepturile \u015fi libert\u0103\u0163ile pe care aceasta le consacr\u0103 beneficiaz\u0103 oricine se afl\u0103 sub jurisdic\u0163ia unui stat parte la Conven\u0163ie. Ca regul\u0103, statul \u00ee\u015fi exercit\u0103 jurisdic\u0163ia <u>asupra tuturor persoanelor care se afl\u0103 pe teritoriul s\u0103u<\/u>, indiferent dac\u0103 sunt cet\u0103\u0163eni, apatrizi sau str\u0103ini. Toate aceste persoane sunt protejate de Conven\u0163ie, f\u0103r\u0103 a avea relevant\u0103 dac\u0103 sunt sau nu cet\u0103\u0163eni ai statului respectiv. Exist\u0103 \u015fi excep\u0163ii de la regul\u0103, cum ar fi posibilitatea aplic\u0103rii extrateritoriale a Conven\u0163iei (de exemplu, o ac\u0163iune produs\u0103 la bordul unei nave sau aeronave a unui stat parte la Conven\u0163ie, aflat\u0103 pe un teritoriu al unui stat neparte la Conven\u0163ie, intr\u0103 sub inciden\u0163a Conven\u0163iei). Trebuie precizat c\u0103, practic, drepturile \u015fi libert\u0103\u0163ile se bucur\u0103 de aceea\u015fi protec\u0163ie, diferen\u0163a dintre ele fiind doar de ordin terminologic.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#principiul-disponibilitatii\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"principiul-disponibilitatii-container\">3. Principiul disponibilit\u0103\u0163ii procedurii<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"principiul-disponibilitatii-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Curtea European\u0103 a Drepturilor Omului (Curtea) nu se poate sesiza din oficiu, ci numai \u00een urma unei cereri \u015fi \u00een limitele \u00eenc\u0103lc\u0103rilor invocate \u00een acea cerere. \u00cen func\u0163ie de cine o poate formula, cererea poate fi individual\u0103 sau interstatal\u0103. <u>Cererea individual\u0103<\/u> poate fi formulat\u0103 de c\u0103tre orice persoan\u0103 fizic\u0103, orice organiza\u0163ie neguvernamental\u0103 sau de orice grup de particulari care se pretinde victim\u0103 a unei \u00eenc\u0103lc\u0103ri de c\u0103tre unul (sau mai multe) dintre statele-parte a drepturilor recunoscute \u00een Conven\u0163ie sau \u00een protocoalele sale. <u>Cererea interstatal\u0103<\/u> poate fi formulat\u0103 de un stat parte la Conven\u0163ie \u015fi poate privi orice pretins\u0103 \u00eenc\u0103lcare a prevederilor Conven\u0163iei \u015fi ale protocoalelor sale de c\u0103tre un alt stat (alte state) parte. Reclamantul are dreptul de a renun\u0163a la cererea sa, oric\u00e2nd pe durata procedurii \u00een fa\u0163a Cur\u0163ii \u015fi, de asemenea, poate tranzac\u0163iona cu cealalt\u0103 parte stingerea litigiului prin bun\u0103-\u00een\u0163elegere (solu\u0163ionarea amiabil\u0103 a cauzei). Curtea se poate pune la dispozi\u0163ia p\u0103r\u0163ilor \u00een vederea solu\u0163ion\u0103rii pe cale amiabil\u0103 a cauzei, procedura fiind confiden\u0163ial\u0103.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#aplicarea-directa-a-conventiei\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"aplicarea-directa-a-conventiei-container\">4. Aplicarea direct\u0103 a Conven\u0163iei<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"aplicarea-directa-a-conventiei-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Aceasta \u00eenseamn\u0103 c\u0103, din momentul ratific\u0103rii de c\u0103tre un stat, Conven\u0163ia devine drept intern al acelui stat, adic\u0103 se aplic\u0103 \u00een statul respectiv la fel ca orice alt\u0103 lege adoptat\u0103 de parlamentul na\u0163ional, f\u0103r\u0103 a mai fi nevoie de emiterea unei alte legi prin care Conven\u0163ia s\u0103 fie transpus\u0103 \u00een legisla\u0163ia na\u0163ional\u0103. Spre exemplu, Conven\u0163ia a fost ratificat\u0103 de Rom\u00e2nia \u00een 1994, prin Legea nr. 30\/1994. Dreptul statelor de a limita anumite drepturi, \u00een anumite condi\u0163ii<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"dreptul-statelor-de-a-limita-anumite-drepturi-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Limit\u0103rile constau \u00een excep\u0163ii sau derog\u0103ri. Excep\u0163iile sunt prev\u0103zute \u00een articolul \u00een care este consacrat dreptul respectiv, iar condi\u0163iile \u015fi limitele derog\u0103rilor sunt prev\u0103zute \u00een art. 15 din Conven\u0163ie.<br \/>\nDrepturile care pot fi limitate se numesc <strong>drepturi relative<\/strong>, iar cele care nu pot fi limitate \u00een nicio situa\u0163ie se numesc <strong>drepturi absolute<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Drepturile absolute sunt \u00een num\u0103r de cinci<\/strong>:<br \/>\n&#8211; Dreptul de a nu fi supus pedepsei cu moartea (Protocoalele nr. 6 \u015fi 13 la Conven\u0163ie)<br \/>\n&#8211; Dreptul de a nu fi supus torturii sau pedepselor ori tratamentelor inumane sau degradante (art. 3 din Conven\u0163ie)<br \/>\n&#8211; Dreptul de a nu fi supus sclaviei (art. 4 par. 1 din Conven\u0163ie)<br \/>\n&#8211; Dreptul de a nu fi condamnat f\u0103r\u0103 lege\/retroactiv (art.7 din Conven\u0163ie)<br \/>\n&#8211; Dreptul de a nu fi judecat sau pedepsit de dou\u0103 ori pentru aceea\u015fi fapt\u0103 (art. 4 din Protocolul nr. 7 la Conven\u0163ie). Acest drept este corespondentul regulii \u201cnon bis \u00een idem\u201d din dreptul roman.<\/p>\n<p style=\"text-align: justify;\">Celelalte drepturi, prev\u0103zute \u00een Conven\u0163ie \u015fi \u00een protocoalele adi\u0163ionale la Conven\u0163ie, sunt drepturi relative, \u00eentruc\u00e2t, \u00een anumite condi\u0163ii, care trebuie strict respectate, li se pot aduce limit\u0103ri.<\/p>\n<p style=\"text-align: justify;\">Tot \u00een leg\u0103tur\u0103 cu restr\u00e2ngerea unor drepturi, este de men\u0163ionat o prevedere care se apropie de intrarea \u00een desuetudine, dar care \u00eenc\u0103 este men\u0163inut\u0103 \u00een Conven\u0163ie. Este vorba despre art. 16 din Conven\u0163ie, care prevede c\u0103 nicio dispozi\u0163ie a art. 10, 11 \u015fi 14 (care consacr\u0103 libertatea de exprimare, libertatea de \u00eentrunire \u015fi de asociere, dreptul de a nu fi discriminat) nu poate fi considerat\u0103 c\u0103 interzice statelor parte s\u0103 impun\u0103 restr\u00e2ngeri activit\u0103\u0163ii politice a str\u0103inilor. Principiul subsidiarit\u0103\u0163ii mecanismului Conven\u0163iei<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"principiul-subsidiaritatii-conventiei-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Aceasta \u00eenseamn\u0103 c\u0103:<\/p>\n<p style=\"text-align: justify;\">A) Curtea European\u0103 a Drepturilor Omului (Curtea) <u>nu poate fi sesizat\u0103 dec\u00e2t dup\u0103 ce statul vizat a avut ocazia s\u0103 remedieze \u00eenc\u0103lc\u0103rile Conven\u0163iei, dar nu a f\u0103cut-o<\/u>. Procedural, aceasta \u00eenseamn\u0103 obligativitatea pentru cel care vrea s\u0103 sesizeze CEDO ca, \u00eenainte de sesizare, s\u0103 epuizeze c\u0103ile interne de atac \u00eempotriva actului de \u00eenc\u0103lcare a dreptului din Conven\u0163ie, adic\u0103 s\u0103 exercite toate modalit\u0103\u0163ile prev\u0103zute \u00een legisla\u0163ia na\u0163ional\u0103 (din statul vizat) pentru remedierea \u00eenc\u0103lc\u0103rii. Spre exemplu, s\u0103 se adreseze justi\u0163iei na\u0163ionale \u015fi s\u0103 parcurg\u0103, f\u0103r\u0103 vreo omisiune, toat\u0103 calea pe care o presupune desf\u0103\u015furarea unui proces, inclusiv cu urmarea tuturor c\u0103ilor de atac obi\u015fnuite de care dispune (fond, apel, recurs), mai pu\u0163in cele cu caracter extraordinar.<br \/>\n\u015ei<br \/>\nB) <u>Curtea nu are rol de legiuitor<\/u>, deci nu poate adopta legi prin care reglementeaz\u0103 conduita unui stat. Doar statele parte ale Conven\u0163iei sunt cele care adopt\u0103 reglement\u0103rile na\u0163ionale (interne) concrete care sunt necesare pentru a se conforma obliga\u0163iilor prev\u0103zute \u00een Conven\u0163ie \u015fi \u00een hot\u0103r\u00e2rile Cur\u0163ii. Dar, prin hot\u0103r\u00e2rile sale, care au for\u0163\u0103 juridic\u0103 obligatorie, Curtea poate dispune m\u0103suri cu caracter general prin care, practic, obliga statele parte s\u0103 adopte anumite m\u0103suri legislative. \u015ei \u00een acest caz, nu Curtea legifereaz\u0103, ci statele respective.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#principiul-fortei-obligatorii-a-hotararilor-curtii\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"principiul-fortei-obligatorii-a-hotararilor-curtii-container\">7. Principiul for\u0163ei obligatorii a hot\u0103r\u00e2rilor Cur\u0163ii<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"principiul-fortei-obligatorii-a-hotararilor-curtii-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Principiul for\u0163ei obligatorii a hot\u0103r\u00e2rilor Cur\u0163ii pentru statele parte la Conven\u0163ie. Potrivit art. 46 din Conven\u0163ie, statele se oblig\u0103 s\u0103 se conformeze hot\u0103r\u00e2rilor definitive ale Cur\u0163ii, pronun\u0163ate \u00een cauzele \u00een care sunt p\u0103r\u0163i.<\/p>\n<p style=\"text-align: justify;\">Hot\u0103r\u00e2rea definitiv\u0103 a Cur\u0163ii se transmite Comitetului Mini\u015ftrilor care supravegheaz\u0103 executarea acesteia. \u00cen cazul \u00een care Comitetul Mini\u015ftrilor consider\u0103 c\u0103 supravegherea execut\u0103rii unei hot\u0103r\u00e2ri definitive este \u00eempiedicat\u0103 de o dificultate de interpretare a acestei hot\u0103r\u00e2ri, el poate sesiza Curtea pentru a se pronun\u0163a asupra acestei probleme de interpretare.