APADOR-CH cere abrogarea legii \u0219i alte m\u0103suri de remediere a situa\u021biei<\/em><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: right;\">Bucure\u0219ti, 17 ianuarie 2019<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Pentru \u00eenceput, asocia\u0163ia precizeaz\u0103 c\u0103 no\u0163iunea de \u201erecurs compensatoriu\u201d nu exist\u0103 ca atare \u00een legisla\u0163ie. At\u00e2t \u00een Legea nr. 254\/2013, care reglementeaz\u0103, printre altele, executarea pedepsei \u00eenchisorii, c\u00e2t \u015fi \u00een Legea nr. 169\/2017, care a modificat-o, exist\u0103 termenii \u201ecompensare\u201d \u015fi \u201em\u0103sur\u0103 compensatorie\u201d. Legea 169\/2017 a fost denumit\u0103 \u00een pres\u0103 drept legea \u201erecursului compensatoriu\u201d, denumire preluat\u0103 apoi \u00een tot spa\u0163iul public.<\/p>\n<p style=\"text-align: justify;\"><strong>Cum func\u021bioneaz\u0103 \u201erecursul compensatoriu\u201d<\/strong><\/p>\n<p style=\"text-align: justify;\">M\u0103sura compensatorie introdus\u0103 prin Legea 169\/2017 const\u0103 \u00een reducerea din totalul pedepsei a 6 zile pentru 30 de zile executate \u00een condi\u0163ii de deten\u0163ie necorespunz\u0103toare. Deci, pentru 30 de zile executate efectiv, se consider\u0103 36 de zile executate efectiv. Ca atare, pentru 1 an executat efectiv, se consider\u0103 executat 1 an, 2 luni \u015fi 12 zile.<\/p>\n<p style=\"text-align: justify;\">Pentru eliberarea din deten\u0163ie a unui condamnat exist\u0103 2 posibilit\u0103\u0163i:<\/p>\n<p style=\"text-align: justify;\"><strong>&#8211; liberarea condi\u0163ionat\u0103<\/strong> (poate fi dispus\u0103 de instan\u0163a de judecat\u0103, numai dac\u0103 sunt \u00eendeplinite anumite condi\u0163ii)<\/p>\n<p style=\"text-align: justify;\"><strong>&#8211; eliberarea la termen<\/strong> (se dispune, automat, atunci c\u00e2nd se constat\u0103 c\u0103 pedeapsa a fost executat\u0103 integral, f\u0103r\u0103 a mai fi necesar\u0103 \u00eendeplinirea altor condi\u0163ii)<\/p>\n<p style=\"text-align: justify;\">Folosul condamnatului care beneficiaz\u0103 de \u201e<em>m\u0103sura compensatorie<\/em>\u201d, introdus\u0103 prin Legea 169\/2017 (lege care se aplic\u0103 retroactiv, \u00eencep\u00e2nd cu 24 iulie 2012), este c\u0103 se poate prezenta mai repede dec\u00e2t \u00een mod normal \u00een fa\u0163a instan\u0163ei de judecat\u0103, care poate dispune <strong>liberarea condi\u0163ionat\u0103<\/strong>. De asemenea, pentru unii condamna\u0163i, aplicarea m\u0103surii compensatorii a f\u0103cut ca \u00eentreaga pedeaps\u0103 aplicat\u0103 s\u0103 fie considerat\u0103 executat\u0103, astfel c\u0103 ei au fost <strong>elibera\u0163i la termen<\/strong>, imediat, f\u0103r\u0103 s\u0103 mai fie nevoie s\u0103 solicite liberarea condi\u0163ionat\u0103.<\/p>\n<p style=\"text-align: justify;\">Teoretic, <strong>instan\u0163ele de judecat\u0103 pot dispune sau nu liberarea condi\u0163ionat\u0103<\/strong> a unui condamnat, nefiind obligate s\u0103 pun\u0103 \u00een libertate, automat, pe oricine solicit\u0103 liberarea condi\u0163ionat\u0103. Codul penal prevede, \u00een art. 99-100, c\u0103 liberarea condi\u0163ionata poate fi dispus\u0103 doar dac\u0103 \u201e<em>instan\u0163a are convingerea c\u0103 persoana condamnat\u0103 s-a \u00eendreptat \u015fi se poate reintegra \u00een societate\u201d.<\/em> Dac\u0103, \u00eens\u0103, instan\u0163ele de judecat\u0103 ac\u0163ioneaz\u0103 superficial \u015fi nu examineaz\u0103 cu aten\u0163ia \u015fi r\u0103bdarea necesare fiecare caz de liberare condi\u0163ionat\u0103 (poate \u015fi din cauza supra\u00eenc\u0103rc\u0103rii instan\u0163elor), se poate ajunge la situa\u0163ia \u00een care sunt pu\u015fi \u00een liberate \u015fi condamna\u0163ii care nu s-au \u00eendreptat \u015fi nu se pot reintegra \u00een societate.<\/p>\n<p style=\"text-align: justify;\"><strong>Media elibera\u021bilor condi\u021bionat este constant\u0103 din 2014 \u00eencoace, dar&#8230;<\/strong><\/p>\n<p style=\"text-align: justify;\">Din <a href=\"https:\/\/www.mediafax.ro\/social\/anp-peste-14-400-de-detinuti-au-fost-eliberati-in-baza-recursului-compensatoriu-multi-au-revenit-in-puscarie-17839141\" target=\"_blank\" rel=\"noopener\">datele oficiale publicate de Administra\u0163ia Na\u0163ional\u0103 a Penitenciarelor<\/a>\u00a0se poate observa c\u0103 \u015fi \u00eenainte de 2017, anul c\u00e2nd a fost adoptat\u0103\u00a0 legea \u201erecursului compensatoriu\u201d, rata celor elibera\u0163i condi\u0163ionat este similar\u0103 cu rata elibera\u0163ilor condi\u0163ionat dup\u0103 adoptarea acestei legi, respectiv o medie de 10-11.000 persoane\/an.