Solicit\u0103m ca PNL \u0219i PSD s\u0103 renun\u021be la astfel de propuneri \u0219i s\u0103 organizeze alegerile astfel \u00eenc\u00e2t s\u0103 nu afecteze drepturile electorale fundamentale, conform principiilor constitu\u021bionale \u0219i standardelor interna\u021bionale asumate.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Comasarea alegerilor va avea efecte negative din mai multe puncte de vedere. <\/span><b>Modificarea legisla\u021biei electorale pe teme majore, cu mai pu\u021bin de cinci luni \u00eenaintea alegerilor contravine standardelor interna\u021bionale asumate de Rom\u00e2nia<\/b><span style=\"font-weight: 400;\">. Codul bunelor practici \u00een materie electoral\u0103 al Comisiei de la Vene\u021bia indic\u0103 faptul c\u0103 un an \u00eenainte de alegeri ar trebui evitate schimb\u0103rile legislative cu impact major, afect\u00e2ndu-se chiar credibilitatea procesului electoral. De\u0219i nu sunt interzise, iar adoptarea unor m\u0103suri pozitive este permis\u0103, \u00een acest caz comasarea nu face dec\u00e2t s\u0103 afecteze drepturile aleg\u0103torilor \u00een mod negativ. \u0218i nu vorbim \u00een niciun caz despre modific\u0103ri aduse cu mai mult de un an, ci despre o perioad\u0103 foarte scurt\u0103 de patru luni, \u00een care se presupune c\u0103 vor opera mai multe modific\u0103ri legislative.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Reamintim \u0219i c\u0103 alegerile locale anterioare au avut loc la finalul lunii septembrie, mandatul ale\u0219ilor locali este de patru ani, iar organizarea unui scrutin \u00een luna iunie ar putea crea confuzie cu privire la preluarea mandatelor acestora. Conform Codului Administrativ consiliul local se constituie \u00een cel mult 60 de zile de la data alegerilor, iar comasarea ar putea determina \u00een fapt scurtarea mandatelor acestora, afect\u00e2nd \u0219i \u00eenceperea exercit\u0103rii mandatului de c\u0103tre primari. Comasarea ar presupune modific\u0103ri sau derog\u0103ri ale legisla\u021biei cu privire la termenele de preluare a mandatelor, cu mai pu\u021bin de patru luni \u00eenainte de ziua alegerilor, ceea ce afecteaz\u0103 principiul securit\u0103\u021bii raporturilor juridice.\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Va fi afectat <\/span><b>dreptul de vot<\/b><span style=\"font-weight: 400;\">. O consecin\u021b\u0103 grav\u0103 a acestei decizii este c\u0103 <\/span><b>pentru alegerile locale s-ar elimina de facto dreptul de a vota la adresa de re\u0219edin\u021b\u0103 pentru aleg\u0103torii care nu \u0219i-au \u00eenregistrat re\u0219edin\u021ba cu cel t\u00e2rziu \u0219ase luni \u00eenaintea datei alegerilor, adic\u0103 la \u00eenceputul lui ianuarie<\/b><span style=\"font-weight: 400;\">. Aceast\u0103 reglementare, introdus\u0103 \u00een 2023, era oricum restrictiv\u0103, dar \u00een acest context nu face dec\u00e2t s\u0103 extind\u0103 \u0219i mai mult num\u0103rul celor care nu vor putea utiliza aceast\u0103 op\u021biune, ceea ce echivaleaz\u0103 cu restr\u00e2ngerea exerci\u021biului unui drept fundamental<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Printre drepturile afectate se num\u0103r\u0103<\/span><b> dreptul de a candida \u0219i a de fi ales <\/b><span style=\"font-weight: 400;\">la candidatur\u0103, \u00eentruc\u00e2t desf\u0103\u0219urarea alegerilor \u00een paralel ar elimina posibilitatea depunerii de candidaturi pentru ambele tipuri de alegeri.