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care Comitetul Mini\u015ftrilor consider\u0103 c\u0103 un stat refuz\u0103 s\u0103 se conformeze unei hot\u0103r\u00e2ri definitive a Cur\u0163ii, acesta poate, dup\u0103 ce a notificat statul c\u0103 este pus \u00een \u00eent\u00e2rziere, s\u0103 sesizeze Curtea cu privire la problema respect\u0103rii de c\u0103tre stat a hot\u0103r\u00e2rii. Curtea poate constata o \u00eenc\u0103lcare a obliga\u0163ie statului, caz \u00een care va trimite cauza Comitetului Mini\u015ftrilor pentru ca acesta s\u0103 examineze m\u0103surile care se impun. \u00cen cazul \u00een care Curtea constat\u0103 c\u0103 nu s-a produs o \u00eenc\u0103lcare a obliga\u0163iei statului de a respecta hot\u0103r\u00e2rea, va transmite cauza Comitetului Mini\u015ftrilor, care va decide \u00eencetarea supravegherii execut\u0103rii.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:20px' class='hr hr-invisible   avia-builder-el-2  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<p style=\"text-align: justify;\"><strong>Schimb\u0103rile care au fost aduse Conven\u0163iei prin Protocolul nr. 14 \u015fi care vor fi aduse Conven\u0163iei prin Protocoalele nr. 15 \u015fi 16<\/strong><\/p>\n<p style=\"text-align: justify;\">Ca orice act cu caracter normativ, Conven\u0163ia a suferit \u015fi va suferi modific\u0103ri, \u00een func\u0163ie de elementele \u015fi cerin\u0163ele nou ap\u0103rute privind sistemul de protec\u0163ie a drepturilor \u015fi libert\u0103\u0163ilor, precum \u015fi \u00een leg\u0103tur\u0103 cu necesitatea cre\u015fterii eficien\u0163ei activit\u0103\u0163ii Cur\u0163ii.<\/p>\n<p style=\"text-align: justify;\">Actele juridice prin care Conven\u0163ia sufer\u0103 modific\u0103ri \u015fi\/sau complet\u0103ri sunt denumite protocoale. Pentru a intra \u00een vigoare, deci pentru a avea for\u0163a juridic\u0103 obligatorie, protocoalele, dup\u0103 semnarea de c\u0103tre state, trebuie s\u0103 fie \u015fi ratificate printr-o lege adoptat\u0103 de parlamentul na\u0163ional al fiec\u0103rui stat parte al Conven\u0163iei.<\/p>\n<p style=\"text-align: justify;\">Ultimele modific\u0103ri \u015fi\/sau complet\u0103ri preconizate pentru Conven\u0163ie se reg\u0103sesc \u00een Protocoalele nr. 14, 15 \u015fi 16.<\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-3  el_after_av_hr  el_before_av_toggle_container \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#protocolul-14\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"protocolul-14-container\">Protocolul nr. 14<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"protocolul-14-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Protocolul nr. 14 a fost adoptat, ca text, de Comitetul Mini\u015ftrilor \u00een anul 2004 \u015fi a intrat \u00een vigoare \u00een anul 2010, dup\u0103 ce a fost ratificat de toate statele parte la Conven\u0163ie, astfel cum se prevede \u00een art. 19 din protocol.<\/p>\n<p style=\"text-align: justify;\">Romania a ratificat Protocolul nr. 14 prin Legea nr.39\/2005.<\/p>\n<p style=\"text-align: justify;\">\u00cen esen\u0163\u0103, Protocolul nr. 14 a introdus un un nou motiv de inadmisibilitate a cererii, care const\u0103 \u00een <strong>lipsa unui prejudiciu <em>important<\/em><\/strong> care s\u0103 fi fost suferit de reclamant. Cu toate acestea, chiar \u015fi \u00een cazul \u00een care prejudiciul nu este important, cauz\u0103 nu va fi respins\u0103 ca inadmisibil\u0103, dac\u0103 exist\u0103 una dintre urm\u0103toarele dou\u0103 situa\u0163ii:<br \/>\n&#8211; respectarea drepturilor omului garantate prin Conven\u0163ie \u015fi Protocoalele sale impune o examinare a fondului cererii<br \/>\n&#8211; cauz\u0103 nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103<\/p>\n<p style=\"text-align: justify;\">Introducerea motivului suplimentar de inadmisibilitate a unei cereri adresat\u0103 Cur\u0163ii \u00ee\u015fi are explica\u0163ia \u00een supra\u00eenc\u0103rcarea Cur\u0163ii cu diverse pl\u00e2ngeri, dintre care unele au o mai mic\u0103 importan\u0163\u0103 \u015fi consum\u0103 din timpul, limitat, al Cur\u0163ii, care trebuie s\u0103 se orienteze spre solu\u0163ionarea unor cauze care au ca obiect \u00eenc\u0103lc\u0103ri de o anumit\u0103 gravitate a Conven\u0163iei.<\/p>\n<p style=\"text-align: justify;\">Curtea a precizat c\u0103 noul criteriu de admisibilitate a fost introdus pentru a permite solu\u0163ionarea rapid\u0103 a unor cauze minore, neimportante (<em>\u201cfutile\u201d<\/em>) \u015fi, \u00een acela\u015fi timp, pentru a-i permite s\u0103 se concentreze asupra misiunii sale esen\u0163iale, de a asigura protec\u0163ia juridic\u0103 la nivel European a drepturilor prev\u0103zute \u00een Conven\u0163ie \u015fi \u00een protocoale, \u00een condi\u0163iile \u00een care \u00eenc\u0103lcarea unui drept trebuie s\u0103 ating\u0103 un anumit nivel de gravitate pentru a justifica examinarea cazului de o jurisdic\u0163ie interna\u0163ional\u0103 (par. 35 din decizia de inadmisibilitate din 12 aprilie 2011 \u00een cazul \u015etef\u0103nescu c. Rom\u00e2nia, cererea nr. 11774\/04).<\/p>\n<p style=\"text-align: justify;\">Unul dintre primele cazuri \u00een care condi\u0163ia de admisibilitate privind existen\u0163a unui <em>\u201cprejudiciu important\u201d<\/em> a fost aplicat\u0103 de Curte a fost un caz contra Rom\u00e2niei. Cererea adresat\u0103 Cur\u0163ii a fost respins\u0103 ca inadmisibil\u0103 pe motiv c\u0103 prejudiciul suferit de reclamant\u0103 nu este important (cauza \u015etef\u0103nescu c. Rom\u00e2nia, cererea nr. 11774\/04, respins\u0103 prin decizia de inadmisibilitate din 12 aprilie 2011; vezi: <a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-104720#{\" target=\"\" rel=\"noopener noreferrer\">hudoc.echr.coe.int<\/a>. \u00cen spe\u0163\u0103, reclamanta solicitase \u00een instan\u0163ele interne daune morale de valoare redus\u0103, circa 125 euro, care au fost refuzate de instan\u0163e pe motiv c\u0103 prejudiciul moral nu a fost dovedit. Reclamanta s-a adresat Cur\u0163ii, invoc\u00e2nd \u00eenc\u0103lcarea de c\u0103tre instan\u0163ele na\u0163ionale a dreptului la un proces echitabil, garantat prin art. 6 par. 1 din Conven\u0163ie, \u00eentruc\u00e2t, pentru dovedirea daunelor morale, care au o natur\u0103 exclusiv intern\u0103, i s-au cerut dovezi foarte greu sau imposibil de administrat, de\u015fi era suficient c\u0103 producerea unui prejudiciu moral s\u0103 fie prezumat\u0103. \u00cen acest sens, reclamanta a argumentat c\u0103 legea prevede c\u0103 prezum\u0163iile au puterea unor dovezi, la fel ca \u015fi m\u0103rturiile sau \u00eenscrisurile, iar prezum\u0163ia existen\u0163ei unui prejudiciu rezult\u0103, \u00een mod logic, din \u00eens\u0103\u015fi comiterea unei fapte ilicite.<\/p>\n<p style=\"text-align: justify;\">Reclamanta a adus la cuno\u015ftin\u0163a Cur\u0163ii, importan\u0163a deosebit\u0103 a rezolv\u0103rii, printr-o hot\u0103r\u00e2re a instan\u0163ei europene, a problemei de drept privind condi\u0163iile foarte grele\/imposibile impuse de instan\u0163ele na\u0163ionale pentru dovedirea daunelor morale. Reclamanta a precizat c\u0103 aceast\u0103 practic\u0103 de a cere probe cvasiimposibile pentru dovedirea existen\u0163ei unui prejudiciu moral nu este \u00eent\u00e2lnit\u0103 doar \u00een cazul sau, ci este practic\u0103 majorit\u0103\u0163ii cov\u00e2r\u015fitoare a instan\u0163elor na\u0163ionale \u015fi c\u0103 acesta este un motiv serios pentru care este necesar\u0103 o hot\u0103r\u00e2re a Cur\u0163ii dedicate acestei probleme. Cu toate acestea, Curtea a respins ca inadmisibil\u0103 cererea reclamantei, cu motivarea c\u0103 nu a suferit un prejudiciu important (neacordarea de c\u0103tre instan\u0163e a daunelor morale de circa 125 euro), astfel c\u0103 nu este \u00eendeplinit\u0103 condi\u0163ia <em>\u201cprejudiciului important\u201d<\/em> introdus\u0103 prin Protocolul nr. 14. De asemenea, Curtea a apreciat c\u0103 a pronun\u0163at deja unele hot\u0103r\u00e2ri pe problem\u0103 unui formalism excesiv al instan\u0163elor \u00een privin\u0163a dovedirii unor daune morale (dar, \u00een cazuri de arestare nelegal\u0103 sau de supunere la rele tratamente), astfel c\u0103 nu se impune o hot\u0103r\u00e2re dedicat\u0103 chestiunii dovezilor cvasiimposibile cerute de instan\u0163ele na\u0163ionale \u00een cazul prejudiciului moral. Totodat\u0103, Curtea a men\u0163ionat c\u0103 preten\u0163iile reclamantei au fost examinate de dou\u0103 instan\u0163e na\u0163ionale, chiar dac\u0103 ele au respins aceste preten\u0163ii, deci nu se poate sus\u0163ine c\u0103, de\u015fi prejudicial nu e important, o hot\u0103r\u00e2re ar trebui pronun\u0163at\u0103 pe motiv c\u0103 preten\u0163iile reclamantei nu ar fi fost examinate \u00een jurisdic\u0163ia na\u0163ional\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00cen alt caz, Curtea a hot\u0103r\u00e2t c\u0103 \u00eenc\u0103lcarea dreptului la un proces echitabil, sub aspectul dep\u0103\u015firii duratei rezonabile a procesului, nu a produs un prejudiciu important reclamantului, at\u00e2t vreme c\u00e2t acesta a beneficiat de lungimea excesiv\u0103 a procesului, \u00een sensul c\u0103, din acest motiv, s-a \u00eemplinit termenul de prescrip\u0163ie a r\u0103spunderii penale, astfel c\u0103 nu a mai fost expus riscului de a fi condamnat pentru cea mai grav\u0103 infrac\u0163iune pentru care fusese trimis \u00een judecat\u0103 (cazul <em>Gagliano Giorgi c. Italia<\/em>, cererea nr. 23563\/07, hot\u0103r\u00e2rea din 6 martie 2012, definitiv\u0103). Este o solu\u0163ie \u00een mod v\u0103dit corect\u0103 \u015fi echitabil\u0103 a Cur\u0163ii, dar, tehnic vorbind, acela\u015fi gen de solu\u0163ie s-ar fi putut pronun\u0163a \u015fi pe vechile prevederi ale Conven\u0163iei, adic\u0103 \u015fi dac\u0103 nu ar fi fost prev\u0103zut noul motiv de inadmisibilitate.