De asemenea, sugeram c\u0103 Autoritatea are nevoie urgent\u0103 de implementarea unui sistem de lucru \u00een solicit\u0103rile care privesc prelucrarea datelor \u00een scop jurnalistic.<\/span><\/p>\n<ol>\n<li style=\"text-align: justify;\"><b>Nu doar via\u021ba privat\u0103 este un drept fundamental, ci \u0219i libertatea de exprimare<\/b><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">At\u00e2t dreptul la via\u021b\u0103 privat\u0103, c\u00e2t \u0219i dreptul la libertatea de exprimare se bucur\u0103 de un regim egal, niciun drept nefiind deasupra celuilalt. O autoritate nu poate invoca \u00een mod arbitrar restric\u021bii asupra dreptului la libertatea de exprimare, cu at\u00e2t mai pu\u021bin c\u00e2nd este vorba despre un subiect de interes public, precum \u00een cazul de fa\u021b\u0103. Pentru a decide care dintre cele dou\u0103 drepturi primeaz\u0103 \u00eentr-o spe\u021b\u0103, acestea trebuie puse \u00een balan\u021b\u0103, fiind necesar a se efectua un echilibru corect, lu\u00e2ndu-se \u00een calcul particularit\u0103\u021bile fiec\u0103rui caz. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A reduce discu\u021bia doar la cele 3 derog\u0103ri din art. 7 din Legea 190\/2018 reprezint\u0103 o abordare simplist\u0103, c\u00e2t\u0103 vreme este clar c\u0103 scopul Regulamentul general privind protec\u021bia datelor (GDPR) nu este de a limita libertatea de exprimare. \u00cen acela\u0219i timp, exist\u0103 numeroase acte normative privind drepturile omului semnate de Rom\u00e2nia (nominaliz\u0103m aici doar dou\u0103 &#8211; Carta Drepturilor Fundamentale a Uniunii Europene \u0219i Conven\u021bia European\u0103 a Drepturilor Omului) ce trebuie luate \u00een considerare atunci c\u00e2nd este vorba de un conflict \u00eentre dou\u0103 sau mai multe drepturi. Curtea European\u0103 a Drepturilor Omului (CEDO) are o vast\u0103 jurispruden\u021b\u0103 ce vorbe\u0219te despre punerea \u00een balan\u021b\u0103 a dreptului la libertatea de exprimare \u0219i a dreptului la via\u021b\u0103 privat\u0103, iar acest test de echilibrare ia \u00een considerare cel pu\u021bin 6 factori extrem de importan\u021bi ce trebuie considera\u021bi \u00een fiecare caz \u00een parte<\/span><span style=\"font-weight: 400;\">. A\u0219adar ar fi fost necesar ca ANSPDCP s\u0103 ia \u00een calcul &#8211; at\u00e2t \u00een discu\u021biile interne, dar \u0219i \u00een clarific\u0103rile publice ulterioare<\/span><span style=\"font-weight: 400;\"> &#8211; aceste aspecte ce \u021bin de propor\u021bionalitate \u0219i c\u00e2nt\u0103rirea just\u0103 a celor dou\u0103 drepturi fundamentale.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><b><\/b><b><i> \u00a0<\/i><\/b><b>Protec\u021bia surselor \u00een cazul jurnali\u0219tilor este crucial\u0103 pentru garantarea dreptului la libertatea de exprimare <\/b><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Protec\u021bia surselor jurnalistice este una din condi\u021biile de baz\u0103 \u00een garantarea libert\u0103\u021bii presei. Jurispruden\u021ba CEDO subliniaz\u0103 cu consecven\u021b\u0103 c\u0103 \u00eencercarea de a obliga un jurnalist s\u0103 \u00ee\u0219i dezv\u0103luie sursele \u00eencalc\u0103 dreptul s\u0103u la libertatea de a primi \u0219i distribui informa\u021bie, deci \u00eencalc\u0103 dreptul s\u0103u la libertatea de exprimare. Curtea a considerat c\u0103 obligarea jurnali\u0219tilor la a-\u0219i dezv\u0103lui sursele afecteaz\u0103 libera circula\u021bie a informa\u021biei, \u00een detrimentul democra\u021biei, drept pentru care poate fi justificat\u0103 doar \u00een cazuri excep\u021bionale<\/span><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">De aceea este absolut normal\u0103 reac\u021bia jurnali\u0219tilor \u0219i a institu\u021biilor europene c\u00e2nd au aflat c\u0103 Autoritatea ar fi cerut \u201esursa\u201d informa\u021biilor protejate de RISE Project. Aici