You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\">Pe site-ul Curtii Constitu\u021bionale a Rom\u00e2niei (CCR) a fost publicat\u0103, cu men\u021biunea \u201e<em>Nepublicat<\/em><em>\u0103<\/em>\u201d, \u201e<a href=\"https:\/\/www.ccr.ro\/wp-content\/uploads\/2024\/10\/HOTARAREA-nr.2.pdf\" target=\"_blank\" rel=\"noopener\"><em>H<\/em><em>otrarea nr. 2 din 5 octombrie 2024 privind contestarea \u00eenregistr\u0103rii candidaturii doamnei Diana Iovanovici-\u0218o\u0219oac\u0103 la alegerile pentru Pre\u0219edintele Rom\u00e2niei din anul 2024<\/em><\/a>\u201d<\/p>\n<p style=\"text-align: justify;\">Dup\u0103 cum este cunoscut, candidatura a fost respins\u0103 de CCR, cu o majoritate de 5 la 2, iar 2 judec\u0103tori au lipsit din complet. Cu alte cuvinte, din totalul de 9 judec\u0103tori care alc\u0103tuiesc completul CCR \u0219i particip\u0103 la judecarea fiec\u0103rui caz, doar 5 au votat \u00een favoarea acestei hot\u0103r\u00e2ri.\u00a0Este un indiciu c\u0103 problema cu privire la care CCR s-a pronun\u021bat este controversat\u0103 chiar \u0219i printre membrii CCR.<\/p>\n<p style=\"text-align: justify;\">Nu facem parte dintre sus\u021bin\u0103torii candidatei respinse sau ai exceselor acesteia. Dar, motivarea acestei hot\u0103r\u00e2ri ridic\u0103 unele probleme de principiu, pe care le prezent\u0103m, mai jos, pe scurt:<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">1.<\/span> Restr\u00e2ngerea dreptului de a fi ales s-a f\u0103cut de c\u0103tre CCR \u00een cadrul unei proceduri \u00een care persoana vizat\u0103 a fost lipsit\u0103 de dreptul la ap\u0103rare \u015fi de dreptul la o cale de atac (dreptul la recurs), drepturi prev\u0103zute distinct at\u00e2t \u00een Constitu\u0163ie, c\u00e2t \u015fi \u00een CEDO.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">2.<\/span> CCR, solu\u0163ion\u00e2nd contesta\u0163iile a dou\u0103 persoane cu privire la o candidatur\u0103 la pre\u015fedin\u0163ia \u0163\u0103rii, s-a substituit instan\u0163elor de judecat\u0103, stabilind r\u0103spunderea individual\u0103 a unui candidat pentru afirma\u0163ii, comportament \u015fi atitudine care nu au f\u0103cut anterior obiectul unor hot\u0103r\u00e2ri judec\u0103tore\u015fti pronun\u0163ate de instan\u0163ele de judecat\u0103 prin care s\u0103 se stabileasc\u0103 vinov\u0103\u0163ia\/responsabilitatea acestei persoane \u015fi interdic\u0163ia pentru aceasta de a candida. Men\u0163ion\u0103m c\u0103, \u00een cadrul procedurilor judiciare care se desf\u0103\u015foar\u0103 \u00een fa\u0163a instan\u0163elor judec\u0103tore\u015fti, sunt asigurate dreptul la ap\u0103rare \u015fi dreptul la exercitarea unei c\u0103i de atac. Iar interdic\u0163ia de a candida, <em>ca sanc\u0163iune pentru faptele unei persoane fizice<\/em>, poate fi dispus\u0103 doar de instan\u0163ele de judecat\u0103. Men\u0163ion\u0103m c\u0103, potrivit Constitu\u0163iei, CCR nu face parte din sistemul instan\u0163elor judec\u0103tore\u015fti. CCR verific\u0103 doar \u00eendeplinirea unor condi\u0163ii legale, nu aplic\u0103 sanc\u0163iuni unei persoane fizice pentru comportament \u015fi atitudine.