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul <em>Nicoleta Gheorghe c. Rom\u00e2nia<\/em> (Cererea nr. 23470\/05, hot\u0103r\u00e2rea din 3 aprilie 2012, r\u0103mas\u0103 definitiv\u0103), Curtea a re\u0163inut c\u0103 de\u015fi prejudiciul suferit nu este important (17 euro, reprezent\u00e2nd o amend\u0103 contraven\u0163ional\u0103 aplicat\u0103 reclamantei pentru tulburarea lini\u015ftii publice), cererea nu va fi respins\u0103 ca inadmisibil\u0103, pe baza modific\u0103rii introduse prin Protocolul nr. 14, \u00eentruc\u00e2t a considerat important\u0103 problem\u0103 privind aplicarea \u00een materie contraven\u0163ional\u0103 a garan\u0163iilor prev\u0103zute de art. 6 din conven\u0163ie \u00een materie penal\u0103, \u00een sensul c\u0103 \u00een pofida prezum\u0163iei de legalitate \u015fi temeinicie de care beneficiaz\u0103 procesul-verbal de contraven\u0163ie, instan\u0163elor le revine sarcina de a verifica, \u00een fiecare situa\u0163ie, cuprinsul documentului contestat, respect\u00e2nd dreptul la ap\u0103rare al contravenien\u0163ilor. \u00cen cele din urm\u0103, cererea reclamantei a fost respins\u0103 de Curte, dar nu pentru c\u0103 ar fi inadmisibil\u0103 din cauza prejudiciului neimportant, ci pentru c\u0103 era ne\u00eentemeiat\u0103 sub aspectul invocat al \u00eenc\u0103lc\u0103rii art. 6 din Conven\u0163ie, \u00eentruc\u00e2t \u00een cauza respectiv\u0103, reclamanta a avut posibilitatea s\u0103 conteste procesul-verbal prin administrarea de probe (s\u0103 cear\u0103 audierea de martori, inclusiv a poli\u0163istului care a \u00eentocmit actul de constatare), \u00eens\u0103 nu a folosit aceast\u0103 posibilitate.<\/p>\n<p style=\"text-align: justify;\">Este posibil ca unii reclaman\u0163i, pentru a evita respingerea cererii pe motiv c\u0103 prejudiciul suferit nu este important, s\u0103 men\u0163ioneze \u00een cerere sume majorate artificial, ca reprezent\u00e2nd daunele morale \u015fi\/sau materiale solicitate. Solu\u0163ia aceasta nu prezint\u0103, totu\u015fi, mari \u015fanse de reu\u015fit\u0103, \u00eentruc\u00e2t Curtea va avea propria apreciere cu privire la caracterul important sau nu al prejudiciului, baz\u00e2ndu-se pe elementele concrete care rezult\u0103 din situa\u0163ia de fapt re\u0163inut\u0103 \u00een acea spe\u0163\u0103.<\/p>\n<p style=\"text-align: justify;\">Protocolul nr. 14 a mai adus Conven\u0163iei \u015fi <strong>alte modific\u0103ri\/complet\u0103ri<\/strong>, dar cu relevan\u0163\u0103 practic\u0103 redus\u0103 din punctul de vedere al reclamantului, care se refer\u0103 la:<br \/>\n&#8211; Durata mandatului (judec\u0103torii sunt ale\u015fi pentru o perioad\u0103 de 9 ani. Ei nu pot fi reale\u015fi. Mandatul judec\u0103torilor se \u00eencheie atunci c\u00e2nd ei \u00eemplinesc v\u00e2rsta de 70 de ani).<br \/>\n&#8211; Revocarea judec\u0103torilor Cur\u0163ii (un judec\u0103tor nu poate fi revocat din func\u0163ie dec\u00e2t dac\u0103 ceilal\u0163i judec\u0103tori decid, cu o majoritate de dou\u0103 treimi, c\u0103 el nu mai corespunde condi\u0163iilor cerute)<br \/>\n&#8211; Grefa \u015fi raportorii Cur\u0163ii (raportorii fac parte din grefa Cur\u0163ii \u0219i \u00eel asist\u0103 pe judec\u0103torul unic \u00een cauzele pe care acesta la solu\u021bioneaz\u0103).<br \/>\n&#8211; Compunerea \u015fi competen\u0163a completelor de judecat\u0103 ale Cur\u021bii: judec\u0103tor unic, comitete (3 judec\u0103tori), Camere (7 judec\u0103tori) \u015fi Marea Camer\u0103 (17 judec\u0103tori).<br \/>\n&#8211; Consacrarea dreptului Comisarului pentru drepturile omului al Consiliului Europei de a prezenta observa\u0163ii scrise \u015fi de a lua parte la audieri \u00een orice cauz\u0103 aflat\u0103 pe rolul unei Camere sau al Marii Camere.<br \/>\n&#8211; Au fost separate \u00een articole distincte \u00een con\u0163inutul Conven\u0163iei regulile privind examinarea \u00een contradictoriu a cauzei \u015fi solu\u0163ionarea cauzei pe cale amiabil\u0103 (anterior, erau unele reglement\u0103ri privind solu\u0163ionarea amiabil\u0103 \u00een articolul privind contradictorialitatea). De asemenea, au fost f\u0103cute unele preciz\u0103ri procedurale privind solu\u0163ionarea pe cale amabil\u0103 (se prevede expres rolul Comitetului Mini\u015ftrilor de a supraveghea executarea clauzelor din conven\u0163ia de solu\u0163ionare pe cale amiabil\u0103, a\u015fa cum au fost re\u0163inute \u00een decizie).<br \/>\n&#8211; Au fost aduse complet\u0103ri cu privire la procedura prin care se asigur\u0103 for\u0163a obligatorie \u015fi executarea hot\u0103r\u00e2rilor (Comitetul Mini\u015ftrilor poate sesiza Curtea, pentru a se pronun\u0163a, dac\u0103 apar probleme de interpretare sau de neexecutare a hot\u0103r\u00e2rilor definitive).<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#protocolul-15\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"protocolul-15-container\">Protocolul nr. 15<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"protocolul-15-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Protocolul nr. 15 a fost adoptat, ca text, de Comitetul Mini\u015ftrilor \u00een anul 2013 \u0219i a fost ratificat de Romania prin Legea nr. 157\/2014. El intr\u0103 \u00een vigoare din august 2021, dup\u0103 ce toate statele membre l-au ratificat.<\/p>\n<p style=\"text-align: justify;\">Pentru reclaman\u0163i, principala modificare pe care acest protocol o aduce Conven\u0163iei este <strong>reducerea termenului \u00een care pot sesiza Curtea de la 6 luni la 4 luni<\/strong>, de la ultima decizie definitiv\u0103 a unei instan\u021be na\u021bionale, dup\u0103 epuizarea tuturor c\u0103ilor de atac. Acest termen de 4 luni a intrat \u00een vigoare la data de 1 februarie 2022. Mai multe informa\u021bii despre cum se aplic\u0103 <strong><a href=\"https:\/\/apador.org\/en\/de-cand-se-schimba-termenul-de-sesizare-a-cedo-conform-protocolului-15\/\" target=\"_blank\" rel=\"noopener noreferrer\">Protocolul 15 g\u0103si\u021bi aici<\/a><\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Alte modific\u0103ri\/complet\u0103ri<\/strong> aduse Conven\u0163iei prin Protocolul nr. 15:<br \/>\n&#8211; Men\u0163ionarea expres\u0103 a principiului subsidiarit\u0103\u0163ii \u00een cuprinsul preambulului Conven\u0163iei<br \/>\n&#8211; Limita maxim\u0103 de v\u00e2rst\u0103 (65 de ani) a candida\u0163ilor la func\u0163ia de judec\u0103tor la Curte<br \/>\n&#8211; Eliminarea prevederii potrivit c\u0103reia mandatul judec\u0103torilor la Curte se \u00eencheie la \u00eemplinirea v\u00e2rstei de 70 de ani<br \/>\n&#8211; Introducerea posibilit\u0103\u0163ii desesiz\u0103rii unei Camere \u015fi a trimiterii cauzei respective la Marea Camer\u0103, chiar dac\u0103 una dintre p\u0103r\u0163i se opune la aceasta (\u00een prezent, opunerea unei p\u0103r\u0163i \u00eempiedic\u0103 o astfel de m\u0103sur\u0103, potrivit art. 30 teza final\u0103 din Conven\u0163ie)<br \/>\n&#8211; Eliminarea unui caz, prev\u0103zut \u00een Protocolul nr. 14, \u00een care o cerere nu poate fi respins\u0103 ca inadmisibil\u0103, de\u015fi prejudiciul suferit nu este important, \u015fi anume a cazului \u00een care <i>cauza nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103<\/i>. Reamintim c\u0103, prin Protocolul nr. 14 a fost introdus un nou caz de inadmisibilitate, care const\u0103 \u00een lipsa de importan\u021b\u0103 a prejudiciului suferit. \u00cen Protocolul nr. 14 se prevede c\u0103 lipsa de importan\u021b\u0103 a prejudiciului nu justific\u0103 respingerea cererii ca inadmisibil\u0103 dac\u0103 exist\u0103 unul dintre urm\u0103toarele dou\u0103 cazuri: respectarea drepturilor omului garantate prin Conven\u0163ie \u015fi Protocoalele sale impune o examinare a fondului cererii sau <i>cauza nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103<\/i>.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#protocolul-16\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"protocolul-16-container\">Protocolul nr. 16<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"protocolul-16-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Protocolul nr. 16 a fost adoptat, ca text, de Comitetul Mini\u015ftrilor \u00een anul 2013 si a fost semnat de Romania in octombrie 2014 (deocamdata, neratificat). El intr\u0103 \u00een vigoare \u00eencep\u00e2nd cu 1 august 2018, \u00eentruc\u00e2t a fost ratificat de 10 state p\u0103r\u0163i la Conven\u0163ie, astfel cum se prevede \u00een art. 8 din protocol.<\/p>\n<p style=\"text-align: justify;\">Are ca obiect principal <strong>extinderea competen\u0163ei Cur\u0163ii de a formula <em>avize consultative<\/em><\/strong>.<\/p>\n<p style=\"text-align: justify;\">Scopul acestui protocol este unificarea jurispruden\u021bei statelor p\u0103r\u021bi \u00een chestiunile privind drepturile prev\u0103zute \u00een Conven\u021bie \u0219i, prin aceasta, reducerea semnificativ\u0103 a num\u0103rului de cereri (cauze) adresate Cur\u021bii.