You may click the link to switch the active language.<\/p><section class=\"av_textblock_section \"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/CreativeWork\" ><div class='avia_textblock  '   itemprop=\"text\" ><h3>Executarea hot\u0103r\u00e2rilor Cur\u0163ii<\/h3>\n<p>Dup\u0103 ob\u021binerea unei solu\u021bii favorabile la CEDO se pune problema execut\u0103rii acelei hot\u0103r\u00e2ri la nivel na\u021bional. De\u0219i Rom\u00e2nia pierde un num\u0103r record de cazuri la CEDO, de cele mai multe ori nu sunt implementate m\u0103surile generale impuse de deciziile CEDO.<br \/>\nAplicarea acestor m\u0103suri generale ar avea ca rezultat remedierea pe plan intern a tuturor \u00eenc\u0103lc\u0103rilor similare.<\/p>\n<p>Ca urmare a cazurilor repetitive pe care Rom\u00e2nia la pierde la CEDO, statul rom\u00e2n trebuie s\u0103 achite costuri substan\u021biale &#8211; 2.000.000 de euro doar \u00een 2011.<\/p>\n<p>\u00cen prezent implementarea hot\u0103r\u00e2rilor CEDO se face printr-o procedur\u0103 opac\u0103, de c\u0103tre Agentul guvernamental pentru CEDO (aflat \u00een subordinea MAE), care elaboreaz\u0103 un plan de ac\u021biune cu m\u0103surile pentru executarea fiec\u0103rei hot\u0103r\u00e2ri CEDO \u00een parte, pe care \u00eel prezint\u0103 Comitetului de Mini\u0219tri al Consiliului Europei, care supervizeaz\u0103 executarea hot\u0103r\u00e2rilor. Organiza\u021biile neguvernamentale au posibilitatea de a-\u0219i expune punctul de vedere cu privire la aceste planuri, \u00eens\u0103 potrivit site-ului Comitetului de Mini\u0219tri de prea pu\u021bine ori s-a f\u0103cut acest lucru.<\/p>\n<p>\u0218i cet\u0103\u021benii care au c\u00e2\u0219tigat la CEDO se pot adresa Comitetului de Mini\u0219tri cu privire la m\u0103surile care \u00eei privesc direct. Este, deci, necesar ca persoanele interesate \u0219i societatea civil\u0103 s\u0103 fie informate \u0219i se implice mult mai activ \u00een mecanismului de executare a hot\u0103r\u00e2rilor CEDO, pentru a asigura adoptarea \u0219i implementarea unor planuri de ac\u021biune relevante \u0219i eficiente la nivel na\u021bional, \u00eent\u0103rind astfel sistemul de protec\u021bie a drepturilor<\/p>\n<h3>1. Hot\u0103r\u00e2rile Cur\u0163ii pot fi executate numai dac\u0103 sunt definitive. C\u00e2nd r\u0103m\u00e2ne definitiv\u0103 o hot\u0103r\u00e2re a Cur\u0163ii.<\/h3>\n<p>Spre deosebire de sistemul din Rom\u00e2nia, \u00een care instan\u0163a pronun\u0163\u0103 solu\u0163ia la o dat\u0103 \u015fi \u00ee\u015fi motiveaz\u0103 hot\u0103r\u00e2rea la o alt\u0103 dat\u0103 (care poate \u00eensemna luni sau, mai rar, ani distan\u0163\u0103 fa\u0163\u0103 de momentul pronun\u0163\u0103rii), \u00een sistemul Cur\u0163ii, la data pronun\u0163\u0103rii solu\u0163iei, hot\u0103r\u00e2rea este \u015fi motivat\u0103\/redactat\u0103, \u015fi publicat\u0103 pe site.<\/p>\n<p>Hot\u0103r\u00e2rea Cur\u0163ii r\u0103m\u00e2ne definitiv\u0103 dup\u0103 3 luni de la data pronun\u0163\u0103rii ei, dac\u0103, \u00een acest interval, o parte nu a cerut trimiterea cauzei la Marea Camer\u0103, spre reexaminare.<br \/>\nReexaminarea este un fel de \u201crecurs\u201d, dar care poate fi declarat numai pentru motive cu adev\u0103rat excep\u0163ionale. Sunt astfel de motive situa\u0163iile \u00een care cauza respectiv\u0103 ridic\u0103 o problem\u0103 grav\u0103 privitoare la interpretarea conven\u0163iei sau a protocoalelor sale, ori \u00een care solu\u0163ionarea unei probleme poate conduce la o contradic\u0163ie cu o hot\u0103r\u00e2re pronun\u0163at\u0103 anterior de Curte (=schimbarea jurispruden\u0163ei Cur\u0163ii).