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">3.<\/span> CCR a ad\u0103ugat, ad-hoc, o nou\u0103 condi\u0163ie la condi\u0163iile preexistente pentru a candida la pre\u015fedin\u0163ie, \u015fi anume condi\u0163ia \u201ecumin\u0163eniei\u201d candidatului. Motivul central al restr\u00e2ngerii dreptului de a candida a constat \u00een atitudinea\/conduita \u0219i <em>declara\u0163iile p<\/em><em>ubl<\/em><em>ice<\/em> ale candidatului (par. 38 din hot\u0103r\u00e2re), care intr\u0103 \u00een categoria \u201eantisistem\u201d. Cu alte cuvinte, CCR nu va accepta, \u00eencep\u00e2nd cu aceast\u0103 hot\u0103r\u00e2re, dec\u00e2t candidaturile la pre\u015fedin\u0163ie ale unor persoane care fac declara\u0163ii cumin\u0163i, conformiste, prosistem. Aceast\u0103 condi\u0163ie nou introdus\u0103 de CCR, a \u201ecumin\u0163eniei\u201d candidatului, reprezint\u0103 o restr\u00e2ngere substan\u0163ial\u0103 a dreptului la liber\u0103 exprimare, drept care protejeaz\u0103 nu doar opiniile favorabile, neutre, neconflictuale, ci \u015fi exprim\u0103rile care \u015focheaz\u0103, ofenseaz\u0103 sau scandalizeaz\u0103. Dac\u0103 aceste exprim\u0103ri dep\u0103\u015fesc limitele stabilite prin lege (de exemplu, declara\u0163ii rasiste sau care incit\u0103 la ur\u0103, la violen\u0163\u0103 \u015fcl), exist\u0103 proceduri prev\u0103zute \u00een legea penal\u0103 sau civil\u0103 care duc la sanc\u0163ionarea persoanei care a dep\u0103\u015fit limitele legale. Potrivit actualelor reglement\u0103ri, sanc\u0163ionarea persoanei fizice pentru astfel de \u201ederapaje\u201d se poate face doar de instan\u0163a de judecat\u0103, nu \u015fi de CCR, care nu este instan\u0163\u0103 de judecat\u0103. \u00cen cazul de fa\u0163\u0103, astfel de sanc\u0163iuni aplicate de instan\u0163ele de judecat\u0103, prin care a fost interzis\u0103 exercitarea dreptului de a candida, nu au fost identificate \u015fi invocate de CCR. \u00cen schimb, CCR a procedat direct la sanc\u0163ionarea candidatului pentru declara\u0163ii \u015fi conduit\u0103 necorespunz\u0103toare, lu\u00e2nd locul instan\u0163elor judec\u0103tore\u015fti competente.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">4.<\/span> CCR asimileaz\u0103 criticile \u0219i opozi\u021bia exprimate la adresa institu\u0163iilor europene sau organiza\u0163iilor militare interna\u0163ionale cu \u00eenc\u0103lc\u0103ri ale Constitu\u0163iei. Astfel, CCR afirm\u0103 c\u0103 \u201e<em>Apartenen\u021ba la UE \u0219i la NATO sunt op\u021biuni <\/em><u><em>fundamentale constitu\u021bionale<\/em><\/u><em>\u2026\u0219i, \u00een aceste condi\u021bii, reprezint\u0103 garan\u021bii ale valorilor \u00eenscrise \u00een Constitu\u021bie, fiind consacrate, de altfel, \u00een mod expres, prin aceasta. <\/em><u><em>Erodarea acestor valori<\/em><\/u><em> \u0219i garan\u021bii echivaleaz\u0103 cu o <\/em><u><em>respingere a op\u021biunilor democratice fundamentale<\/em><\/u><em>\u2026<\/em>\u201d(par. 39). Desigur c\u0103 integrarea euroatlantic\u0103 reprezint\u0103 un element pozitiv, dar asimilarea de c\u0103tre CCR a exprim\u0103rii criticii sau nemul\u0163umirii ori opozi\u0163iei la adresa unor entit\u0103\u0163i publice, perfectibile ca orice entitate public\u0103, cu \u201e<em>respingerea op\u0163iunilor democratice fundamentale<\/em>\u201d \u015fi cu \u201e<em>erodarea valorilor fundamentale constitu\u0163ionale<\/em>\u201d reprezint\u0103 o exagerare, un exces de zel protector, care are ca efect inhibarea unor dezbateri pe chestiuni de interes public.