You may click the link to switch the active language.<\/p><h3 style=\"text-align: justify;\"><i style=\"font-size: 1rem;\">APADOR-CH cere clarificarea sau eliminarea unor propuneri de modificare a legilor poli\u021biei, de natur\u0103 s\u0103 \u00eencalce drepturi ale omului sau s\u0103 favorizeze abuzuri ale poli\u021bi\u0219tilor \u2013 de la incriminarea unor simple huiduieli la proteste p\u00e2n\u0103 la re\u021bineri pe durat\u0103 nedeterminat\u0103 sau obligarea cet\u0103\u021benilor s\u0103 stea \u00een \u201epozi\u021bie inofensiv\u0103\u201d \u00een fa\u021ba organelor de ordine<\/i><\/h3>\n<p style=\"text-align: justify;\">APADOR-CH a transmis Ministerului Afacerilor Interne o serie de comentarii pe marginea proiectelor de modificare a legilor din domeniul ordinii publice, aflate \u00een dezbatere <a href=\"http:\/\/www.mai.gov.ro\/index05_1.html\" target=\"_blank\" rel=\"noopener noreferrer\">pe site-ul ministerului<\/a>. Modific\u0103rile propuse la Legea 61\/1991 (a ordinii \u0219i lini\u0219tii publice), la Legea 218\/2002 (a poli\u021biei) \u0219i la OUG 104\/2001 (a poli\u021biei de frontier\u0103) sunt pe alocuri de natur\u0103 s\u0103 \u00eencalce drepturi \u0219i libert\u0103\u021bi sau permit, prin ambiguitatea lor, abuzuri pe care organele de ordine ar putea s\u0103 le fac\u0103 la adresa cet\u0103\u021beanului. De aceea APADOR-CH a cerut clarificarea acestor propuneri sau eliminarea unora dintre ele.<\/p>\n<p style=\"text-align: justify;\"><b>Exemple de propuneri controversate\u00a0 de modificare a legilor poli\u021biei:<\/b><\/p>\n<ul>\n<li>Propunerea de incriminare \u0219i pedepsire cu \u00eenchisoare de la 3 luni la un an pentru fapta de a \u201e\u00eentrebuin\u021ba cuvinte, expresii, gesturi jignitoare sau obscene\u201d la adresa organelor de ordine este at\u00e2t de larg\u0103 \u015fi de vag\u0103 \u00eenc\u00e2t orice gest sau cuv\u00e2nt dezagreat de un poli\u0163ist poate fi calificat drept comportament infrac\u0163ional (infrac\u0163iunea de ultraj). <b>Spre exemplu, \u00een cadrul unei adun\u0103ri publice, nemul\u0163umirea, protestul se exprim\u0103 \u015fi sub forma unor huiduieli. Potrivit textului de lege propus, aceste huiduieli pot fi interpretate de poli\u0163ist drept <\/b><b>\u201e<\/b><b>cuvinte, expresii ori gesturi jignitoare\u201d, astfel c\u0103 toate persoanele participante la acea adunare public\u0103 pot deveni autori ai infrac\u0163iunii de ultraj. <\/b>\u00cen prezent, \u00een art. 257 din Codul penal este incriminat\u0103 o form\u0103 a ultrajului verbal, \u015fi anume ultrajul comis prin amenin\u0163are. Amenin\u0163area este o fapt\u0103 mai grav\u0103 dec\u00e2t \u201ejignirea\u201d \u015fi de aceea sanc\u0163ionarea penal\u0103 a celui care amenin\u0163\u0103 un poli\u0163ist se justific\u0103 prin pericolul unei astfel de fapte. Dar, altul, mai sc\u0103zut, este pericolul unor \u201egesturi, cuvinte sau expresii jignitoare\u201d. \u00cen plus, jurispruden\u0163a CEDO accept\u0103 exprim\u0103ri \u015focante \u015fi chiar ofensatoare atunci c\u00e2nd se urm\u0103re\u015fte atragerea aten\u0163iei asupra unor chestiuni de interes public.