<\/p>\n<p>Cererea de trimitere la Marea Camer\u0103 pentru reexaminare este analizat\u0103 de un complet de judec\u0103tori, care decide dac\u0103 este sau nu cazul s\u0103 fie sesizat\u0103 Marea Camer\u0103. Dac\u0103 decizia acestui complet este de respingere a solicit\u0103rii de sesizare, hot\u0103r\u00e2rea Cur\u0163ii r\u0103m\u00e2ne definitiv\u0103 la data acestei decizii. Dac\u0103 se decide sesizarea Marii Camere, solu\u0163ionarea definitiv\u0103 a cazului are loc numai la data pronun\u0163\u0103rii unei hot\u0103r\u00e2ri a Marii Camere.<\/p>\n<h3>2. Cum se execut\u0103 hot\u0103r\u00e2rile Cur\u0163ii<\/h3>\n<p>Hot\u0103r\u00e2rea definitiv\u0103 a Cur\u0163ii care d\u0103 dreptate reclamantului (=constat\u0103 o violare a unui drept din Conven\u0163ie) este transmis\u0103 de Curte c\u0103tre Comitetul de Mini\u015ftri al Consiliului Europei, care are ca atribu\u0163ii supravegherea execut\u0103rii de c\u0103tre state a hot\u0103r\u00e2rilor Cur\u0163ii (art. 46 par. 2 din Conven\u0163ie).<\/p>\n<p>Supravegherea efectuat\u0103 de Comitetul de Mini\u015ftri prive\u015fte at\u00e2t plata sumei de bani (desp\u0103gubiri) pe care statul a fost obligat prin hot\u0103r\u00e2rea Cur\u0163ii s\u0103 o pl\u0103teasc\u0103 reclamantului, c\u00e2t \u015fi luarea de c\u0103tre stat a unor m\u0103suri cu caracter individual (de exemplu, restituirea \u00een natur\u0103 a unui bun) s\u0103u general (de exemplu, modific\u0103ri legislative interne) pentru a preveni existen\u0163a unor viol\u0103ri similare de drepturi.<\/p>\n<p>Desp\u0103gubirile se pl\u0103tesc de stat \u00een termenul prev\u0103zut \u00een hot\u0103r\u00e2rea Cur\u0163ii, care, de regul\u0103, este de 3 luni de la r\u0103m\u00e2nerea definitiv\u0103 a hot\u0103r\u00e2rii Cur\u0163ii.<\/p>\n<p>M\u0103surile cu caracter general, care presupun un ansamblu de activit\u0103\u0163i, inclusiv modific\u0103ri de natur\u0103 legislativ\u0103, se execut\u0103 \u00eentr-un termen mai \u00eendelungat \u015fi mult mai pu\u0163in precis dec\u00e2t cel \u00een care trebuie pl\u0103tite desp\u0103gubirile.<\/p>\n<p>Persoanele care se consider\u0103 lezate de modul \u00een care statul \u00ee\u015fi execut\u0103 (sau nu) obliga\u0163iile de a pl\u0103ti desp\u0103gubirile, de a lua m\u0103suri cu caracter individual s\u0103u general, astfel cum rezult\u0103 din hot\u0103r\u00e2rea Cur\u0163ii, se pot adresa direct, cu o sesizare, Comitetului de Mini\u015ftri.<\/p>\n<\/div><\/section>\n<div id='avia-messagebox-' class='avia_message_box  avia-color-blue avia-size-large avia-icon_select-no avia-border-  avia-builder-el-1  el_after_av_textblock  avia-builder-el-last '><div class='avia_message_box_content' ><p>Afl\u0103 ce se \u00eent\u00e2mpl\u0103 dup\u0103 o condamnare la CEDO \u0219i cine este responsabil cu supravegherea implement\u0103rii hot\u0103r\u00e2rilor cur\u021bii. <a href=\"http:\/\/www.coe.int\/t\/dghl\/monitoring\/execution\/Presentation\/Video_ro.asp\" target=\"_blank\" rel=\"noopener\">Un video explicativ \u00een limba rom\u00e2n\u0103<\/a><\/p>\n<\/div><\/div>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Rom\u00e2n\u0103.