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Comasarea alegerilor va produce confuzii legislative pentru aleg\u0103tori \u0219i posibil pentru organizatorii alegerilor<\/b><span style=\"font-weight: 400;\">. Legile utilizate pentru organizarea celor dou\u0103 tipuri nu sunt armonizate. Un astfel de exemplu este modul \u00een care se formeaz\u0103 birourile electorale, regulile fiind diferite. Autorit\u0103\u021bile care organizeaz\u0103 alegerile sunt diferite. De exemplu, la europarlamentare, Ministerul Afacerilor Interne are roluri pe care le \u00eendepline\u0219te Autoritatea Electoral\u0103 Permanent\u0103 pentru locale. Acreditarea observatorilor se face dup\u0103 reguli diferite, la niveluri diferite, ceea ce ar putea limita posibilitatea de a monitoriza procesul \u0219i deci s-ar reduce transparen\u021ba. EFOR\u00a0<\/span><a href=\"https:\/\/expertforum.ro\/problemele-grave-europarlamentare\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a atras aten\u021bia asupra problemelor grave legate de Legea 33\/2007<\/span><\/a><span style=\"font-weight: 400;\">, pentru organizarea alegerilor europarlamentare, care risc\u0103 s\u0103 afecteze organizarea alegerilor \u0219i care nu a fost nicidecum o prioritate pentru politicieni din 2019 p\u00e2n\u0103 ast\u0103zi. Comasarea alegerilor ar putea genera \u0219i alte modific\u0103ri legislative de ultim moment, care ar completa \u0219i mai mult acest scenariu de instabilitate legislativ\u0103.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Comasarea afecteaz\u0103 principiile legislative fundamentale care \u021bin de <\/span><b>claritate \u0219i stabilitate legislativ\u0103<\/b><span style=\"font-weight: 400;\">, prin faptul c\u0103 suprapunerea unor reguli electorale diferite, un num\u0103r mai mare de buletine de vot (5 buletine), votul \u00een circumscrip\u021bii diferite <\/span><b>ar putea afecta participarea informat\u0103 a aleg\u0103torilor<\/b><span style=\"font-weight: 400;\">. Acest ultim aspect este important, \u00eentruc\u00e2t aleg\u0103torii ar putea fi confuzi cu privire la modul \u00een care sunt aronda\u021bi la sec\u021biile de votare, mai ales c\u0103 la europarlamentare se voteaz\u0103 \u0219i \u00een str\u0103in\u0103tate, iar la locale ace\u0219tia sunt dependen\u021bi strict de adresa de domiciliu sau re\u0219edin\u021b\u0103.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><b>Alegerile europarlamentare \u0219i cele locale se desf\u0103\u0219oar\u0103 dup\u0103 logici electorale diferite<\/b><span style=\"font-weight: 400;\">, iar temele din campaniile electorale ar induce confuzie \u0219i ar crea neclarit\u0103\u021bi. Practic, s-ar suprapune teme europene cu subiecte care \u021bin de comunit\u0103\u021bile locale, care pot fi foarte specifice. Mai mult, finan\u021barea celor dou\u0103 campanii electorale s-ar putea suprapune, fapt care ar putea genera dificult\u0103\u021bi \u00een asigurarea controlului \u0219i transparen\u021bei celor dou\u0103 campanii. Apoi, <\/span><b>comasarea ar favoriza partidele mari, tradi\u021bionale, cu resurse generoase din subven\u021bii<\/b><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/expertforum.ro\/taiati-din-subventiile-pentru-partidele-politice-in-2024\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">314 milioane de lei \u00een 2024<\/span><\/a><span style=\"font-weight: 400;\">), \u00een defavoarea celor care au obiective politice \u0219i electorale doar la nivel regional sau local.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Consider\u0103m c\u0103 argumentele pe care le-au adus cele dou\u0103 partide \u00een spa\u021biul public nu se sus\u021bin \u0219i sunt strict calcule politice, bazate pe interese de partid, realizate \u00een detrimentul principiilor democratice \u0219i drepturilor aleg\u0103torilor. <\/span><b>Economiile care ar rezulta din aceste alegeri nu sunt un argument care s\u0103 sus\u021bin\u0103 inten\u021bia PSD \u0219i PNL. De altfel, reducerea unor costuri &#8211; care erau predictibile &#8211; \u00een detrimentul echilibrului democratic nu este de dorit. <\/b><span style=\"font-weight: 400;\">Reamintim c\u0103 CCR a enun\u021bat \u00een Decizia 51\/2012, prin care a stabilit neconstitu\u021bionalitatea legii care propunea comasarea alegerilor locale \u0219i parlamentare, c\u0103 economiile aduse la buget nu justific\u0103 o astfel de decizie.