<\/p>\n<p style=\"text-align: justify;\">\u015ei \u00een prezent, potrivit art. 47-49 din Conven\u0163ie, Curtea poate s\u0103 emit\u0103, dar numai la cererea \u015fi pentru uzul Comitetului Mini\u015ftrilor, avize motivate, cu rol consultativ, asupra problemelor juridice privind <i>interpretarea conven\u0163iei<\/i> \u015fi a protocoalelor sale. Totu\u015fi, aceste avize nu se pot referi la probleme legate de <i>con\u0163inutul sau de \u00eentinderea drepturilor<\/i> \u015fi a libert\u0103\u0163ilor definite \u00een art. 2-14 ale Conven\u0163iei \u015fi \u00een protocoalele sale, nici asupra altor probleme de care Curtea sau Comitetul Mini\u015ftrilor ar putea s\u0103 ia cuno\u015ftin\u0163\u0103 ca urmare a introducerii unui recurs prev\u0103zut \u00een Conven\u0163ie.<\/p>\n<p style=\"text-align: justify;\">Protocolul nr. 16 prevede, \u00een esen\u021b\u0103, c\u0103 <strong>avizele consultative<\/strong> vor putea fi solicitate Cur\u0163ii \u015fi de c\u0103tre <strong>instan\u021bele supreme \u0219i tribunalele din statele p\u0103r\u0163i<\/strong>, care vor fi nominalizate de fiecare stat parte, printr-o declaratie, asupra unor <strong>chestiuni de principiu privind interpretarea sau aplicarea drepturilor \u015fi libert\u0103\u0163ilor<\/strong> prev\u0103zute \u00een Conven\u0163ie \u015fi \u00een protocoalele sale.<\/p>\n<p style=\"text-align: justify;\">Cu ocazia semn\u0103rii protocolului, Rom\u00e2nia a depus \u0219i o declara\u021bie \u00een care a precizat care sunt instan\u021bele rom\u0203ne care vor putea solicita un aviz consultativ Cur\u021bii. Aceste instan\u021be sunt:<br \/>\n&#8211; Curtea Constitu\u021bional\u0103<br \/>\n&#8211; \u020analta Curte de Casa\u021bie \u0219i Justi\u021bie<br \/>\n&#8211; Cur\u021bile de apel<\/p>\n<p style=\"text-align: justify;\">Instan\u0163ele supreme na\u0163ionale pot cere avizul Cur\u0163ii doar \u00een cadrul unei cauze care se afl\u0103 pe rolul lor, spre solu\u0163ionare.<\/p>\n<p style=\"text-align: justify;\">Cererea de aviz consultativ este examinat\u0103 de un colegiu format din 5 judec\u0103tori ai Marii Camere, care se pronun\u021b\u0103 asupra admisibilit\u0103\u021bii cererii (apreciaz\u0103 dac\u0103 respectiva cerere se refer\u0103 sau nu la chestiuni de principiu privind interpretarea sau aplicarea drepturilor \u015fi libert\u0103\u0163ilor prev\u0103zute \u00een Conven\u0163ie \u015fi \u00een protocoalele sale). Dac\u0103 solicitarea de aviz este considerat\u0103 admisibil\u0103, Marea Camer\u0103 va emite un aviz consultativ.<\/p>\n<p style=\"text-align: justify;\">Avizul consultativ este motivat, se comunic\u0103 instantei care l-a solicitat, se public\u0103 \u015fi nu are caracter obligatoriu. Cu toate c\u0103 nu are caracter obligatoriu, \u00een practic\u0103, acest aviz va avea, totu\u015fi, o for\u0163\u0103 juridic\u0103 deosebit\u0103, av\u00e2nd \u00een vedere c\u0103 este emis de Marea Camer\u0103, instan\u0163a suprem\u0103 din sistemul Cur\u0163ii. O cerere individual\u0103 adresat\u0103 Cur\u0163ii care ar fi motivat\u0103 contrar solu\u021biei\/argumenta\u0163iei dintr-un aviz consultativ al Cur\u0163ii, va fi, \u00een mod real, lipsit\u0103 de \u015fanse de reu\u015fit\u0103.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n\n<\/div>\n<\/div>\n<\/section>\n\n<section class=\"av_tab_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div aria-controls=\"criterii-de-admisibilitate-plangere\" role=\"tab\" tabindex=\"0\" data-fake-id=\"#criterii-de-admisibilitate-plangere\" class=\"tab \"  itemprop=\"headline\" >Criterii de admisibilitate pl\u00e2ngere<\/div>\n<div id=\"criterii-de-admisibilitate-plangere-container\" class=\"tab_content \" aria-hidden=\"true\">\n<div class=\"tab_inner_content invers-color\"  itemprop=\"text\" >\n<h4 style=\"text-align: justify;\">Criteriile de admisibilitate ale unei pl\u00e2ngeri \u00een fa\u0163a Cur\u0163ii Europene a Drepturilor Omului<\/h4>\n<p style=\"text-align: justify;\">Criteriile de admisibilitate sunt prev\u0103zute de <strong>Articolul 34<\/strong> (<em>Pl\u00e2ngere individual\u0103<\/em>) \u015fi <strong>Articolul 35<\/strong> (<em>Criterii de admisibilitate<\/em>) din Conven\u0163iei European\u0103. Un nou criteriu de inadmisibilitate a fost introdus de <strong>Protocolului 14<\/strong>, intrat \u00een vigoare la data de 1 iunie 2010.<\/p>\n<p style=\"text-align: justify;\"><em><strong>Articolul 34. \u2013 Cereri individuale<\/strong><br \/>\n\u201eCurtea poate fi sesizat\u0103, printr-o cerere, de orice persoan\u0103 fizic\u0103, organiza\u0163ie neguvernamental\u0103 sau grup de particulari care se pretind victime ale unei \u00eenc\u0103lc\u0103ri de c\u0103tre una din \u00eenaltele p\u0103r\u0163i contractante a drepturilor recunoscute \u00een Conven\u0163ie sau \u00een protocoalele sale. \u00cenaltele p\u0103r\u0163i contractante se angajeaz\u0103 s\u0103 nu \u00eempiedice prin nicio m\u0103sur\u0103 exerci\u0163iul eficace al acestui drept.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Orice persoan\u0103 particular\u0103 poate invoca protec\u0163ia Conven\u0163iei \u00eempotriva unui stat parte atunci c\u00e2nd pretinsa \u00eenc\u0103lcare a avut loc \u00een limitele jurisdic\u0163iei.<\/p>\n<p style=\"text-align: justify;\"><strong>Cine poate face o pl\u00e2ngere la CEDO<\/strong><br \/>\n&#8211; Orice persoan\u0103 fizic\u0103 sau juridic\u0103 poate formula o pl\u00e2ngere, indiferent de cet\u0103\u0163enie, loc de re\u015fedin\u0163\u0103, stare civil\u0103, situa\u0163ie sau capacitate juridic\u0103<br \/>\n&#8211; Orice organiza\u0163ie neguvernamental\u0103 are dreptul de a formula o pl\u00e2ngere. Pot formula pl\u00e2ngeri \u015fi persoanele juridice de drept public care nu exercit\u0103 atribute de putere public\u0103 \u015fi cele care sunt independente de stat din punct de vedere juridic \u015fi financiar.<br \/>\n&#8211; Orice grup de particulari: o asocia\u0163ie informal\u0103 format\u0103 din mai multe persoane.<\/p>\n<p style=\"text-align: justify;\"><strong>Pot face pl\u00e2ngere doar &#8220;victimele&#8221;.<\/strong><br \/>\nReclaman\u0163ii care se consider\u0103 victime ale unei \u00eenc\u0103lc\u0103ri a Conven\u0163iei pot introduce o pl\u00e2ngere \u00een fa\u0163a Cur\u0163ii. Calitatea de victim\u0103 trebuie s\u0103 existe \u00een toate stadiile procedurii \u00een fa\u0163a Cur\u0163ii.<\/p>\n<p style=\"text-align: justify;\"><em>No\u0163iunea de \u201evictim\u0103\u201d<\/em> este interpretat\u0103 \u00een mod autonom \u015fi independent de principiile de drept intern, precum interesul de a formula o pl\u00e2ngere sau calitatea procesual\u0103.<\/p>\n<p style=\"text-align: justify;\">Pl\u00e2ngerile pot fi formulate doar de persoane \u00een via\u0163\u0103 sau \u00een numele acestora; o persoan\u0103 decedat\u0103 nu poate s\u0103 introduc\u0103 o cerere \u00een fa\u0163a Cur\u0163ii, nici m\u0103car prin intermediul unui reprezentant legal sau conven\u0163ional. Cu toate acestea, decesul victimei nu presupune \u00een mod automat radierea cauzei de pe rolul Cur\u0163ii (membrii familiei reclamantului ini\u0163ial pot men\u0163ine cererea, cu condi\u0163ia s\u0103 aib\u0103 un interes suficient \u00een acest sens).<\/p>\n<p style=\"text-align: justify;\"><strong>Dreptul de a sesiza Curtea este absolut \u015fi nu face obiectul vreunei limit\u0103ri.<\/strong><br \/>\nAutorit\u0103\u0163ile na\u0163ionale trebuie s\u0103 se ab\u0163in\u0103 de la orice form\u0103 de presiune asupra reclaman\u0163ilor \u00een sensul determin\u0103rii acestora de a-\u015fi retrage sau modifica pl\u00e2ngerile.<\/p>\n<h4 style=\"text-align: justify;\">Articolul 35 \u00a7 1 \u2013 Condi\u0163iile de admisibilitate<\/h4>\n<p style=\"text-align: justify;\"><em>&#8220;1. Curtea nu poate fi sesizat\u0103 dec\u00e2t dup\u0103 <strong>epuizarea c\u0103ilor de recurs interne<\/strong>, a\u015fa cum se \u00een\u0163elege din principiile de drept interna\u0163ional general recunoscute, <strong>\u015fi \u00eentr-un termen de 6 luni \u00eencep\u00e2nd cu data deciziei interne definitive (termenul devine 4 luni din februarie 2022)<\/strong>.<br \/>\n2. Curtea nu re\u0163ine nicio cerere individual\u0103 introdus\u0103 \u00een virtutea articolului 34, \u00een cazul \u00een care:<br \/>\na. <strong>ea este anonim\u0103<\/strong> ; sau<br \/>\nb. ea <strong>este \u00een mod esen\u0163ial aceea\u015fi cu o cerere examinat\u0103 anterior <\/strong>de c\u0103tre Curte sau deja supus\u0103 unei alte instan\u0163e interna\u0163ionale de anchet\u0103 sau de reglementare \u015fi dac\u0103 nu con\u0163ine fapte noi.<br \/>\n3. Curtea declar\u0103 inadmisibil\u0103 orice cerere individual\u0103 introdus\u0103 \u00een virtutea articolului 34, atunci c\u00e2nd ea consider\u0103 c\u0103:<br \/>\na. ea <strong>este incompatibil\u0103 cu dispozi\u0163iile Conven\u0163iei sau ale Protocoalelor sale, \u00een mod v\u0103dit nefondat\u0103 sau abuziv\u0103; sau reclamantul nu a suferit niciun prejudiciu important<\/strong>, cu excep\u0163ia cazului \u00een care respectarea drepturilor omului garantate prin Conven\u0163ie \u015fi Protocoalele sale impune o examinare a fondului cererii, \u015fi cu condi\u0163ia de a nu respinge din acest motiv nicio cauz\u0103 care nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103.<br \/>\n4. Curtea respinge orice cerere pe care o consider\u0103 inadmisibil\u0103 \u00een aplicarea prezentului articol. Ea poate proceda astfel \u00een orice stadiu al procedurii.