You may click the link to switch the active language.<\/p><h3 style=\"text-align: justify;\">Prin relaxarea condi\u021biilor de eliberare condi\u021bionat\u0103 din penitenciar, \u00a0judec\u0103torii vor fi obliga\u021bi s\u0103 pun\u0103 \u00een libertate de\u021binu\u021bii care au executat jum\u0103tate din pedeaps\u0103; Parlamentul a lansat aceast\u0103 ofert\u0103 penal\u0103 &#8211; <strong>\u201e<\/strong><strong><em>prime\u015fti 10 ani, dar faci doar 5<\/em><\/strong><strong>\u201d<\/strong> \u2013 f\u0103r\u0103 s\u0103 fac\u0103 un studiu de impact, a\u0219a cum prevede Legea 24\/2000, ceea ce este neconstitu\u021bional; Cine \u0219i cum ar putea ataca la Curtea Constitu\u021bional\u0103 modific\u0103rile Codului penal<\/h3>\n<p style=\"text-align: right;\"><em>Bucure\u0219ti, 4 iulie 2018<\/em><\/p>\n<p style=\"text-align: justify;\">APADOR-CH consider\u0103 c\u0103 este neconstitu\u0163ional\u0103 adoptarea unor modific\u0103ri legislative substan\u0163iale ale Codului penal, \u00een lipsa studiilor de impact prev\u0103zute de Legea nr. 24\/2000 privind tehnica legislativ\u0103.<\/p>\n<p style=\"text-align: justify;\">Potrivit art. 30 al. 1 lit. d din legea 24\/2000, <u>studiile de impact sunt obligatorii \u00een cazul proiectelor de legi de importan\u021b\u0103 \u015fi complexitate deosebit\u0103<\/u>, iar proiectul de lege de modificare a Codului penal intr\u0103, \u00een mod evident, \u00een aceast\u0103 categorie.<\/p>\n<p style=\"text-align: justify;\">Conform art. 33 al. 1 din Legea nr. 24\/2000, studiul de impact are ca scop estimarea costurilor \u015fi beneficiilor aduse \u00een plan economic \u015fi social prin adoptarea proiectului de lege, precum \u015fi eviden\u0163ierea dificult\u0103\u0163ilor care ar putea ap\u0103rea \u00een procesul de punere \u00een practic\u0103 a reglement\u0103rilor propuse.<\/p>\n<p style=\"text-align: justify;\">De asemenea, potrivit art. 33 al. 2 din legea 24\/2000, <u>pentru propunerile legislative ini\u0163iate de deputa\u0163i sau de senatori, studiile de impact se \u00eentocmesc prin grija ministerelor de resort, <strong>la solicitarea comisiilor parlamentare<\/strong><\/u>.<\/p>\n<p style=\"text-align: justify;\">Deci, era obliga\u0163ia legal\u0103 a comisiei parlamentare \u201eIordache\u201d s\u0103 solicite ministerelor de resort (printre care, Ministerul Justi\u0163iei \u015fi\u00a0 Ministerul Afacerilor Interne) \u00eentocmirea de studii de impact cu privire la modific\u0103rile propuse pentru Codul penal.<\/p>\n<p style=\"text-align: justify;\">Spre exemplu, studiile de impact, dac\u0103 ar fi fost \u00eentocmite, a\u015fa cum oblig\u0103 Legea 24\/2000, ar fi trebuit s\u0103 se pronun\u0163e \u015fi cu privire la efectele sau, mai exact, riscurile ce se creeaz\u0103 pentru ordinea public\u0103 prin <strong>relaxarea exagerat\u0103 a regimului liber\u0103rii condi\u0163ionate<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Astfel, prin modific\u0103rile aduse la <strong>art. 100 din Codul penal<\/strong> privind liberarea condi\u0163ionata se ajunge, practic, la <strong>regula eliber\u0103rii automate<\/strong> din penitenciar dup\u0103 executarea a <strong>jum\u0103tate din pedeapsa<\/strong> aplicat\u0103 de instan\u0163\u0103 (se are \u00een vedere c\u0103 marea majoritate a pedepselor aplicate de instan\u0163\u0103 nu dep\u0103\u015fesc 10 ani \u00eenchisoare).<\/p>\n<p style=\"text-align: justify;\">\u00cen acest context, nu poate fi neglijat\u0103 \u00eengrijorarea legitim\u0103 care este generat\u0103 de aceast\u0103 relaxare a regimului eliber\u0103rii din deten\u0163ie a persoanelor condamnate definitiv. Un posibil efect al acestei relax\u0103ri poate fi o \u00eencurajare a infrac\u0163ionalit\u0103\u0163ii, deoarece, practic, pedepsele aplicate de instan\u0163e vor fi executate, ca regul\u0103, doar la jum\u0103tate. <strong>La o asemenea <\/strong><strong>\u201e<\/strong><strong>ofert\u0103\u201d lansat\u0103 de legiuitor, de tipul <\/strong><strong>\u201e<\/strong><strong><em>prime\u015fti 10 ani, dar faci doar 5<\/em><\/strong><strong>\u201d este foarte posibil c\u0103 starea infrac\u0163ional\u0103 s\u0103 creasc\u0103 \u015fi astfel s\u0103 fie afectat\u0103 ordinea public\u0103 din \u0163ar\u0103. \u00cenchisorile tot nu s-ar elibera, pentru c\u0103, dac\u0103 va cre\u015fte starea infrac\u0163ional\u0103, vor intra mai mul\u0163i la \u00eenchisoare, \u00eens\u0103 pe durate mai scurte.<\/strong><\/p>\n<p style=\"text-align: justify;\">Desigur, dac\u0103 studiile de impact ar fi fost efectuate, ele ar fi trebuit s\u0103 ofere r\u0103spunsuri \u015fi la \u00eengrijor\u0103rile exprimate mai sus \u015fi prezente \u00een spa\u0163iul public.