Dac\u0103 tot e s\u0103 mergem la r\u0103zboi, m\u0103car s\u0103 \u015ftim pentru ce.<\/p>\n<p style=\"text-align: justify;\">Ca studiu de caz, ne putem \u00eentreba dac\u0103 \u201edocumentul\u201d extras dintr-un rechizitoriu, prezentat, la Copenhaga, de pre\u015fedintele Nicu\u0219or Dan, drept \u201eprob\u0103 solid\u0103\u201d a interferen\u0163ei ruse\u015fti \u00een alegerile preziden\u0163iale din 2024 ar putea fi sau nu considerat prob\u0103 solid\u0103 a unei \u201eamenin\u0163\u0103ri hibride\u201d, care s\u0103 justifice o interven\u0163ie militar\u0103 \u00eempotriva statului b\u0103nuit ca autor al acelei amenin\u0163\u0103ri?<\/p>\n<p style=\"text-align: justify;\">Pe l\u00e2ng\u0103 definirea clar\u0103 a no\u021biunii de \u201eamenin\u021b\u0103ri hibride\u201d, legea ar trebui s\u0103 indice \u015fi un prag minimal al gravit\u0103\u0163ii acelei amenin\u0163\u0103ri, pentru ca ea s\u0103 poat\u0103 sta la baza ini\u0163ierii unei ac\u0163iuni militare pe teritoriul altei \u0163\u0103ri, adic\u0103 al declan\u015f\u0103rii unui r\u0103zboi.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH mai solicit\u0103 \u0219i ca legea s\u0103 prevad\u0103 expres c\u0103 o interven\u021bie militar\u0103 extern\u0103 se poate face <strong>doar pe baza unei decizii a Consiliului Atlanticului de Nord (NATO)<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>Text neclar privind trimiterea de trupe pentru \u201esitua\u021bii care genereaz\u0103 riscuri\u201d<\/strong><\/p>\n<p style=\"text-align: justify;\">Tot articolul 4, dar alin. 4 permite folosirea armatei \u00een afara \u021b\u0103rii pentru \u201eprotejarea cet\u0103\u021benilor rom\u00e2ni\u201d \u0219i \u201ealte situa\u021bii care genereaz\u0103 riscuri\u201d. Formularea este at\u00e2t de vag\u0103 \u00eenc\u00e2t ar putea permite interven\u021bii militare \u00een aproape orice context \u2014 chiar \u0219i \u00een afara unor conflicte armate sau dezastre naturale.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 art. 4 al. 4 este clar atunci c\u00e2nd se refer\u0103 la \u201ecazul unor dezastre naturale\u201d sau \u201econflicte armate\u201d, nu mai este clar atunci c\u00e2nd se refer\u0103 \u015fi la \u201ealte situa\u021bii care genereaz\u0103 riscuri pentru siguran\u021ba acestora\u201d.