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-4  el_after_av_toggle_container  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#epuizare-cai-interne-de-atac\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"epuizare-cai-interne-de-atac-container\">1. Epuizarea c\u0103ilor interne de atac<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"epuizare-cai-interne-de-atac-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Reclaman\u0163ii au obliga\u0163ia de a epuiza c\u0103ile de recurs interne.<br \/>\nReclaman\u0163ii trebuie s\u0103 parcurg\u0103 at\u00e2t calea apelul \u015fi\/sau ce a recursului \u00een conformitate cu normele de procedur\u0103 intern\u0103.<\/p>\n<p style=\"text-align: justify;\">Curtea consider\u0103 c\u0103 reclamantul nu este obligat s\u0103 parcurg\u0103 \u015fi alte c\u0103i de recurs, dac\u0103 acestea urm\u0103resc, \u00een esen\u0163\u0103, acela\u015fi scop sau c\u0103ile extraodinare de atac.<\/p>\n<ul style=\"text-align: justify;\">\n<li>Curtea a apreciat c\u0103 reclamantul rom\u00e2n nu este obligat s\u0103 exercite calea reviuirii sau a contesta\u0163iei \u00een anulare prev\u0103zute \u00een dreptul intern.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Reclaman\u0163ii trebuie s\u0103 respecte normele \u015fi procedurile aplicabile \u00een legisla\u0163ia intern\u0103, \u00een caz contrar pl\u00e2ngerea lor va fi respins\u0103, pe motiv c\u0103 nu \u00eendepline\u015fte condi\u0163ia prev\u0103zut\u0103 la art. 35.<br \/>\nCurtea a apreciat c\u0103 art. 35 nu a fost respectat, atunci c\u00e2nd un apel\/recurs nu a fost admis din cauza unei gre\u015feli procedurale a reclamantului.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#regula-termenului-de-6-luni\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"regula-termenului-de-6-luni-container\">2. Regula termenului de 6 luni<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"regula-termenului-de-6-luni-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Reclamantul poate adresa o pl\u00e2ngere Cur\u0163ii \u00een termen de 6 luni (4 luni \u00eencep\u00e2nd dn februarie 2022).<br \/>\nTermenul de 6 luni (termenul devine 4 luni \u00eencep\u00e2nd dn februarie 2022) \u00eencepe s\u0103 curg\u0103 odat\u0103 cu pronun\u0163area deciziei definitive \u00een cadrul procesului de epuizare a c\u0103ilor de recurs interne.<br \/>\nPerioada de \u015fase\/patru luni \u00eencepe s\u0103 curg\u0103 de la data la care reclamantul \u015fi \/ sau reprezentantul acestuia a luat la cuno\u015ftin\u0163\u0103 decizia intern\u0103 definitiv\u0103.<br \/>\nDac\u0103 decizia intern\u0103 definitiv\u0103 i se comunic\u0103 reclamantului din oficiu atunci termenul de 6 luni\/4 luni se calculeaz\u0103 de la data comunic\u0103rii copiei deciziei.<\/p>\n<p style=\"text-align: justify;\">Nota: <em>Dac\u0103 decizia din recurs nu a fost redactat\u0103 \u00een termen de 6 luni\/4 luni de la pronun\u0163are, pute\u0163i solicita instan\u0163ei de recurs un certificat de gref\u0103 din care s\u0103 rezulte data la care a fost redactat\u0103 hot\u0103r\u00e2rea din recurs \u015fi data la care a fost disponibi\u0103 p\u0103r\u0163ilor. Termenul de 6 luni\/4 luni va \u00eencepe s\u0103 curg\u0103 de la data men\u0163ionat\u0103 \u00een certificatul de gref\u0103.<\/em><\/p>\n<p style=\"text-align: justify;\">Termenul \u00eencepe s\u0103 curg\u0103 \u00een ziua urm\u0103toare pronun\u0163\u0103rii \u00een \u015fedin\u0163\u0103 public\u0103 a deciziei interne definitive sau, \u00een lipsa pronun\u0163\u0103rii, \u00een ziua urm\u0103toare aducerii la cuno\u015ftin\u0163a reclamantului sau reprezentantului acestuia \u015fi expir\u0103 dup\u0103 6 luni\/4 luni calendaristice, indiferent de durata efectiv\u0103 a acestora. Curtea are posibilitatea de a stabili o dat\u0103 de expirare a termenului de 6 luni\/4 luni care s\u0103 fie diferit\u0103 de cea indicat\u0103 de statul p\u00e2r\u00e2t.<\/p>\n<p style=\"text-align: justify;\"><strong>Termenul de 6 luni\/4 luni \u00een situa\u0163ia unei \u00eenc\u0103lc\u0103ri continue<\/strong><\/p>\n<p style=\"text-align: justify;\">Dac\u0103 pretinsa \u00eenc\u0103lcare invocat\u0103 de reclamant reprezint\u0103 o situa\u0163ie continu\u0103 \u00eempotriva c\u0103reia nu exist\u0103 nicio cale de recurs \u00een legisla\u0163ia intern\u0103, termenul de <del>6 luni\/<\/del>4 luni \u00eencepe s\u0103 curg\u0103 din momentul \u00een care aceast\u0103 situa\u0163ie continu\u0103 a \u00eencetat. C\u00e2t\u0103 vreme situa\u0163ia persist\u0103, regula termenului de <del>6 luni\/<\/del>4 luni nu este aplicabil\u0103.<\/p>\n<p style=\"text-align: justify;\">Nota:<br \/>\n<em>1. Data introducerii pl\u00e2ngerii este considerat\u0103 a fi cea indicat\u0103 de \u015ftampila po\u015ftei aplicat\u0103 la expedierea plicului, \u015fi nu data de primire a pl\u00e2ngerii.<br \/>\n2. Cerere abuziv\u0103<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"cerere-abuziva-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Terminologia de cerere &#8220;abuziv\u0103&#8221; poate fi explicat\u0103 ca fiind: exercitarea unui drept de c\u0103tre titularul acestuia \u00een alte scopuri dec\u00e2t cele pentru care este destinat, \u00een mod prejudiciabil.<br \/>\n\u00cen jurispruden\u0163a sa Curtea a constatat caracterul abuziv \u00een urm\u0103toarele situa\u0163ii: dezinformarea Cur\u0163ii, utilizarea unui limbaj ofensator sau jignitor, \u00eenc\u0103lcarea obliga\u0163iei de confiden\u0163ialitate a solu\u0163ion\u0103rii pe cale amiabil\u0103, cererea cu caracter v\u0103dit \u015ficanator sau<br \/>\nlipsit\u0103 de orice miz\u0103 real\u0103.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-5  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<h4 style=\"text-align: justify;\">II. Inadmisibilitatea legat\u0103 de competen\u0163a cur\u0163ii<\/h4>\n<p style=\"text-align: justify;\"><em>34. 5.3. Curtea declar\u0103 inadmisibil\u0103 orice cerere individual\u0103 introdus\u0103 \u00een virtutea articolului 34, atunci c\u00e2nd ea consider\u0103 c\u0103:<br \/>\na. ea este incompatibil\u0103 cu dispozi\u0163iile Conven\u0163iei sau ale Protocoalelor sale, \u00een mod v\u0103dit nefondat\u0103 sau abuziv\u0103; sau reclamantul nu a suferit niciun prejudiciu important, cu excep\u0163ia cazului \u00een care respectarea drepturilor omului garantate prin Conven\u0163ie \u015fi Protocoalele sale impune o examinare a fondului cererii, \u015fi cu condi\u0163ia de a nu respinge din acest motiv nicio cauz\u0103 care nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103.<\/em><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-6  el_after_av_hr  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#incompatibilitatea-ratione-personae\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"incompatibilitatea-ratione-personae-container\">2.1 Incompatibilitatea ratione personae<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"incompatibilitatea-ratione-personae-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Compatibilitatea <em>ratione personae<\/em> presupune ca pretinsa \u00eenc\u0103lcare a Conven\u0163iei s\u0103 fi fost comis\u0103 de un stat contractant sau ca aceasta s\u0103 \u00eei fie imputabil\u0103 \u00eentr-un fel sau altul.<br \/>\nPl\u00e2ngerile vor fi declarate incompatibile <em>ratione personae<\/em> cu prevederile Conven\u0163iei pentru urm\u0103toarele motive:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Pl\u00e2ngerea este \u00eendreptat\u0103 \u00eempotriva unui stat care nu a semnat \u015fi ratificat Conven\u0163ia;<\/li>\n<li>Pl\u00e2ngerea este \u00eendreptat\u0103 \u00eempotriva unei persoane private;<\/li>\n<li>Reclamantul nu are calitate procesual\u0103 \u00een sensul art. 34 din Conven\u0163ie<\/li>\n<li>Reclamantul nu este \u00een m\u0103sur\u0103 s\u0103 demonstreze c\u0103 este victima pretinsei \u00eenc\u0103lc\u0103ri<\/li>\n<li>Pl\u00e2ngerea are ca obiect un protocol la Conven\u0163ie pe care statul p\u00e2r\u00e2t nu l-a semnat \u015fi ratificat<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#incompatibilitatea-ratione-loci\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"incompatibilitatea-ratione-loci-container\">2.2. Incompatibilitatea ratione loci<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"incompatibilitatea-ratione-loci-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Compatibilitatea <em>ratione loci<\/em> presupune ca pretinsa \u00eenc\u0103lcare a Conven\u0163iei s\u0103 fi avut loc \u00een jurisdic\u0163ia statului p\u00e2r\u00e2t sau pe teritoriul controlat \u00een mod efectiv de acest stat.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#-ncompatibilitatea-ratione-temporis\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"-ncompatibilitatea-ratione-temporis-container\">2.3. Incompatibilitatea ratione temporis<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"-ncompatibilitatea-ratione-temporis-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Competen\u0163a <em>ratione temporis<\/em> acoper\u0103 doar perioada ulterioar\u0103 ratific\u0103rii Conven\u0163iei sau a protocoalelor sale de c\u0103tre statul p\u00e2r\u00e2t. Conven\u0163ia nu impune totu\u015fi statelor contractante vreo obliga\u0163ie specific\u0103 de a repara o nedreptate sau un prejudiciu cauzat \u00eenainte de data respectiv\u0103.