consider\u0103m c\u0103 ar fi rolul Autorit\u0103\u021bii de a \u021bine cont de sensibilit\u0103\u021bile conflictului dintre drepturi, \u00een primul r\u00e2nd pentru a preciza de ce \u00een acel caz nu se aplic\u0103 excep\u021biile pentru colectarea de date \u00een scop jurnalistic. \u00cen al doilea r\u00e2nd dac\u0103 decide c\u0103 trebuie s\u0103 mearg\u0103 mai departe, nefiind vorba de derog\u0103ri, Autoritatea trebuie s\u0103 precizeze c\u0103 solicitarea de surse \u00een aceste cazuri nu se refer\u0103 la sursele jurnalistice, ci, mai degrab\u0103, urm\u0103re\u0219te s\u0103 identifice dac\u0103 datele sunt colectate direct de la persoana vizat\u0103 sau din alte surse (sau surse publice), pentru eventuala aplicare a articolelor 13 \u0219i 14 din GDPR. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Nu putem dec\u00e2t s\u0103 sper\u0103m c\u0103, de fapt, avem de a face mai degrab\u0103 cu o inadecvare a comunic\u0103rii, dec\u00e2t cu o dorin\u021b\u0103 de a avea acces la sursele jurnali\u0219tilor.<\/span><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><b> \u00a0Amenin\u021b\u0103rile nu au ce s\u0103 caute \u00eentr-o adres\u0103 din partea unei autorit\u0103\u021bi publice<\/b><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Solicitarea dvs. c\u0103tre RISE Project indic\u0103 faptul c\u0103 sunt pasibili de o amend\u0103 de 3000 de lei pe zi, pentru fiecare zi de \u00eent\u00e2rziere cu r\u0103spunsul la solicitarea dvs., r\u0103spuns ce are termen limit\u0103 de 10 zile. \u00cen plus i-a\u021bi mai anun\u021bat \u0219i c\u0103 sunt pasibili de o amend\u0103 de p\u00e2n\u0103 la 20.000.000 de euro pentru \u00eenc\u0103lcarea art. 83 din Regulamentul general privind protec\u021bia datelor, subliniind \u00een textul redactat de dvs. referin\u021ba la \u201eneacordarea accesului\u201d. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Aceasta sun\u0103 a amenin\u021bare (de\u0219i textul e conform cu prevederile Regulamentului), iar partea legat\u0103 de \u201eaccesul\u2019 la documente ridic\u0103 acela\u0219i probleme ca \u0219i cele de mai sus. Cu at\u00e2t mai mult cu c\u00e2t nimeni \u00een Europa n-a acordat \u00eenc\u0103 vreo amend\u0103 de 20 de milioane de euro. De fapt, nici m\u0103car de 1 milion. Credem c\u0103 nici m\u0103car de 100 000. <\/span><\/p>\n<p style=\"text-align: justify;\"><b>\u00cen concluzie, fa\u021b\u0103 de cele 3 puncte mai sus men\u021bionate, <\/b><span style=\"font-weight: 400;\">observ\u0103m c\u0103 solicitarea formulat\u0103 c\u0103tre RISE Project a l\u0103sat impresia unei ac\u021biuni f\u0103cute \u00een grab\u0103, f\u0103r\u0103 o analiz\u0103 temeinic\u0103 a situa\u021biei, ceea ce a alimentat convingerea public\u0103 c\u0103 ar fi existat o motiva\u021bie de natur\u0103 politic\u0103, generat\u0103 de subiectul materialului jurnalistic, \u0219i nu ar fi fost vorba de o simpl\u0103 anchet\u0103 obiectiv\u0103 \u0219i impar\u021bial\u0103 a Autorit\u0103\u021bii de supraveghere \u00een domeniul prelucr\u0103rii datelor cu caracter personal. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Facem aceste remarci deoarece ambele drepturi fundamentale sunt la fel de importante \u0219i nu dorim ca rolul Autorit\u0103\u021bii s\u0103 par\u0103 a fi redus la un instrument de control politic \u0219i blocare a dezbaterilor necesare \u00eentr-o societate democratic\u0103. <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Consider\u0103m c\u0103 Autoritatea are nevoie urgent\u0103 de implementarea unui sistem de lucru \u00een solicit\u0103rile care privesc presa. Acest sistem de lucru trebuie conceput doar \u00een baza unor consult\u0103ri publice cu mass-media \u0219i cu organisme cu expertiz\u0103 \u00een domeniul libert\u0103\u021bii de exprimare \u0219i al libert\u0103\u021bii presei, din Rom\u00e2nia \u0219i din Uniunea European\u0103.
