You may click the link to switch the active language.<\/p><p><span style=\"line-height: 1.714285714; font-size: 1rem;\">Organiza\u021biile semnatare salut\u0103<a href=\"http:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2014-04\/cp140054en.pdf\" target=\"_blank\"> decizia <\/a><\/span><a href=\"http:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2014-04\/cp140054en.pdf\" target=\"_blank\"><b style=\"line-height: 1.714285714; font-size: 1rem;\">Cur\u021bii de Justi\u021bie a Uniunii Europene<\/b><\/a><span style=\"line-height: 1.714285714; font-size: 1rem;\">, care a invalidat azi Directiva 2006\/24\/EC privind p\u0103strarea datelor de trafic informa\u021bional, cunoscut\u0103 sub denumirea de \u201e<\/span><b style=\"line-height: 1.714285714; font-size: 1rem;\">Directiva Big Brother\u201d, <\/b><span style=\"line-height: 1.714285714; font-size: 1rem;\">\u0219i<\/span><b style=\"line-height: 1.714285714; font-size: 1rem;\"> <\/b><span style=\"line-height: 1.714285714; font-size: 1rem;\">solicit\u0103 autorit\u0103\u021bilor rom\u00e2ne \u2013 Guvernului \u0219i Parlamentului &#8211; s\u0103 procedeze de urgen\u021b\u0103 la abrogarea legisla\u021biei rom\u00e2ne\u0219ti care transpune aceast\u0103 directiv\u0103.<\/span><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>Curtea de Justi\u021bie a Uniunii Europene (CJUE) a declarat ast\u0103zi invalid\u0103<\/b> <b>Directiva<a title=\"\" href=\"file:\/\/\/C:\/Users\/Lenovo\/Desktop\/comunicat_big_brother_final.doc#_ftn1\"><b>[1]<\/b><\/a> European\u0103 2006\/24\/EC<\/b>, care impunea obliga\u021bia statelor de a colecta date privind comunica\u021biile electronice \u0219i de telefonie ale cet\u0103\u021benilor pentru o perioad\u0103 de cel pu\u021bin \u0219ase luni.<\/p>\n<p>Directiva a fost transpus\u0103 \u00een ordinea de drept rom\u00e2n\u0103 prin Legea nr. 82\/2012, \u00een ciuda opozi\u021biei societ\u0103\u021bii civile \u0219i cu toate c\u0103 o lege similar\u0103 fusese declarat\u0103 neconstitu\u021bional\u0103, prin Decizia Cur\u021bii Constitu\u021bionale nr. 1258 din 8 octombrie 2009. Argumentele CCR s-au bazat \u00een<b> <\/b>principal<b>\u00a0<\/b><strong>pe \u00eenc\u0103lcarea dreptului la via\u021b\u0103 privat\u0103, prin obliga\u021bia general aplicabil\u0103 de a p\u0103stra date care sunt legate \u00een mod direct de comunica\u021biile private ale<\/strong><b>\u00a0<\/b><strong><span style=\"text-decoration: underline;\">tuturor<\/span><\/strong><b>\u00a0<\/b><strong>cet\u0103\u021benilor. <\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Organiza\u021biile semnatare au cerut \u00een repetate r\u00e2nduri<\/strong><a title=\"\" href=\"file:\/\/\/C:\/Users\/Lenovo\/Desktop\/comunicat_big_brother_final.doc#_ftn2\">[2]<\/a><strong> autorit\u0103\u021bilor rom\u00e2ne s\u0103 refuze implementarea directivei, chiar cu riscul declan\u0219\u0103rii unei proceduri de infringement, \u0219i au cerut statului rom\u00e2n s\u0103 militeze la nivel european pentru anularea directivei. Principalul argument a fost acela c\u0103 prin colectarea tuturor datelor se \u00eencalc\u0103 principiul propor\u021bionalit\u0103\u021bii \u0219i to\u021bi cet\u0103\u021benii sunt trata\u021bi ca suspec\u021bi de s\u0103v\u00e2r\u0219irea unor infrac\u021biuni. <\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Prin decizia de azi, CJUE a statuat c\u0103 <\/strong><b>prin impunerea p\u0103str\u0103rii acestor date \u0219i permi\u021b\u00e2nd accesul autorit\u0103\u021bilor na\u021bionale competente, directiva reprezint\u0103 o imixtiune deosebit de grav\u0103 \u00een drepturile fundamentale la respectarea vie\u021bii private \u0219i la protec\u021bia datelor cu caracter personal<\/b>. \u00cen plus, faptul c\u0103 p\u0103strarea \u0219i utilizarea ulterioar\u0103 a datelor sunt efectuate, f\u0103r\u0103 ca abonatul sau utilizatorul \u00eenregistrat s\u0103 fie informat, poate da persoanelor vizate sentimentul c\u0103 via\u021ba lor privat\u0103 este obiectul unei supravegheri constante.<\/p>\n<p><b>Admi\u021b\u00e2nd c\u0103 motivele care au stat la baza adopt\u0103rii directivei sunt legitime, scopul urm\u0103rit fiind combaterea criminalit\u0103\u021bii \u0219i siguran\u021ba public\u0103, Curtea a constatat c\u0103 legiuitorul Uniunii a dep\u0103\u0219it limitele impuse de respectarea principiului propor\u021bionalit\u0103\u021bii. <\/b><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p>Curtea a precizat c\u0103 p\u0103strarea datelor de trafic (\u0219i implicit directiva) reprezint\u0103 o interferen\u021b\u0103 serioas\u0103 cu dreptul fundamental la via\u021b\u0103 privat\u0103 statuat \u00een Articolul 7 din Carta UE a Drepturilor Omului. Reamintim faptul c\u0103 tratatele interna\u021bionale de drepturile omului, deci inclusiv Carta UE a Drepturilor Omului la care Romania este parte, au prioritate \u00een fa\u021ba legilor interne, \u00een conformitate cu art. 20 din Constitu\u021bia Rom\u00e2niei. <b><\/b><\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>Decizia CJUE\u00a0 din 8 aprilie 2014 consfin\u021be\u0219te importan\u021ba respect\u0103rii drepturilor \u0219i libert\u0103\u021bilor cet\u0103\u021bene\u0219ti pentru construc\u021bia european\u0103.