<br \/>\nCu toate acestea, Curtea poate s\u0103 \u0163in\u0103 seama de fapte anterioare ratific\u0103rii, cu condi\u0163ia ca acestea s\u0103 poat\u0103 fi considerate ca fiind la originea unei \u00eenc\u0103lc\u0103ri continue, care s-a prelungit dup\u0103 aceast\u0103 dat\u0103, sau s\u0103 fie relevante pentru \u00een\u0163elegerea faptelor care au avut loc dup\u0103 aceast\u0103 dat\u0103.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#incompatibilitatea-ratione-materiae\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"incompatibilitatea-ratione-materiae-container\">2.4 Incompatibilitatea ratione materiae<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"incompatibilitatea-ratione-materiae-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>Compatibilitatea <em>ratione materiae<\/em> a unei pl\u00e2ngeri sau a unui cap\u0103t de pl\u00e2ngere \u0163ine de competen\u0163a material\u0103 a Cur\u0163ii. Pentru ca un cap\u0103t de cerere s\u0103 fie compatibil <em>ratione materiae<\/em> cu Conven\u0163ia, dreptul invocat de reclamant trebuie s\u0103 fie protejat de Conven\u0163ie \u015fi de protocoalele sale care au intrat \u00een vigoare.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-7  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<h4 style=\"text-align: justify;\">III. Criteriu de inadmisibilitate- Prejudiciu nesemnificativ<\/h4>\n<p style=\"text-align: justify;\"><strong>Articolul 35 \u00a7 (b) \u2013 Condi\u0163ii de admisibilitate<\/strong><br \/>\n<em>\u201c3. Curtea declar\u0103 inadmisibil\u0103 orice cerere individual\u0103 introdus\u0103 \u00een virtutea Articolului 34, atunci c\u00e2nd ea consider\u0103 c\u0103:<br \/>\n\u2026<br \/>\n(b) reclamantul nu a suferit niciun prejudiciu important, cu excep\u0163ia cazului \u00een care respectarea drepturilor omului garantate prin Conven\u0163ie \u015fi protocoalele sale impune o examinare a fondului cererii, \u015fi cu condi\u0163ia de a nu respinge din acest motiv nici o cauz\u0103 care nu a fost examinat\u0103 corespunz\u0103tor de o instan\u0163\u0103 na\u0163ional\u0103.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Curtea poate declara inadmisibil\u0103 orice cerere individual\u0103 atunci c\u00e2nd consider\u0103 c\u0103 <strong>reclamantul nu a suferit niciun prejudiciu important<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Odata cu intrarea \u00een vigoare a Protocolului nr. 14, la 1 iunie 2010, a fost introdus un nou criteriu de admisibilitate care s-a ad\u0103ugat criteriilor prev\u0103zute la art. 35. Noul criteriu se bazeaz\u0103 pe ideea c\u0103 \u00eenc\u0103lcarea unui drept, indiferent de contextul juridic, trebuie s\u0103 ating\u0103 <strong>un nivel minim de gravitate<\/strong> pentru a justifica examinarea sa de c\u0103tre o instan\u0163\u0103 interna\u0163ional\u0103<\/p>\n<p style=\"text-align: justify;\">Criteriului \u0163ine seama de prejudiciul deja suferit de reclamant la nivel na\u0163ional. Printre factorii care pot fi lua\u0163i \u00een considerare se num\u0103r\u0103, dar nu \u00een mod exclusiv, impactul financiar pentru reclamant.<\/p>\n<p style=\"text-align: justify;\">Exemplu: \u00cen cauza <em>Ionescu c. Rom\u00e2niei<\/em>, ( <em>cererea nr. 36659\/04, Decizia din 1 iunie 2010<\/em>) Curtea a concluzionat c\u0103 prejudiciul financiar suferit de reclamant nu era important. \u00cen fapt, prejudiciul se ridica la 90 EUR iar pierderea acestei sume nu ar fi avut urm\u0103ri importante asupra vie\u0163ii personale a reclamantului.<\/p>\n<h4 style=\"text-align: justify;\">IV. Declararea inadmisibilit\u0103\u0163ii unei pl\u00e2ngeri \u00een urma examin\u0103rii fondului<\/h4>\n<p style=\"text-align: justify;\">Curtea poate s\u0103 o declare o pl\u00eengere inadmisibil\u0103 pentru motive ce \u0163in de examinarea fondului chiar dac\u0103 pl\u00e2ngerea este compatibil\u0103 cu Conven\u0163ia \u015fi \u00eendepline\u015fte toate condi\u0163iile formale de admisibilitate.<\/p>\n<p style=\"text-align: justify;\">Cur\u0163ii se limiteaz\u0103 la controlul respect\u0103rii, de c\u0103tre statele contractante, a angajamentelor \u00een materie de drepturile omului, angajamente asumate prin aderarea la Conven\u0163ie \u015fi la protocoalele sale.<\/p>\n<p style=\"text-align: justify;\">\u00cen m\u0103sura \u00een care Curtea, analizeaz\u0103 o pl\u00e2ngere pe fondul cauzei poate constata c\u0103 ea este inadmisibil\u0103 \u00een m\u0103sura \u00een care statul p\u00e2r\u00e2t a respectat garan\u0163iile \u00een materie de drepturile omului prev\u0103zute \u00een Conve\u0163ie \u015fi protocoalele adi\u0163ionale.<\/p>\n<p style=\"text-align: justify;\">Curtea nu este competent\u0103 s\u0103 se pronun\u0163e cu privire la erorile de fapt sau de drept pretins comise de o instan\u0163\u0103 intern\u0103, cu excep\u0163ia cazului \u015fi \u00een m\u0103sura \u00een care acestea au adus atingere drepturilor \u015fi libert\u0103\u0163ilor garantate de Conven\u0163ie.<\/p>\n<p style=\"text-align: justify;\">Curtea nu poate examina elementele de fapt sau de drept care au determinat o instan\u0163\u0103 na\u0163ional\u0103 la adoptarea unei anumite solu\u0163ii; \u00een caz contrar, aceasta s-ar erija \u00een judec\u0103tor de gradul trei sau patru de jurisdic\u0163ie \u015fi ar \u00eenc\u0103lca limitele misiunii sale.<\/p>\n<p style=\"text-align: justify;\"><strong>Ca regula general\u0103<\/strong>: Curtea nu poate contesta urm\u0103toarele constat\u0103ri \u015fi concluzii la care au ajuns instan\u0163ele na\u0163ionale:<\/p>\n<ul style=\"text-align: justify;\">\n<li>stabilirea faptelor cauzei;<\/li>\n<li>interpretarea \u015fi aplicarea dreptului intern;<\/li>\n<li>admisibilitatea \u015fi aprecierea probelor la proces;<\/li>\n<li>echitatea substan\u0163ial\u0103 a rezultatului unui litigiu civil;<\/li>\n<li>vinov\u0103\u0163ia sau nevinov\u0103\u0163ia a unui acuzat \u00eentr-o cauz\u0103 penal\u0103.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Excep\u0163ie<\/strong>: Singura situa\u0163ie \u00een care Curtea poate, \u00een mod excep\u0163ional, s\u0103 conteste aceste constat\u0103ri \u015fi concluzii, este aceea \u00een care acestea au un caracter arbitrar flagrant \u015fi evident, contrar justi\u0163iei \u015fi atrag, prin acesta, o \u00eenc\u0103lcare a Conven\u0163iei<\/p>\n\n<\/div>\n<\/div>\n<\/section>\n\n<section class=\"av_tab_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div aria-controls=\"cum-se-completeaza-cererea\" role=\"tab\" tabindex=\"0\" data-fake-id=\"#cum-se-completeaza-cererea\" class=\"tab \"  itemprop=\"headline\" >Cum se completeaza o cerere<\/div>\n<div id=\"cum-se-completeaza-cererea-container\" class=\"tab_content \" aria-hidden=\"true\">\n<div class=\"tab_inner_content invers-color\"  itemprop=\"text\" >\n<p>De la 1 ianuarie 2014 au intrat \u00een vigoare o serie de modific\u0103ri ale regulamentului Cur\u021bii Europene a Drepturilor Omului (CEDO), ceea ce schimb\u0103 \u00een anumite privin\u021be modul \u00een care peten\u021bii care caut\u0103 dreptatea european\u0103 trebuie s\u0103 se adreseze Cur\u021bii. \u00cen cele ce urmeaz\u0103 v\u0103 explic\u0103m concret ce trebuie s\u0103 con\u021bin\u0103 o cerere individual\u0103 c\u0103tre CEDO \u0219i ce proceduri trebuie s\u0103 urma\u021bi pentru ca aceast\u0103 cerere s\u0103 v\u0103 fie admis\u0103.<\/p>\n<h4 style=\"text-align: justify;\">Pl\u00e2ngerile pe care le poate examina Curtea<\/h4>\n<p style=\"text-align: justify;\">\u00cenainte de orice trebuie s\u0103 \u0219ti\u021bi exact cu ce se ocup\u0103 CEDO \u0219i care sunt limitele ei. Curtea european\u0103 a Drepturilor Omului este o instan\u0163\u0103 interna\u021bional\u0103. Aceasta poate examina doar pl\u00e2ngerile prezentate de c\u0103tre persoane fizice, organiza\u021bii \u0219i societ\u0103\u021bi care se pretind victime ale unei \u00eenc\u0103lc\u0103ri a drepturilor prev\u0103zute de Conven\u021bia european\u0103 a Drepturilor Omului. Conven\u021bia este un tratat interna\u021bional prin care un mare num\u0103r de state europene s-au angajat s\u0103 protejeze anumite drepturi fundamentale. Aceste drepturi sunt enun\u021bate \u00een <strong><a href=\"http:\/\/www.echr.coe.int\/Pages\/home.aspx?p=basictexts&amp;c=\" target=\"_blank\" rel=\"noopener noreferrer\">textul Conven\u021biei \u0219i al protocoalelor sale nr. 1, 4, 6, 7, 12 \u0219i 13<\/a><\/strong>. Aceste protocoale nu au fost acceptate dec\u00e2t de c\u0103tre anumite state.<\/p>\n<p style=\"text-align: justify;\"><strong>Curtea nu poate examina orice fel de pl\u00e2ngere. Competen\u021bele sale sunt definite prin criteriile de admisibilitate prev\u0103zute \u00een Conven\u021bie, criterii care precizeaz\u0103 cine se poate adresa Cur\u021bii, c\u00e2nd \u0219i \u00een leg\u0103tur\u0103 cu ce. Mai mult de 90 % dintre cererile examinate de c\u0103tre Curte sunt declarate inadmisibile. Prin urmare, verifica\u021bi dac\u0103 pl\u00e2ngerile dumneavoastr\u0103 r\u0103spund criteriilor de admisibilitate de mai jos.