You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><em>APADOR-CH solicit\u0103 Comisiei speciale pentru modificarea Codurilor penale s\u0103 lucreze transparent \u0219i s\u0103 implice \u00een dezbaterea proiectelor to\u021bi actorii importan\u021bi din domeniul justi\u021biei \u0219i ai societ\u0103\u021bii civile<\/em><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: right;\"><em>Bucure\u0219ti, 10 mai 2018<\/em><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Noile modific\u0103ri la Codul penal \u0219i la Codul de procedur\u0103 penal\u0103, discutate s\u0103pt\u0103m\u00e2na aceasta \u00een Comisia special\u0103 din Parlament, pentru \u201e<em>sistematizarea, unificarea \u0219i asigurarea stabilit\u0103\u021bii legislative \u00een domeniul justi\u021biei<\/em>\u201d, au st\u00e2rnit din nou nemul\u021bumire \u0219i dezbateri aprinse \u00een r\u00e2ndul opiniei publice \u0219i \u00eentre profesioni\u0219ti.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH a identificat cel pu\u021bin dou\u0103 aspecte problematice \u00eentre amendamentele propuse de unii parlamentari, a\u0219a cum au fost ele publicate \u00een media. Primul dintre ele este modificarea propus\u0103 la <strong>articolul 277<\/strong>, <strong>privind \u201eCompromiterea intereselor justi\u0163iei\u201d<\/strong>, amendamentul ad\u0103ugat prin alineatul 5 av\u00e2nd urm\u0103torul cuprins:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>(5) Divulgarea oric\u0103ror date privind desf\u0103\u0219urarea urm\u0103ririi penale, de natur\u0103 a afecta imaginea public\u0103 a celor cerceta\u021bi, a induce \u00een opinia public\u0103 ideea vinov\u0103\u021biei lor sau a zdruncina \u00een orice fel prezum\u021bia de nevinov\u0103\u021bie, se pedepse\u0219te cu \u00eenchisoare de la 6 luni la doi ani sau cu amend\u0103.<\/em><\/p>\n<p style=\"text-align: justify;\"><em style=\"font-size: 1rem;\">Dac\u0103 informa\u021biile date publicit\u0103\u021bii sunt neadev\u0103rate, pedeapsa este de la un an la trei ani sau amend\u0103.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong style=\"font-size: 1rem;\"><em>Atunci c\u00e2nd f\u0103ptuitorul nu poate fi identificat este antrenat\u0103 r\u0103spunderea pentru neglijen\u021b\u0103 a persoanelor competente s\u0103 efectueaze urm\u0103rirea penal\u0103 \u00een cazul respectiv<\/em><\/strong><em style=\"font-size: 1rem;\">, pedeapsa fiind amend\u0103 penal\u0103 \u0219i interzicerea exercit\u0103rii dreptului de a ocupa o func\u021bie public\u0103.<\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">O prim\u0103 problem\u0103 a\u00a0 acestui amendament este c\u0103 \u00een formularea textului de lege se folosesc exprim\u0103ri echivoce, care nu au claritatea \u0219i previzibilitatea cerute de Constitu\u021bie unei legi.<\/p>\n<p style=\"text-align: justify;\">Astfel, sintagma: \u201c<em>Divulgarea oric\u0103ror date privind desf\u0103\u0219urarea urm\u0103ririi penale\u201d <\/em>poate \u00eensemna orice. De asemenea, ambiguitatea redact\u0103rii sintagmei \u201e<em>de natur\u0103 a afecta imaginea public\u0103 a celor cerceta\u021bi\u201d <\/em>permite interpretarea c\u0103 orice informa\u021bii despre stadiul urm\u0103ririi penale, altele dec\u00e2t cele favorabile suspectului\/inculpatului, pot fi \u201e<em>de natur\u0103 a afecta imaginea public\u0103 a celor cerceta\u021bi<\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\">\u00cen consecin\u021b\u0103, dac\u0103 un astfel de amendament ar fi adoptat, \u00een loc de informarea corect\u0103 \u0219i obiectiv\u0103 a opiniei publice cu privire la stadiul urm\u0103ririi penale, vor putea fi publicate doar \u0219tiri pozitive despre suspec\u021bi\/inculpa\u021bi sau opinii glorificatoare la adresa acestora, \u00een caz contrar exist\u00e2nd riscul comiterii unei infrac\u021biuni.