APADOR-CH consider\u0103 c\u0103 noul Cod de Procedur\u0103 Penal\u0103 permite interceptarea convorbirilor telefonice \u0219i \u00eenainte de \u00een\u0219tiin\u021barea suspec\u021bilor.<\/b><\/p>\n<p>&nbsp;<\/p>\n<p>APADOR-CH\u00a0 reafirm\u0103 c\u0103 anchetarea infrac\u021biunilor nu trebuie s\u0103 se rezume sau s\u0103 se axeze pe intercept\u0103ri telefonice, \u00eentruc\u00e2t astfel se ajunge la o \u00eenc\u0103lcare grav\u0103 \u0219i necontrolabil\u0103 a vie\u021bii private.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen acest sens, asocia\u021bia consider\u0103 ca necesar\u0103 prevederea din noul Cod de Procedur\u0103 Penal\u0103 \u00een sensul c\u0103 suprevegherea tehnic\u0103 a persoanelor (care include \u0219i interceptarea convorbirilor telefonice) se poate dispune numai dup\u0103 \u00eenceperea urm\u0103ririi penale.<\/p>\n<p>&nbsp;<\/p>\n<p>Asocia\u021bia consider\u0103 ca nejustificate temerile exprimate \u00een spa\u021biul public de unele autorit\u0103\u021bi \u00een sensul c\u0103 intercept\u0103rile telefonice nu-\u0219i vor putea atinge scopul de a proba s\u0103v\u00e2r\u0219irea infrac\u021biunilor \u00een condi\u021biile \u00een care ele nu vor putea fi dispuse dec\u00e2t dup\u0103 \u00een\u0219tiin\u021barea suspec\u021bilor c\u0103 sunt urm\u0103ri\u021bi penal.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen realitate, articolul 307 din noul Cod de Procedur\u0103 Penal\u0103 prevede c\u0103 persoanei care a dob\u00e2ndit calitatea de suspect\u00a0<span style=\"text-decoration: underline;\">i se aduc la cuno\u015ftin\u0163\u0103, \u00eenainte de prima sa audiere<\/span>, aceast\u0103 calitate, fapta pentru care este suspectat\u0103, \u00eencadrarea juridic\u0103 a acesteia \u0219i drepturile procesuale.<\/p>\n<p>&nbsp;<\/p>\n<p>Deci, articolul 307 prevede expres c\u0103 suspectul trebuie \u00een\u0219tiin\u021bat cu privire la calitatea sa nu imediat ce a fost \u00eenceput\u0103 urm\u0103rirea penal\u0103, ci doar \u00eenainte de prima sa audiere. Or, termenul dintre \u00eenceperea urm\u0103ririi penale \u0219i prima audiere a suspectului, termen care poate fi de 1-2 luni, este suficient pentru interceptarea comunica\u021biilor suspectului.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen consecin\u021b\u0103, APADOR-CH\u00a0 \u00ee\u0219i exprim\u0103 opozi\u021bia fa\u021b\u0103 de o eventual\u0103 modificare a noului Cod de Procedur\u0103 Penal\u0103 \u00een sensul reintroducerii posibilit\u0103\u021bii intercept\u0103rii comunica\u021biilor mai \u00eenainte de \u00eenceperea urm\u0103ririi penale.<\/p>\n<p>&nbsp;<\/p>\n<p><b>2. \u00cen acela\u0219i timp, APADOR-CH constat\u0103 lipsa de interes a autorit\u0103\u021bilor de a remedia adev\u0103ratele deficien\u021be ale noilor reglement\u0103ri penale, respectiv ale noului Cod Penal (care ar trebui s\u0103 intre \u00een vigoare la 1 februarie 2014, \u00eempreun\u0103 cu noul Cod de Procedur\u0103 Penal\u0103).<\/b><\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen acest context, APADOR-CH\u00a0 dore\u0219te s\u0103 reaminteasc\u0103 faptul c\u0103, \u00ee<b>nc\u0103 din anul 2009, c\u00e2nd noul Cod Penal se afla \u00een faza de proiect, a atras public aten\u021bia asupra pericolului pentru libertatea presei pe care-l reprezint\u0103 noua infrac\u021biune de &#8220;presiuni asupra justi\u0163iei\u201d<\/b>\u00a0(articolul 276 din noul Cod Penal).<\/p>\n<p>&nbsp;<\/p>\n<p>APADOR-CH\u00a0 a formulat \u00een urm\u0103 cu mai mult de 4 ani, \u00een lunile februarie \u0219i iunie 2009, comentarii \u0219i propuneri, pe care le-a transmis deciden\u021bilor din structurile guvernamentale \u0219i parlamentare.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00cen aceste comentarii, APADOR-CH\u00a0 a solicitat eliminarea din proiectul noului Cod Penal\u00a0a\u00a0<b>infrac\u021biunii de presiuni asupra justitiei<\/b>, care nu constituie lege previzibil\u0103 \u00een sensul Conven\u0163iei Europene a Drepturilor Omului, \u00eentruc\u00e2t textul articolului 276 este redactat extrem de larg, vag, ambiguu \u015fi permite s\u0103v\u00e2r\u015firea de abuzuri prin care se va \u00eempiedica punerea \u00een discu\u0163ia liber\u0103 a membrilor comunit\u0103\u0163ii a unor chestiuni de interes public privind buna func\u0163ionare a autorit\u0103\u0163ilor publice.<\/p>\n<p>&nbsp;<\/p>\n<p>Asocia\u021bia a aten\u021bionat \u00eenc\u0103 din luna februarie 2009 c\u0103 articolul 276 instituie o protec\u0163ie excesiv\u0103\u00a0 at\u00e2t pentru judec\u0103tor, c\u00eet mai ales pentru organele de urm\u0103rire penal\u0103 \u00een situa\u0163ia \u00een care o persoan\u0103 ar face, pe durata procedurii judiciare \u00een curs &#8220;declara\u0163ii publice\u201d cu privire la s\u0103v\u00e2r\u015firea de c\u0103tre ace\u015ftia &#8220;a unei infrac\u0163iuni sau a unei abateri disciplinare grave legat\u0103 de instrumentarea respectivei cauze\u201d pentru a-i &#8220;influen\u0163a sau intimida\u201d. Asocia\u0163ia a precizat c\u0103 un judec\u0103tor nu poate \u015fi nu trebuie s\u0103 se lase influen\u0163at sau intimidat de declara\u0163ii \u2013 chiar \u015fi publice \u2013 ale uneia din p\u0103r\u0163i.