<\/strong><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-8  el_after_av_hr  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#conditii-de-admisibilitate-a-cererilor\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"conditii-de-admisibilitate-a-cererilor-container\">Conditiile de admisibilitate a cererilor<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"conditii-de-admisibilitate-a-cererilor-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><ul style=\"text-align: justify;\">\n<li>Pl\u00e2ngerile dumneavoastr\u0103 se refer\u0103 la atingerile aduse unuia sau mai multor drepturi prev\u0103zute \u00een Conven\u021bie \u0219i protocoalele sale;<\/li>\n<li>Pl\u00e2ngerile sunt \u00eendreptate \u00eempotriva unui stat care a ratificat Conven\u021bia \u0219i, dac\u0103 este cazul, protocolul care garanteaz\u0103 dreptul a c\u0103rui \u00eenc\u0103lcare este invocat\u0103 (protocoalele nu au fost ratificate de c\u0103tre toate statele; verifica\u021bi lista ratific\u0103rilor din Kit-ul reclaman\u021bilor disponibil pe pagina de Internet a Cu\u021bii: www.echr.coe.int\/applicants);<\/li>\n<li>Pl\u00e2ngerile se refer\u0103 la aspecte care angajeaz\u0103 responsabilitatea unei autorit\u0103\u021bi publice (legislativ\u0103, administrativ\u0103, judec\u0103toreasc\u0103, etc.) \u2013 Curtea nu este \u00een m\u0103sur\u0103 s\u0103 examineze pl\u00e2ngeri \u00eempotriva particularilor sau organismelor private;<\/li>\n<li>Pl\u00e2ngerile se refer\u0103 la acte sau fapte survenite dup\u0103 data ratific\u0103rii Conven\u021biei sau a protocolului respectiv de c\u0103tre statul p\u00e2r\u00e2t (datele ratific\u0103rii pentru fiecare stat sunt disponibile \u00een Kit-ul reclaman\u021bilor disponibil pe pagina de Internet a Cur\u021bii: <a href=\"http:\/\/www.echr.coe.int\/Pages\/home.aspx?p=applicants\/ron\" target=\"_blank\" rel=\"noopener noreferrer\">www.echr.coe.int\/applicants<\/a>);<\/li>\n<li>Sunte\u021bi afectat personal \u0219i direct de \u00eenc\u0103lcarea unui drept fundamental (ave\u021bi \u201ecalitatea de victim\u0103\u201d);<\/li>\n<li>A\u021bi permis instan\u021belor interne s\u0103 remedieze \u00eenc\u0103lcarea drepturilor dumneavoastr\u0103 (\u201depuizarea c\u0103ilor de recurs interne\u201d) \u2013 ceea ce \u00eenseamn\u0103 \u00een general c\u0103, \u00eenainte de a sesiza Curtea, trebuie s\u0103 v\u0103 fi adresat cu acelea\u0219i capete de cerere instan\u021belor na\u021bionale, inclusiv celei mai \u00eenalte dintre ele, \u0219i c\u0103, \u00een acest cadru, a\u021bi respectat toate regulile na\u021bionale de procedur\u0103, mai ales termenele. Nu ave\u021bi \u00een schimb obliga\u021bia de a exercita c\u0103ile de recurs care nu sunt efective, nici c\u0103ile de recurs discre\u021bionare sau extraordinare care nu fac parte din procedurile de recurs normale;<\/li>\n<li>A\u021bi sesizat Curtea cu cererea dumneavoastr\u0103 complet\u0103 \u00eentr-un termen de \u0219ase luni de la data deciziei interne definitive\/irevocabile. Termenul de \u0219ase luni \u00eencepe \u00een mod normal s\u0103 curg\u0103 de la data la care cea mai \u00eenalt\u0103 instan\u021b\u0103 na\u021bional\u0103 competent\u0103 \u0219i-a pronun\u021bat decizia sau de la data la care a existat posibilitatea efectiv\u0103, pentru dumneavoastr\u0103 sau reprezentantul dumneavoastr\u0103, de a lua cunostin\u021b\u0103 de textul integral al acestei decizii. \u00cen cazul \u00een care nu exist\u0103 o cale de recurs efectiv\u0103 cu privire la un cap\u0103t de cerere, termenul de \u0219ase luni \u00eencepe s\u0103 curg\u0103 de la data actului, faptului sau deciziei de care v\u0103 pl\u00e2nge\u021bi.Termenul de \u0219ase luni este \u00eentrerupt doar de trimiterea c\u0103tre Curte a unei cereri complete care r\u0103spunde exigen\u021belor articolului 47 din regulamentul Cur\u021bii (detaliat mai jos). Termenul de \u0219ase luni ia sf\u00e2r\u0219it \u00een ultima zi a celor \u0219ase luni, chiar dac\u0103 acesat\u0103 zi este o duminic\u0103 sau o zi de s\u0103rb\u0103toare. Deci, formularul de cerere \u00eenso\u021bit de toate informa\u021biile \u0219i documentele necesare trebuie trimise Cur\u021bii cel mai t\u00e2rziu \u00een ultima zi a termenului de \u0219ase luni: asigura\u021bi-v\u0103, a\u0219adar, c\u0103 le trimite\u021bi prin po\u0219t\u0103 din timp;<\/li>\n<li>Capetele dumneavoastr\u0103 de cerere se bazeaz\u0103 pe dovezi solide: trebuie s\u0103 expune\u021bi clar ce vi s-a \u00eent\u00e2mplat \u0219i s\u0103 aduce\u021bi \u00een sprijinul afirma\u021biilor dumneavoastr\u0103 documente, decizii, rapoarte medicale, declara\u021bii de martori \u0219i alte \u00eenscrisuri doveditoare;<\/li>\n<li>Sunte\u021bi \u00een m\u0103sur\u0103 s\u0103 demonstra\u021bi c\u0103 faptele \u00een leg\u0103tur\u0103 cu care v\u0103 pl\u00e2nge\u021bi au adus o atingere nejustificat\u0103 unui drept fundamental. Nu v\u0103 pute\u021bi pl\u00e2nge pur \u015fi simplu de o decizie pe care o considera\u021bi nedreapt\u0103 sau gre\u0219it\u0103. Curtea nu este o instan\u021b\u0103 de apel \u00eempotriva deciziilor instan\u021belor na\u021bionale \u0219i deci nu le poate nici anula, nici modifica;<\/li>\n<li>Capetele dumneavoastr\u0103 de cerere nu au fost deja examinate de c\u0103tre Curte sau o alt\u0103 instan\u021b\u0103 interna\u021bional\u0103. Lua\u021bi \u00een considerare faptul c\u0103 zeci de mii de cereri sunt trimise Cur\u021bii \u00een fiecare an. Curtea nu dispune de resursele necesare pentru a examina pl\u00e2ngeri nesemnificative sau repetate, f\u0103r\u0103 obiect serios \u2013 nu-i revine unei instan\u021be interna\u021bionale s\u0103 examineze astfel de cereri. Astfel de pl\u00e2ngeri sunt respinse ca fiind abuzive, la fel ca \u0219i pl\u00e2ngerile \u00een care reclaman\u021bii utilizeaz\u0103 un limbaj jignitor sau injurios.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Cererea poate de asemenea fi respins\u0103 atunci c\u00e2nd urm\u0103toarele elemente sunt reunite: faptele \u00een leg\u0103tur\u0103 cu care se pl\u00e2nge reclamantul nu i-au cauzat un prejudiciu real \u0219i important, nu ridic\u0103 noi problematici cu privire la drepturile omului care ar necesita o examinare la nivel interna\u021bional \u0219i au fost deja examinate de c\u0103tre o instan\u021b\u0103 intern\u0103.<\/p>\n<p style=\"text-align: justify;\">Pentru a afla mai multe despre aceste criterii, pute\u021bi consulta un avocat sau pagina de Internet a Cur\u021bii unde ve\u021bi g\u0103si informa\u021bii referitoare la criteriile de admisibilitate \u0219i r\u0103spunsuri la \u00eentreb\u0103ri recurente.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-9  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<h4 style=\"text-align: justify;\">Ce trebuie s\u0103 con\u021bin\u0103 cererea c\u0103tre CEDO<\/h4>\n<p style=\"text-align: justify;\">Articolul 47 din Regulamentul Cur\u0163ii este cel care detaliaz\u0103 con\u0163inutul unei cereri individuale pe care un petent trebuie s-o adreseze CEDO ca s\u0103 cear\u0103 judecarea cauzei sale:<\/p>\n<p style=\"text-align: justify;\"><strong>1. Fiecare cerere trebuie prezentat\u0103 pe formularul pus la dispozi\u0163ie de gref\u0103, cu excep\u0163ia cazului \u00een care Curtea decide altfel. Cererea trebuie s\u0103 con\u021bin\u0103 toate informa\u021biile cerute \u00een p\u0103r\u021bile pertinente ale formularului \u0219i trebuie s\u0103 indice:<\/strong><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-10  el_after_av_hr  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#-nformatii-de-baza\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"-nformatii-de-baza-container\">Informatii de baza<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"-nformatii-de-baza-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>(a) numele, data na\u015fterii, na\u0163ionalitatea \u015fi adresa reclamantului; \u00een cazul \u00een care reclamantul este o persoan\u0103 juridic\u0103: numele complet, data constituirii sau a \u00eenregistr\u0103rii, num\u0103rul oficial de \u00eenregistrare (dac\u0103 exist\u0103) \u0219i adresa oficial\u0103;<\/p>\n<p style=\"text-align: justify;\">(b) dac\u0103 este cazul, numele, profesia, adresa, numerele de telefon \u0219i fax \u0219i adresa electronic\u0103 a reprezentantului s\u0103u;<\/p>\n<p style=\"text-align: justify;\">(c) Partea sau P\u0103r\u0163ile contractante \u00eempotriva c\u0103reia sau c\u0103rora este \u00eendreptat\u0103 cererea;<\/p>\n<p style=\"text-align: justify;\">(d) o expunere concis\u0103 \u0219i lizibil\u0103 a faptelor;<\/p>\n<p style=\"text-align: justify;\">(e) o expunere concis\u0103 \u0219i lizibil\u0103 a \u00eenc\u0103lc\u0103rii sau a \u00eenc\u0103lc\u0103rilor pretinse ale Conven\u0163iei precum \u015fi a argumentelor pertinente; \u015fi<\/p>\n<p style=\"text-align: justify;\">(f) o expunere concis\u0103 \u0219i lizibil\u0103 referitoare la respectarea de c\u0103tre reclamant a criteriilor de admisibilitate prev\u0103zute de art. 35 paragraful 1 din Conven\u0163ie;<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-11  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<p style=\"text-align: justify;\"><strong>2. a) Toate informa\u021biile men\u021bionate mai sus trebuie expuse \u00een p\u0103r\u021bile corespunz\u0103toare ale formularului de cerere \u0219i trebuie s\u0103 fie suficiente pentru a permite Cur\u021bii s\u0103 identifice, f\u0103r\u0103 ca aceasta s\u0103 consulte alte documente, natura \u0219i obiectul cererii.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>b) Reclamantul poate \u00eens\u0103 completa aceste informa\u021bii anex\u00e2nd la formularul de cerere un document separat de maxim 20 de pagini care s\u0103 con\u021bin\u0103 o expunere detaliat\u0103 a faptelor, a pretinselor \u00eenc\u0103lc\u0103ri ale Conven\u021biei \u0219i a argumentelor pertinente.