\u00a0 Specific societ\u0103\u0163ii democratice este c\u0103 \u00eendoielile, rezervele, criticile, nemul\u0163umirile cet\u0103\u0163enilor fa\u0163\u0103 de entit\u0103\u0163ile publice, chiar \u015fi cele \u00een curs de deificare la CCR, pot fi exprimate \u0219i discutate public, f\u0103r\u0103 inhibare, f\u0103r\u0103 teama de a fi\u00a0 calificat ca \u201e<em>erodant al societ\u0103\u0163ii democratice<\/em>\u201d. Dezbaterea liber\u0103 a chestiunilor de interes public este, totu\u015fi, esen\u0163a societ\u0103\u0163ii democratice. Spre exemplu, \u00een Marea Britanie, \u0163ar\u0103 \u00een care exist\u0103 un sistem democratic consolidat, dezbaterea privind Brexit nu a fost interzis\u0103 sau calificat\u0103 de vreo autoritate na\u0163ional\u0103 drept un atac la valorile democratice fundamentale. Democratic este s\u0103 existe c\u00e2t mai pu\u0163ine subiecte tabu \u015fi c\u00e2t mai mult\u0103 desacralizare.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">5.<\/span> \u00cen calitate de parlamentar, na\u0163ional \u015fi apoi european, un candidat beneficiaz\u0103 de imunitate pentru orice declara\u0163ii politice, fiind protejat de orice form\u0103 de r\u0103spundere juridic\u0103 pentru aceste declara\u0163ii. \u00cen consecin\u0163\u0103, parlamentarul este protejat sau ar trebui s\u0103 fie protejat de orice repercusiuni legate de aceste declara\u0163ii politice, inclusiv de repercusiunile const\u00e2nd \u00een interdic\u0163ia de a candida dispus\u0103 de CCR \u00een urma evalu\u0103rii declara\u021biilor politice pentru care exist\u0103 imunitate. Aceast\u0103 imunitate este prev\u0103zut\u0103, de asemenea, \u00een Constitu\u0163ie, \u00een art. 72.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-simple\" style=\"font-size:1.5em\">6.<\/span> Apeten\u0163a CCR de a se substitui instan\u0163elor de judecat\u0103 aduce un argument suplimentar \u00een favoarea unei <a href=\"https:\/\/apador.org\/eterna-controversa-a-numirii-judecatorilor-de-la-curtea-constitutionala\/\" target=\"_blank\" rel=\"noopener\">propuneri de revizuire a Constitu\u0163iei formulat\u0103 de APADOR-CH \u00eenc\u0103 din 2013<\/a>, \u00een sensul c\u0103 atribu\u0163iile CCR ar trebui exercitate de judec\u0103tori, \u00een cadrul unei sec\u0163ii distincte a \u00cenaltei Cur\u0163i de Casa\u0163ie \u015fi Justi\u0163ie, \u015fi nu de persoane numite politic, de Parlament, la propunerea partidelor \u015fi a pre\u015fedintelui \u0163\u0103rii. De\u015fi membrii CCR au studii de drept, pare c\u0103 nu au independen\u0163a \u015fi impar\u0163ialitatea judec\u0103torilor de carier\u0103 din sistemul instan\u0163elor judec\u0103tore\u015fti. Istoria de p\u00e2n\u0103 acum a CCR ar fi un argument suficient.
