You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><em>APADOR-CH a transmis c\u00e2teva propuneri de clarificare a proiectului de lege privind ap\u0103rarea na\u021bional\u0103; Sunt cel pu\u021bin trei probleme: posibilitatea reinstituirii stagiul militar obligatoriu, excluderea Parlamentului din decizia de intrare \u00een r\u0103zboi a \u021b\u0103rii \u0219i <i>lipsa unei defintii legale a <\/i>\u201eamenin\u021b\u0103rilor hibride\u201d<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\">Ministerul Ap\u0103r\u0103rii Na\u021bionale (MApN) a pus \u00een dezbatere public\u0103 <a href=\"https:\/\/sg.mapn.ro\/proiecte\/legea_apararii_nationale_a_romaniei_660aa6d057330.pdf\" target=\"_blank\" rel=\"noopener\">un proiect de lege pentru ap\u0103rarea patriei<\/a>. APADOR-CH a identificat \u00een acest text cel pu\u021bin trei probleme, care se cer clarificate:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Intr\u0103m \u00een r\u0103zboi f\u0103r\u0103 s\u0103 \u0219tim de ce<\/strong> &#8211; No\u021biunea de \u201eamenin\u021b\u0103ri hibride\u201d nu este definit\u0103 \u00een lege (la art. 4 alin. 3 din proiect), de\u0219i acest soi de amenin\u021b\u0103ri permit Parlamentului s\u0103 angajeze capabilit\u0103\u0163i militare \u015fi nonmilitare pe teritoriul \u0163\u0103rii sau \u00een afara \u0163\u0103rii. Adic\u0103 s\u0103 ne bage \u00een r\u0103zboi. Pe site-ul MApN exist\u0103 o trimitere c\u0103tre o descriere a acestui termen, de pe site-ul Comisiei Europene, \u00eens\u0103 o \u021bar\u0103 nu poate fi b\u0103gat\u0103 \u00een r\u0103zboi pe baza unui link, ci pe baza unor defini\u021bii clare prev\u0103ute de lege, de care parlamentarii s\u0103 \u021bin\u0103 cont atunci c\u00e2nd decid dac\u0103 ne bag\u0103 \u00een r\u0103zboi sau nu. Pentru a implica \u0163ara \u00een r\u0103zboi, este necesar ca Parlamentul s\u0103 cunoasc\u0103 \u00een mod foarte clar, s\u0103 aib\u0103 reprezentarea corect\u0103 \u015fi complet\u0103 a ceea ce \u00eenseamn\u0103 \u201eamenin\u0163area hibrid\u0103\u201d pe care dore\u015fte s\u0103 o anihileze, chiar cu riscul declan\u015f\u0103rii unui r\u0103zboi;<\/li>\n<li><strong>Pre\u0219edintele \u0219i premierul ne pot b\u0103ga \u00een r\u0103zboi f\u0103r\u0103 acordul Parlamentului<\/strong> &#8211; Art.4 alin. 4 permite ca dou\u0103 persoane, prim-ministrul \u015fi pre\u015fedintele \u0163\u0103rii, s\u0103 angajze \u0163ara \u00eentr-un r\u0103zboi, de\u015fi, potrivit Constitu\u0163iei, doar Parlamentul poate decide intrarea \u00eentr-un r\u0103zboi. Redactarea neclar\u0103 a alin. 4 permite pre\u015fedintelui s\u0103 dispun\u0103 orice \u201em\u0103suri necesare\u201d, adic\u0103 \u015fi m\u0103suri care pot fi calificate ca acte de agresiune (interven\u0163ii armate \u00eempotriva\/pe teritoriul altei \u0163\u0103ri), dac\u0103 le consider\u0103 necesare pentru protec\u0163ia cet\u0103\u0163enilor rom\u00e2ni dintr-o \u0163ar\u0103 str\u0103in\u0103. Aceast\u0103 atribu\u0163ie ar trebui s\u0103 revin\u0103 exclusiv Parlamentului, nu pre\u015fedintelui, deoarece potrivit art. 65 din Constituie, numai Parlamentul poate declara starea de r\u0103zboi. Ca atare, la art. 4 alin. 4 din proiect ar trebui \u00eenlocuit\u0103 sintagma \u201ePre\u015fedintele Rom\u00e2niei\u201d cu \u201eParlamentul Rom\u00e2niei\u201d.<\/li>\n<li><strong>Armata obligatorie se \u00eentoarce. Pe \u0219est <\/strong>&#8211; Art. 28 lit. d din proiect prevede c\u0103 Ministerul Ap\u0103r\u0103rii Na\u0163ionale \u201e<em>organizeaz\u0103, cu caracter permanent, preg\u0103tirea popula\u0163iei pentru ap\u0103rare\u2026\u201d.<\/em> Modul ambiguu \u00een care este redactat\u0103 aceast\u0103 atribu\u0163ie nu exclude posibilitatea instituirii unui stagiu obligatoriu de preg\u0103tire militar\u0103 pentru popula\u0163ie. Mai ales c\u0103 \u00een expunerea de motive la actualul proiect de lege, printre motivele care au creat probleme pentru ap\u0103rarea na\u0163ional\u0103, este enumerat\u0103, pe primul loc, legea care suspend\u0103 stagiul militar obligatoriu (Legea nr. 395\/2005 privind suspendarea pe timp de pace a serviciului militar obligatoriu \u015fi trecerea la serviciul militar pe baz\u0103 de voluntariat). Este discutabil dac\u0103 introducerea unei astfel de atribu\u0163ii a MApN, care poate afecta destul de sever via\u0163a obi\u015fnuit\u0103 a popula\u0163iei, nu ar trebui supus\u0103, pe l\u00e2ng\u0103 o dezbatere public\u0103 extins\u0103 \u015fi sincer\u0103, \u015fi unui referendum na\u0163ional.