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH consider\u0103 c\u0103 ne\u00eentocmirea studiilor de impact \u00een leg\u0103tur\u0103 cu modific\u0103rile propuse pentru Codul penal constituie o \u00eenc\u0103lcare clar\u0103 a Legii nr. 24\/2000 privind tehnica legislativ\u0103, iar aceast\u0103 \u00eenc\u0103lcare de lege a viciat constitu\u0163ionalitatea procedurilor parlamentare de adoptare a legii de modificare a Codului penal. Viciul de constitu\u0163ionalitate const\u0103 \u00een \u00eenc\u0103lcarea <strong>art. 1 al. 3 din Constitu\u0163ie<\/strong>, care prevede c\u0103 Rom\u00e2nia este <strong>stat de drept<\/strong> \u015fi <strong>art. 1 al. 5 din Constitu\u0163ie<\/strong>, care prevede c\u0103 <strong>\u00een Rom\u00e2nia<\/strong>, <strong>respectarea<\/strong> Constitu\u0163iei, a suprema\u0163iei sale \u015fi a <strong>legilor este obligatorie<\/strong>.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH precizeaz\u0103 c\u0103 \u00een jurispruden\u0163a Cur\u0163ii Constitu\u0163ionale s-a mai stabilit c\u0103 \u00eenc\u0103lcarea normelor de tehnic\u0103 legislativ\u0103 prev\u0103zute \u00een Legea nr. 24\/2000 cu ocazia adopt\u0103rii unei legi duce la neconstitu\u0163ionalitatea legii adoptate, \u00eentruc\u00e2t astfel au fost \u00eenc\u0103lcate art. 1 al. 3 \u015fi art. 1 al. 5 din Constitu\u0163ie.<\/p>\n<div class=\"su-box su-box-style-glass\" id=\"\" style=\"border-color:#819dca;border-radius:3px;max-width:none\"><div class=\"su-box-title\" style=\"background-color:#b4d0fd;color:#FFFFFF;border-top-left-radius:1px;border-top-right-radius:1px\">Spre exemplu, \u00een decizia nr. 104 din 6 martie 2018 a Cur\u0163ii Constitu\u0163ionale, \u00een par. 74-75, se men\u0163ioneaz\u0103 urm\u0103toarele:<\/div><div class=\"su-box-content su-u-clearfix su-u-trim\" style=\"border-bottom-left-radius:1px;border-bottom-right-radius:1px\">\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\">\u201c<em>74. <strong><u>\u00cen cadrul controlului de constitu\u021bionalitate<\/u><\/strong>, <u>principiul legalit\u0103\u021bii<\/u> a fost analizat inclusiv prin <strong><u>\u00eencorporarea normelor de tehnic\u0103 legislativ\u0103<\/u><\/strong><u> pentru elaborarea actelor normative<\/u>. Temeiul constitu\u021bional al <strong><u>valorific\u0103rii normelor de tehnic\u0103 legislativ\u0103 \u00een controlul de constitu\u021bionalitate<\/u><\/strong> a fost identificat, a\u0219adar, \u00een dispozi\u021biile art.1 alin.(3) \u201eRom\u00e2nia este stat de drept [\u2026]\u201d, precum \u0219i ale art.1 alin.(5), \u201e\u00cen Rom\u00e2nia, respectarea Constitu\u021biei, a suprema\u021biei sale \u0219i a legilor este obligatorie.\u201d<\/em><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><em>\u00a0<\/em><\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"75\">\n<li><span style=\"color: #3366ff;\"><em> Corela\u021bia dintre cele dou\u0103 componente \u2013 principiul statului de drept \u0219i principiul legalit\u0103\u021bii &#8211; cuprinse \u00een art.1 din Constitu\u021bie este realizat\u0103 de Curtea Constitu\u021bional\u0103 prin faptul c\u0103 <strong><u>principiul legalit\u0103\u021bii este unul de rang constitu\u021bional<\/u><\/strong>\u2026, astfel \u00eenc\u00e2t \u00eenc\u0103lcarea legii are drept consecin\u021b\u0103 imediat\u0103 nesocotirea art.1 alin.(5) din Constitu\u021bie, care prevede c\u0103 respectarea legilor este obligatorie. \u00cenc\u0103lcarea acestei obliga\u021bii constitu\u021bionale atrage implicit afectarea principiului statului de drept, consacrat prin art.1 alin.(3) din Constitu\u021bie\u2026<\/em>\u201d<\/span><\/li>\n<\/ol>\n<\/div><\/div>\n<p style=\"text-align: justify;\"><strong>\u00cen concluzie, APADOR-CH consider\u0103 necesar\u0103 atacarea la Curtea Constitu\u0163ional\u0103, \u00eenainte de promulgare, a legii de modificare a Codului penal, prin invocarea \u00eenc\u0103lc\u0103rii art. 1 al 3 \u015fi art. 1 al. 5 din Constitu\u0163ie. Potrivit art. 15 al. 1 din Legea nr. 47\/1997, Curtea Constitu\u0163ional\u0103 se pronun\u0163\u0103 asupra constitu\u0163ionalit\u0103\u0163ii legilor \u00eenainte de promulgarea acestora, la sesizarea Pre\u015fedintelui Rom\u00e2niei, a unuia dintre pre\u015fedin\u0163ii celor dou\u0103 Camere, a Guvernului, a \u00cenaltei Cur\u0163i de Casa\u0163ie \u015fi Justi\u0163ie, a Avocatului Poporului, a unui num\u0103r de cel pu\u0163in 50 de deputa\u0163i sau de cel pu\u0163in 25 de senatori.
