Propunerea vizeaz\u0103 \u00eembun\u0103t\u0103\u021birea mecanismului de raportare financiar\u0103 \u00een privin\u021ba cheltuielilor cu presa, \u0219tiut fiind faptul c\u0103 partidele parlamentare din Rom\u00e2nia au virat \u00een ultimii ani sume importante de bani c\u0103tre diverse companii de media, f\u0103r\u0103 o transparen\u021b\u0103 a acestui proces. La r\u00e2ndul lor, organismele de pres\u0103 au acceptat banii \u0219i livrat materiale de propagand\u0103 politic\u0103, f\u0103r\u0103 s\u0103 fie marcate ca atare. \u00cen final, publicul rom\u00e2n este cel care pierde din aceast\u0103 tranzac\u021bie, \u00eentruc\u00e2t prime\u0219te propagand\u0103 politic\u0103 pl\u0103tit\u0103 de partide, \u00een loc de \u0219tiri \u0219i informa\u021bii obiective. \u00cen ultimul raport privind statul de drept al Comisiei Europene a fost abordat\u0103 aceast\u0103 problem\u0103, recomandarea Comisiei fiind tocmai \u00eembun\u0103t\u0103\u021birea transparen\u021bei acestui proces de finan\u021bare.<\/p>\n<p style=\"text-align: justify;\">Conform Legii 334\/2006 privind finan\u0163area activit\u0103\u0163ii partidelor politice \u015fi a campaniilor electorale, partidele politice primesc anual subven\u021bii de la bugetul de stat este de cel pu\u0163in 0,01% \u015fi de cel mult 0,04% din Produsul Intern Brut. Potrivit unui <a href=\"https:\/\/expertforum.ro\/wp-content\/uploads\/2023\/08\/PB153subventii.pdf\" target=\"_blank\" rel=\"noopener\">studiu realizat de exper\u021bi<\/a> \u00een chestiuni electorale, numai \u00een 2023 partidele politice care au realizat pragul electoral la alegerile precedente au primit subven\u021bii din bugetul public \u00een valoare total\u0103 de 258 de milioane de lei (circa 51 milioane euro), \u00een cre\u0219tere fa\u021b\u0103 de 2022 cu 4 milioane euro.<\/p>\n<p style=\"text-align: justify;\">\u00cen acela\u0219i studiu, se men\u021bioneaz\u0103 c\u0103, \u00een primele 6 luni ale anului 2023, partidele au cheltuit cei mai mul\u021bi bani din subven\u021biile de la stat pentru <em>pres\u0103 \u0219i propagand\u0103 (49%)<\/em>, bunuri mobile \u0219i imobile (10%), personal (9%), consultan\u021b\u0103 politic\u0103 (7%) \u0219i activit\u0103\u021bi cu caracter politic (5%).<\/p>\n<p style=\"text-align: justify;\">Av\u00e2nd \u00een vedere c\u0103 <strong>jum\u0103tate din subven\u021biile de la stat primite de partide sunt cheltuite pentru pres\u0103 \u0219i propagand\u0103<\/strong>, cre\u0219terea tansparen\u021bei ar trebui s\u0103 priveasc\u0103, \u00een primul r\u00e2nd, finan\u021barea mass-media de c\u0103tre partide. Una dintre consecin\u021be ar fi cre\u0219terea \u00eencrederii publice \u00een media, suspectat\u0103 c\u0103, \u00eentr-o m\u0103sur\u0103 semnificativ\u0103, ar fi \u201ecump\u0103rat\u0103\u201d de partidele politice care folosesc, \u00een acest scop, subven\u021biile de la stat.<\/p>\n<p><strong>Propunerea APADOR-CH de modificare a legii privind finan\u021barea partidelor politice<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00centruc\u00e2t legea finan\u021b\u0103rii partidelor se afl\u0103 \u00een Parlament, pentru modific\u0103ri, fiind deja adoptat\u0103 de Senat, APADOR-CH a transmis Camerei Deputa\u021bilor o propunere de \u00eembun\u0103t\u0103\u021bire a articolului care stabile\u0219te\u00a0obliga\u021bia partidelor care primesc subven\u021bii de la stat de a comunica Autorit\u0103\u021bii Electorale Permanente, p\u00e2n\u0103 la data de 25 a fiec\u0103rei luni, situa\u021bia defalcat\u0103 a cheltuielilor efectuate din subven\u021bii de la bugetul de stat \u00een luna anterioar\u0103. \u201eSitua\u021bia defalcat\u0103\u201d include, conform proiectului, \u0219i \u201e<em>lista furnizorilor si valoarea produselor sau serviciilor prestate<\/em>.