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>3.1. Formularul de cerere trebuie semnat de c\u0103tre reclamant sau de c\u0103tre reprezentantul s\u0103u \u0219i trebuie \u00eenso\u021bit de:<\/strong><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-12  el_after_av_hr  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#acte-ce-completeaza-cererea\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"acte-ce-completeaza-cererea-container\">Acte ce completeaza cererea<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"acte-ce-completeaza-cererea-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>a) copii ale documentelor aferente deciziilor sau m\u0103surilor contestate, fie ele de natur\u0103 judiciar\u0103 sau de alt\u0103 natur\u0103;<\/p>\n<p style=\"text-align: justify;\">b) copii ale documentelor \u0219i deciziilor care demonstreaz\u0103 c\u0103 reclamantul a epuizat c\u0103ile de recurs interne \u0219i c\u0103 a respectat termenul stabilit de art. 35 paragraful 1 din Conven\u021bie;<\/p>\n<p style=\"text-align: justify;\">c) dac\u0103 este cazul, copii ale documentelor referitoare la alte proceduri interna\u021bionale de anchet\u0103 sau de reglementare ;<\/p>\n<p style=\"text-align: justify;\">d) dac\u0103 reclamantul este reprezentat, de originalul procurii sau al mandatului semnat de c\u0103tre reclamant.<\/p>\n<p style=\"text-align: justify;\">3.2. Documentele prezentate \u00een sprijinul cererii trebuie s\u0103 figureze pe o list\u0103 \u00een ordine cronologic\u0103, s\u0103 poarte numere consecutive \u0219i s\u0103 fie clar identificate.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-13  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<p style=\"text-align: justify;\"><strong>4. Reclamantul care nu dore\u015fte ca identitatea sa s\u0103 fie f\u0103cut\u0103 public\u0103 trebuie s\u0103 precizeze aceasta \u015fi s\u0103 prezinte o expunere a motivelor care justific\u0103 derogarea de la regula publicit\u0103\u0163ii procedurii \u00een fa\u021ba Cur\u021bii. Aceasta din urm\u0103 poate autoriza anonimatul sau poate decide s\u0103-l acorde din oficiu.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>5.1. \u00cen cazul nerespect\u0103rii acestor obliga\u021bii, cererea nu va fi examinat\u0103 de c\u0103tre Curte, cu excep\u0163ia cazurilor \u00een care:<\/strong><\/p>\n<p style=\"text-align: justify;\"><div  class=\"togglecontainer   toggle_close_all  avia-builder-el-14  el_after_av_hr  el_before_av_hr \" >\n<section class=\"av_toggle_section\"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\"  >    <div role=\"tablist\" class=\"single_toggle\" data-tags=\"{All} \"  >        <p data-fake-id=\"#exceptii\" class=\"toggler \"  itemprop=\"headline\"    role=\"tab\" tabindex=\"0\" aria-controls=\"exceptii-container\">Exceptii<span class=\"toggle_icon\" >        <span class=\"vert_icon\"><\/span><span class=\"hor_icon\"><\/span><\/span><\/p>        <div id=\"exceptii-container\" class=\"toggle_wrap \"  >            <div class=\"toggle_content invers-color \"  itemprop=\"text\"   ><p>a) reclamantul a furnizat o explica\u021bie satisf\u0103c\u0103toare cu privire la nerespectarea respectivei obliga\u021bii;<\/p>\n<p style=\"text-align: justify;\">b) cererea prive\u0219te solicitarea unei m\u0103suri provizorii;<\/p>\n<p style=\"text-align: justify;\">c) Curtea decide altfel, la cererea reclamantului sau din oficiu.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-15  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<p style=\"text-align: justify;\"><strong>5.2. Curtea poate \u00een orice moment s\u0103 solicite unui reclamant s\u0103 transmit\u0103 \u00eentr-un termen determinat orice informa\u021bie sau document utile \u00een forma sau maniera considerate adecvate.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>6. a) Cererea este considerat\u0103 introdus\u0103 la data la care formularul de cerere care satisface exigen\u021bele impuse de prezentul articol de fa\u021b\u0103 este expediat Cur\u021bii. Data expedierii este considerat\u0103 data \u0219tampilei po\u0219tei.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>b) Dac\u0103 consider\u0103 justificat, Curtea poate decide s\u0103 re\u021bin\u0103 o alt\u0103 dat\u0103 ca dat\u0103 a introducerii cererii.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>7. Reclamantul trebuie s\u0103 informeze Curtea cu privire la schimbarea adresei sale \u0219i \u00een leg\u0103tur\u0103 cu orice fapt pertinent \u00een examinarea cererii sale.<\/strong><\/p>\n<h4 style=\"text-align: justify;\">Cum se completeaz\u0103 formularul de cerere<\/h4>\n<ul style=\"text-align: justify;\">\n<li><strong>Scrie\u021bi cite\u021b<\/strong> &#8211; este de preferat s\u0103 dactilografia\u021bi r\u0103spunsurile.<\/li>\n<li><strong>Completa\u021bi toate rubricile aplicabile situa\u021biei dvs<\/strong> &#8211; \u00cen caz contrar, formularul dumneavoastr\u0103 va fi considerat incomplet \u0219i va fi refuzat.<\/li>\n<li><strong>Nu utiliza\u021bi simboluri sau abrevieri<\/strong>, exprima\u021bi-v\u0103 clar, folosi\u021bi cuvinte \u00eentregi.<\/li>\n<li><strong>Fi\u021bi concis<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Limba<\/strong><br \/>\nLimbile oficiale ale Cur\u021bii sunt franceza \u0219i engleza dar, dac\u0103 v\u0103 este mai simplu, pute\u0163i de asemenea scrie grefei \u00een limba oficial\u0103 a unuia dintre statele care au ratificat Conven\u021bia. \u00cen faza ini\u021bial\u0103 a procedurii, este posibil s\u0103 primi\u021bi din partea Cur\u021bii scrisori redactate \u00een aceast\u0103 din urm\u0103 limb\u0103. Unii reclaman\u021bi aleg s\u0103 nu participe ei \u00een\u0219i\u0219i la procedur\u0103 sau nu sunt \u00een m\u0103sur\u0103 s\u0103 o fac\u0103, din motive, de exemplu, de s\u0103n\u0103tate sau incapacitate. Aceast\u0103 persoan\u0103 trebuie, \u00een m\u0103sura \u00een care este posibil, s\u0103 furnizeze dovezi (documente) care atest\u0103 dreptul s\u0103u de a reprezenta organiza\u021bia reclamant\u0103.<\/p>\n<p style=\"text-align: justify;\"><strong>Avocat<\/strong><br \/>\n24-40. Numele \u0219i coordonatele complete ale avocatului care reprezint\u0103 reclamantul \u00een fa\u021ba Cur\u021bii trebuie men\u021bionate. \u00cen momentul introducerii cererii, reprezentarea de c\u0103tre un avocat nu este obligatorie, dar este totu\u0219i recomandat\u0103. Dac\u0103 cererea ajunge \u00eentr-un stadiu al procedurii \u00een care reprezentarea devine obligatorie, reclamantul este informat despre aceasta. \u00cen acest stadiu, dup\u0103 ce Curtea a hot\u0103r\u00e2t s\u0103 comunice cererea guvernului p\u00e2r\u00e2t pentru a ob\u021bine observa\u021biile scrise ale acestuia, reclamantul poate avea dreptul la asisten\u021b\u0103 judiciar\u0103 dac\u0103 nu are mijloacele de a se achita de onorariile de avocat \u0219i dac\u0103 acordarea unui astfel de ajutor financiar este considerat\u0103 necesar\u0103 pentru buna desf\u0103\u0219urare a cazului. Reclamantul este informat din timp asupra pa\u0219ilor pe care trebuie s\u0103-i urmeze \u00een acest sens.<\/p>\n<p style=\"text-align: justify;\"><strong>Procura<\/strong><br \/>\n31. Reclamantul individual trebuie s\u0103 semneze procura care \u00eel \u00eemputernice\u0219te pe reprezentant s\u0103 ac\u021bioneze \u00een numele s\u0103u, cu excep\u021bia cazului \u00een care nu este \u00een m\u0103sur\u0103 s\u0103 semneze pentru c\u0103, de exemplu, este minor sau nu are capacitate juridic\u0103. Dac\u0103 un reprezentant, care nu este avocat, \u00eemputernice\u0219te un avocat s\u0103 reprezinte un reclamant care nu este \u00een m\u0103sur\u0103 s\u0103 semneze procura, reprezentantul trebuie s\u0103 semneze procura \u00een numele reclamantului.<\/p>\n<p style=\"text-align: justify;\">31. Data care trebuie men\u021bionat\u0103 la aceast\u0103 rubric\u0103 este data la care reclamantul individual sau reprezentantul organiza\u021biei reclamante semneaz\u0103 procura.<\/p>\n            <\/div>        <\/div>    <\/div><\/section>\n<\/div><\/p>\n<p style=\"text-align: justify;\"><div  style='height:1px' class='hr hr-invisible   avia-builder-el-17  el_after_av_toggle_container  el_before_av_toggle_container '><span class='hr-inner ' ><span class='hr-inner-style'><\/span><\/span><\/div><\/p>\n<p style=\"text-align: justify;\"><strong>Statul sau statele \u00eempotriva c\u0103ruia\/c\u0103rora este \u00eendreptat\u0103 cererea<\/strong><\/p>\n<p style=\"text-align: justify;\">33. Fi\u021bi concis. Men\u021biona\u021bi aici informa\u021biile esen\u021biale cu privire la cazul dumneavoastr\u0103: faptele \u0219i deciziile esen\u021biale \u0219i felul \u00een care drepturile dumneavoastr\u0103 au fost \u00eenc\u0103lcate. Nu men\u021biona\u021bi circumstan\u021bele nepertinente \u0219i nici chestiunile secundare. Nu v\u0103 folosi\u021bi de citate lungi ci face\u021bi trimitere mai degrab\u0103 la un document anexat. Explica\u021bi c\u00e2t mai precis posibil care este pl\u00e2ngerea dumneavoastr\u0103 cu privire la Conven\u021bie. Indica\u021bi care este dispozi\u021bia din Conven\u021bie pe care o invoca\u021bi \u0219i explica\u021bi cum anume faptele pe care le-a\u021bi expus \u00eencalc\u0103 aceast\u0103 dispozi\u021bie.