\u00a0 APADOR-CH solicit\u0103 eliminarea complet\u0103 a acestei propuneri de reincriminare \u00een Legea 61\/1991.<\/li>\n<li><b>Introducerea unui nou caz de privare de libertate \u2013 \u201ere\u021binere administrativ\u0103\u201d<\/b> \u2013 adic\u0103 posibilitatea ca poli\u021bistul s\u0103 \u00eei interzic\u0103 unei persoane s\u0103 p\u0103r\u0103seasc\u0103 un anumit spa\u021biu, de\u0219i \u00een legea poli\u021biei avem deja procedura \u201econducerii administrative\u201d la sec\u021bie care este o m\u0103sur\u0103 similar\u0103.\u00a0 Textul de lege propus nu prevede nicio limitare \u00een timp a duratei re\u0163inerii administrative, nici procedura dispunerii ei \u015fi nici care sunt drepturile \u015fi garan\u0163iile persoanei re\u0163inute administrativ. O astfel de reglementare, \u00een mod v\u0103dit lacunar\u0103, nu poate fi folosit\u0103 ca temei pentru privarea de libertate a unei persoane, ca atare\u00a0 APADOR-CH a cerut eliminarea acestei propuneri din Legea 218\/2002.<\/li>\n<li>Introducerea unei no\u021biuni vagi precum <b>\u201epozi\u021bie inofensiv\u0103\u201d pe care o persoan\u0103 care face obiectul cercet\u0103rii poli\u021biene\u0219ti<\/b> <b>ar trebui s\u0103 o adopte<\/b> \u2013 APADOR-CH cere definirea acestei pozi\u021bii, \u00een caz contrar fiecare poli\u021bist va avea libertatea de a-\u0219i imagina cum dore\u0219te aceast\u0103 \u201epozi\u021bie inofensiv\u0103\u201d, chiar \u0219i pe burt\u0103 cu m\u00e2inile la spate.<\/li>\n<li>Definirea mai clar\u0103 a unor no\u021biuni introduse suplimentar \u00een Legea poli\u021biei, ce vizeaz\u0103 fotografierea, amprentarea \u0219i controlul corporal sau al bagajelor<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.apador.org\/wp-content\/uploads\/2017\/11\/Recomandari-APADOR-CH-Proiect-de-Lege-acte-normative-ordine-si-siguranta-publica.pdf\" class=\"su-button su-button-style-soft\" style=\"color:#FFFFFF;background-color:#d90d04;border-color:#ae0b04;border-radius:6px\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color:#FFFFFF;padding:6px 18px;font-size:14px;line-height:21px;border-color:#e55650;border-radius:6px;text-shadow:none\"><i class=\"sui sui-file-pdf-o\" style=\"font-size:14px;color:#FFFFFF\"><\/i> Citi\u021bi pe larg toate comentariile \u0219i propunerile formulate de APADOR-CH pe marginea acestor modific\u0103ri legislative.<\/span><\/a>\n<p style=\"text-align: justify;\">Asocia\u021bia Pentru Ap\u0103rarea Drepturilor Omului \u00een Rom\u00e2nia \u2013 Comitetul Helsinki consider\u0103 c\u0103 poli\u0163istul trebuie s\u0103 beneficieze de o protec\u0163ie real\u0103, efectiv\u0103 \u015fi de mijloace adecvate, inclusiv de natur\u0103 legislativ\u0103, atunci c\u00e2nd \u00ee\u015fi exercit\u0103, \u00een mod corect, atribu\u0163iile legale. \u00cen acela\u015fi timp, exercitarea abuziv\u0103 a func\u0163iei nu numai c\u0103 nu trebuie acceptat\u0103, ci trebuie prevenit\u0103 \u015fi, dac\u0103 s-a produs, sanc\u0163ionat\u0103 sever.