\u201d Aceast\u0103 nou\u0103 prevedere reprezint\u0103 un progres pe calea transparen\u021bei, dar nu ajut\u0103 la dezv\u0103luirea \u00eentregului lan\u021b al prestatorilor serviciului pl\u0103tit de partide din subventii de la stat. Reglementarea face posibil\u0103 doar dezv\u0103luirea primului prestator, dar nu \u0219i a ultimului, a celui final, care, practic, execut\u0103 presta\u021bia.<\/p>\n<p style=\"text-align: justify;\">Aceast\u0103 practic\u0103 permite deja partidelor s\u0103 vireze bani c\u0103tre pres\u0103 prin intermediul unor agen\u021bii de comunicare, care la r\u00e2ndul lor vor transmite banii c\u0103tre diversele posturi TV sau site-uri de \u0219tiri. Partidul este obligat s\u0103 fac\u0103 public doar numele agen\u021biei de comunicare intermediare, \u00een schimb vor r\u0103m\u00e2ne necunoscute acele televiziuni \u0219i site-uri care primesc efectiv banii \u0219i livreaz\u0103 materialele de propagand\u0103 nemarcate ca atare, a\u0219adar legea nu \u00ee\u0219i atinge scopul de tranparentizare a rela\u021biei dintre politic\u0103 \u0219i pres\u0103.<\/p>\n<p style=\"text-align: justify;\">De aceea, al. 3 al art. 27\/1, propus prin proiectul de modificare a legii, ar trebui completat cu o prevedere \u00een sensul c\u0103 dac\u0103 servciiile prestate sunt contractate prin intermediari (caz \u00een care, contractantul initial nu este si prestatorul final), lista furnizorilor ce trebuie comunicat\u0103 va cuprinde at\u00e2t fiecare intermediar, c\u00e2t \u0219i pe cel\/cei care vor presta efectiv serviciul, adic\u0103 \u0219i fiecare furnizor (prestator) final. Mai precis, obliga\u021bia comunic\u0103rii trebuie s\u0103 se refere la numele\/denumirea fiec\u0103rei persoane fizice sau juridice din lan\u021bul prestatorilor seriviciului, cu indicarea, pentru fiecare, a\u00a0 obiectului, valorii \u0219i datei pl\u0103\u021bii.<\/p>\n<p style=\"text-align: justify;\">Conform recomand\u0103rii APADOR-CH, pentru modificarea \u015fi completarea Legii nr.334\/2006 privind finan\u0163area activit\u0103\u0163ii partidelor politice \u015fi a campaniilor electorale (PL-x nr. 516\/2023) art. 27\/1 al. 3 ar urma s\u0103 aib\u0103 urm\u0103torul con\u021binut:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">(3) <em>Prin situa\u021bia defalcat\u0103 prev\u0103zut\u0103 la alin. 1 lit. b se \u00een\u021belege inclusiv<\/em> <em>lista furnizorilor si valoarea produselor sau serviciilor prestate<\/em>. <strong><em>Lista va curpinde at\u00e2t numele\/denumirea fiec\u0103rui intermediar, c\u00e2t \u0219i numele\/denumirea furnizorului final al serviciului, cu indicarea, pentru fiecare,<\/em><\/strong><em> <strong>a\u00a0 obiectului, valorii \u0219i datei pl\u0103\u021bii.<\/strong><\/em>\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\u00cen caz contrar, benficiarul real al sumelor pl\u0103tite de partid va ram\u00e2ne necunsocut, cunoscut fiind doar intermediarul (posibil, o firm\u0103 paravan), nu \u0219i subcontractorul sau cel care, \u00een final, presteaz\u0103 efectiv serviciul.\u00a0 C\u00e2nd e vorba de media, necesitatea comunic\u0103rii \u00eentregului lan\u021b de prestatori este chiar mai sporit\u0103, pentru ca publicul s\u0103 poat\u0103 aprecia dac\u0103 exist\u0103 o rela\u021bie \u00eentre finan\u021barea primit\u0103 de o entitate media \u0219i o anumit\u0103 politic\u0103 editorial\u0103.<\/p>\n<p style=\"text-align: justify;\">","protected":false},"excerpt":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\">Sorry, this entry is only available in <a href=\"https:\/\/apador.org\/ro\/wp-json\/wp\/v2\/posts\/10852\" class=\"qtranxs-available-language-link qtranxs-available-language-link-ro\" title=\"Rom\u00e2n\u0103\">Rom\u00e2n\u0103<\/a>.