<\/p>\n<p style=\"text-align: justify;\">\u00cen plus, acest amendament, care se dore\u0219te a fi dedicat consolid\u0103rii prezum\u021biei de nevinov\u0103\u021bie, introduce, \u00een premier\u0103, \u00een Codul penal, <strong>prezum\u021bia de vinov\u0103\u021bie<\/strong>, \u00een cazul organelor de anchet\u0103, care vor fi prezumate vinovate c\u0103 au divulgat informa\u021bii dintr-un dosar, \u00een cazul \u00een care nu poate fi identificat\u0103 sursa acelor informa\u021bii. Aceast\u0103 <strong>prevedere \u00eencalc\u0103 prezum\u021bia de nevinov\u0103\u021bie, prev\u0103zut\u0103 \u00een Constitu\u021bie la articolul 23, alineatul 11. <\/strong>Orice persoan\u0103 (chiar \u0219i un anchetator) este prezumat\u0103 nevinovat\u0103 p\u00e2n\u0103 la condamnarea definitiv\u0103, iar \u00een realitate acele scurgeri de informa\u021bii pot avea \u0219i alte surse implicate \u00een faza de urm\u0103rire penal\u0103 (p\u0103r\u021bi, martori, avoca\u021bi, exper\u021bi etc.).<\/p>\n<p style=\"text-align: justify;\">Un alt amendament discutabil este cel prin care se propune modificarea <strong>Articolului 290, privind <em>Darea de mit\u0103<\/em><\/strong>. Se dore\u0219te ca simpla promisiune de dare de mit\u0103, incriminat\u0103 \u00een prezent, s\u0103 nu mai constituie infrac\u021biune. Va exista infrac\u021biunea de dare de mit\u0103 numai dac\u0103 promisiunea va fi urmat\u0103 de ni\u0219te acte materiale de \u00eendeplinire, m\u0103car par\u021bial\u0103, a acesteia.<\/p>\n<p style=\"text-align: justify;\">Potrivit textului propus,<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>Pentru ca fapta s\u0103 constituie infrac\u021biune, promisiunea trebuie s\u0103 fie real\u0103, serioas\u0103, explicit\u0103, efectiv\u0103 \u0219i con\u0219tient\u0103. Nu este astfel promisiunea neurmat\u0103 de acte materiale de natur\u0103 a transpune \u00een via\u021b\u0103, cel pu\u021bin cu caracter incipient \u0219i par\u021bial, \u00een\u021belegerea frauduloas\u0103.<\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Modificarea este cel pu\u021bin discutabil\u0103 \u00eentruc\u00e2t integritatea presupune respingerea chiar \u0219i a simplei promisiuni.<\/p>\n<p style=\"text-align: justify;\">Acestea sunt numai dou\u0103 exemple de modific\u0103ri propuse la Codul penal, dar este posibil s\u0103 mai existe \u0219i altele despre care societatea nu a aflat, de vreme ce lucr\u0103rile comisiei nu sunt transparente.<\/p>\n<p style=\"text-align: justify;\">Ca \u0219i <a href=\"http:\/\/www.apador.org\/despre-proiectul-de-modificare-a-codului-de-procedura-penala\/\" target=\"_blank\" rel=\"noopener\">\u00een decembrie 2017<\/a>, c\u00e2nd aceea\u0219i Comisie a \u00eencercat s\u0103 fac\u0103 modific\u0103ri la Codul de procedur\u0103 penal\u0103, justificate de transpunerea \u00een legisla\u021bia na\u021bional\u0103 a directivei europene privind prezum\u021bia de nevinov\u0103\u021bie, se constat\u0103 \u00een continuare acela\u0219i stil de lucru opac \u0219i un refuz de a dezbate deschis proiectele cu toate p\u0103r\u021bile implicate.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH face din nou un apel c\u0103tre <em>Comisia special\u0103 pentru sistematizarea, unificarea \u0219i asigurarea stabilit\u0103\u021bii legislative \u00een domeniul justi\u021biei<\/em> s\u0103-\u0219i respecte <a href=\"http:\/\/www.cdep.ro\/comisii\/suasl_justitie\/pdf\/2017\/rd_1011;1.pdf\" target=\"_blank\" rel=\"noopener\">propriul regulament<\/a>, precum \u0219i regulamentele celor dou\u0103 camere ale Parlamentului \u0219i s\u0103 lucreze transparent, cu publicarea proiectelor \u0219i a amendamentelor propuse la ele, astfel \u00eenc\u00e2t dezbaterile publice s\u0103 se fac\u0103 pe articole concrete, nu pe zvonuri \u0219i supozi\u021bii \u201esc\u0103pate\u201d \u00een pres\u0103, care inflameaz\u0103 inutil opinia public\u0103.<\/p>\n<p style=\"text-align: justify;\">","protected":false},"excerpt":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\">Sorry, this entry is only available in <a href=\"https:\/\/apador.org\/ro\/wp-json\/wp\/v2\/posts\/6230\" class=\"qtranxs-available-language-link qtranxs-available-language-link-ro\" title=\"Rom\u00e2n\u0103\">Rom\u00e2n\u0103<\/a>.
