{"id":5409,"date":"2016-10-10T11:40:24","date_gmt":"2016-10-10T11:40:24","guid":{"rendered":"http:\/\/www.apador.org\/?p=5409"},"modified":"2016-10-10T12:56:13","modified_gmt":"2016-10-10T12:56:13","slug":"parchetul-combate-abuzurile-politiei-printr-o-strategie-secreta","status":"publish","type":"post","link":"https:\/\/apador.org\/en\/parchetul-combate-abuzurile-politiei-printr-o-strategie-secreta\/","title":{"rendered":"The Romanian Prosecutor\u2019s Office (POHCCJ) combats police violence through secret strategy"},"content":{"rendered":"<p><\/p>\n<p style=\"text-align: justify;\">The Prosecutor\u2019s Office attached to the High Court of Cassation and Justice (POHCCJ) claims to have elaborated and to currently implement a <b>\u201eStrategy for increasing the effectiveness of investigations conducted in cases of ill-treatment applied by the State agents in connection with the exercise of their professional duties\u201d <\/b>as an answer to the numerous <a href=\"http:\/\/www.apador.org\/sunt-abuzurile-politiei-descurajate-de-autoritati\/\" target=\"_blank\">complaints lodged in the last years regarding police abuse\/violence<\/a>. The Prime Minister Dacian Ciolo\u0219 himself praised this strategy as a reply to Mr. Nils Mui\u017enieks\u2019s (Commissioner for Human Rights of the Council of Europe) <a href=\"http:\/\/www.apador.org\/blog\/relatia-romanilor-cu-politia-infloreste-in-corespondenta-cu-consiliul-europei\/\" target=\"_blank\">concerns<\/a>. Trying to also find out the content of this strategy APADOR-CH stumbled upon a bizarre refusal of POHCCJ to provide the information.<\/p>\n<p style=\"text-align: justify;\">Thus, we wrote the two authors of the Romania-Council of Europe correspondence, to see if they had access to this strategy or if they were also told the document is meant for \u201cinternal use\u201d only.<\/p>\n<p style=\"text-align: justify;\"><div class=\"su-box su-box-style-soft\" id=\"\" style=\"border-color:#86a0ca;border-radius:3px;max-width:none\"><div class=\"su-box-title\" style=\"background-color:#b9d3fd;color:#FFFFFF;border-top-left-radius:1px;border-top-right-radius:1px\">Open letter from APADOR-CH<\/div><div class=\"su-box-content su-u-clearfix su-u-trim\" style=\"border-bottom-left-radius:1px;border-bottom-right-radius:1px\">\n<p style=\"text-align: justify;\"><b>Mr. Nils Mui\u017enieks, Commissioner for Human Rights of the Council of Europe, <\/b><\/p>\n<p style=\"text-align: justify;\"><b>Mr. Dacian Ciolo\u0219, Prime Minister of Romania,\u00a0 <\/b><\/p>\n<p style=\"text-align: justify;\">The Association for the Defence of Human Rights in Romania-the Helsinki Committee (APADOR-CH) took notice of the interesting conversation you had on the issue of police violence in Romania, <a href=\"https:\/\/wcd.coe.int\/ViewDoc.jsp?p=&#038;Ref=CommDH(2016)30&#038;Language=lanEnglish&#038;Ver=original&#038;direct=true\" target=\"_blank\">published on the Council of Europe website<\/a> on 23 august 2016. APADOR-CH appreciates Mr. Nils Mui\u017enieks\u2019s concern for the problematic aspects acknowledged during his visit to Romania in 2014 as well as the fact that he follows up on the commitments made by the national authorities to improve the situation.<\/p>\n<p style=\"text-align: justify;\">After reading the letter of Prime Minister Dacian Ciolo\u0219 APADOR-CH tried to learn more about the <b>\u201eStrategy for increasing the effectiveness of investigations conducted in cases of ill-treatment applied by the State agents in connection with the exercise of their professional duties\u201d. <\/b>This strategy is mentioned in the letter as being a measure through which the Prosecutor\u2019s Office attached to the High Court of Cassation and Justice (POHCCJ) would reorganize its activity in the sense of designating special prosecutors to handle cases involving police violence.<\/p>\n<p style=\"text-align: justify;\">Unfortunately, despite the efforts made to obtain this information from POHCCJ, APADOR-CH received an answer according to which the mentioned above strategy &#8211; identified as \u201cOrder no. 214 of 9 October 2015\u201d issued by the Attorney General &#8211; is a \u201cdocument intended for internal use only\u201d, therefore not meant to be made public. However, the organization will continue to request this document in court considering that the phrase \u201cdocument for internal use\u201d is not listed among the exceptions mentioned in Law 544\/2001 regarding the free access to information of public interest. A strategy contains general directions measures, there being no reason why it should be kept a secret.<\/p>\n<p style=\"text-align: justify;\">At the same time, the association would like to know if Mr. Nils Mui\u017enieks<b> <\/b>received the \u201cStrategy for increasing the effectiveness of investigations conducted in cases of ill-treatment applied by the State agents in connection with the exercise of their professional duties\u201d and if he considers that it would be useful for the Romanian civil society to be aware of the measures contained in it.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH has been monitoring police abuses in Romania for more than 20 years. <a href=\"http:\/\/www.apador.org\/sunt-abuzurile-politiei-descurajate-de-autoritati\/\" target=\"_blank\">A recent study<\/a> realized by the association shows that only <b>14 of the 3034 complains made by citizens concerning police abuses have reached a court during 2012-2014. <\/b>During the same period<b>, <\/b>the General Inspectorate of the Romanian Police (IGPR) received <b>3301 complaints concerning the abusive\/brutal policemen behaviour. Only 47 of them, meaning approximately 1 in 70 complaints ended in a disciplinary sanction. <\/b>An update of this information, possible through the data received by APADOR-CH from all county prosecutor\u2019s offices in Romania, shows that <b>in 2015 there were 828 complaints lodged against police officers for abusive behaviour and only one (1) reached a court.<\/b><\/p>\n<p style=\"text-align: justify;\">Under these circumstances, the public interest for the measures the authorities claim to have adopted through this strategy \u201cof internal use\u201d is very obvious.<\/p>\n<p style=\"text-align: justify;\">Mr. Nils Mui\u017enieks, Commissioner for Human Rights, Mr. Dacian Ciolo\u0219, Prime Minister of Romania, APADOR-CH would like to express its wish to learn what the <b>\u201e<\/b>Strategy for increasing the effectiveness of investigations conducted in cases of ill-treatment applied by the State agents in connection with the exercise of their professional duties\u201d contains.