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><a href=\"http:\/\/www.apador.org\/wp-content\/uploads\/2019\/01\/eliberati-penitenciare.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-6516\" src=\"http:\/\/www.apador.org\/wp-content\/uploads\/2019\/01\/eliberati-penitenciare.jpg\" alt=\"\" width=\"727\" height=\"269\" srcset=\"https:\/\/apador.org\/wp-content\/uploads\/2019\/01\/eliberati-penitenciare.jpg 727w, https:\/\/apador.org\/wp-content\/uploads\/2019\/01\/eliberati-penitenciare-300x111.jpg 300w, https:\/\/apador.org\/wp-content\/uploads\/2019\/01\/eliberati-penitenciare-705x261.jpg 705w\" sizes=\"auto, (max-width: 727px) 100vw, 727px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Deci, din datele oficiale prezentate, rezult\u0103 c\u0103 <strong>problema num\u0103rului mare de eliber\u0103ri din penitenciare este legat\u0103 mai mult de u\u015furin\u0163a acord\u0103rii liber\u0103rii condi\u0163ionate, u\u015furin\u0163\u0103 care a existat \u015fi \u00een anii de dinaintea legii \u201erecursului compensatoriu\u201d, dec\u00e2t de legea \u201erecursului compensatoriu\u201d \u00een sine.<\/strong> Dar, efectul specific, vizibil \u015fi cu adev\u0103rat negativ al legii \u201erecursului compensatoriu\u201d este <strong>dublarea num\u0103rului celor elibera\u0163i la termen, <\/strong>prin reducerea duratei pedepsei ce trebuia executata efectiv<strong>:<\/strong> de la o medie de circa 900 persoane\/an, \u00een perioada 2014-2016, s-a ajuns la o medie de circa 1800 persoane\/an, \u00een perioada 2017-2018.<\/p>\n<p style=\"text-align: justify;\">At\u00e2t <strong>eliberarea la termen<\/strong>, mult prea gr\u0103bit\u0103 \u00een urma adopt\u0103rii legii \u201erecursului compensatoriu\u201d, c\u00e2t \u015fi <strong>liberarea condi\u0163ionat\u0103<\/strong> a unor condamna\u0163i care nu s-au \u00eendreptat \u015fi nu se pot reintegra, excese\u00a0 stimulate de faptul c\u0103 nu exist\u0103 suficiente spa\u0163ii de deten\u0163ie, nu fac dec\u00e2t s\u0103 \u00eencurajeze fenomenul infrac\u0163ional. Aceste eliber\u0103ri induc ideea c\u0103 se poate sc\u0103pa mai u\u015for dup\u0103 comiterea de infrac\u0163iuni, oric\u00e2t de grave ar fi ele. Astfel se poate ajunge la comiterea de noi infrac\u0163iuni, din ce \u00een ce mai grave, la noi victime ale noilor infrac\u0163iuni \u015fi, \u00een cele din urm\u0103, la re\u00eentoarcerea \u00een penitenciar a celor care au fost elibera\u0163i cu prea mare u\u015furin\u0163\u0103, f\u0103r\u0103 ca ei s\u0103 se fi \u00eendreptat \u015fi s\u0103 se poat\u0103 reintegra \u00een societate. Astfel, este foarte probabil ca penitenciarele s\u0103 se reaglomereze, tocmai ca efect al unei goliri gr\u0103bite \u015fi mai pu\u0163in g\u00e2ndite.<\/p>\n<p style=\"text-align: justify;\"><strong>Dac\u0103 au devenit ne\u00eenc\u0103p\u0103toare, solu\u021bia e construirea de noi \u00eenchisori, nu eliberarea de\u021binu\u021bilor<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00cen acest context, APADOR-CH subliniaz\u0103 c\u0103 luarea de c\u0103tre stat a m\u0103surilor pentru \u00eendeplinirea unor cerin\u0163e stabilite de CEDO nu se poate face\u00a0 \u00een condi\u0163ii care s\u0103 creeze pericole pentru siguran\u0163a, via\u0163a, s\u0103n\u0103tatea \u015fi proprietatea cet\u0103\u0163enilor. Cet\u0103\u0163enii nu sunt datori s\u0103 pl\u0103teasc\u0103 cu via\u0163a sau cu bunurile pentru lipsa de interes, nepriceperea sau reaua-credin\u0163\u0103 a persoanelor pl\u0103tite din bani publici pentru a rezolva problemele comunit\u0103\u0163ii \u015fi care, \u00een loc de a le rezolva, creeaz\u0103 noi \u015fi grave probleme. Dreptul la via\u0163\u0103, dreptul la protec\u0163ia propriet\u0103\u0163ii sunt \u015fi ele drepturi prev\u0103zute \u015fi garantate \u00een Conven\u0163ia European\u0103 a Drepturilor Omului. Nu se poate renun\u0163a la aceste drepturi fundamentale, sub pretextul respect\u0103rii altor drepturi fundamentale. \u00centotdeauna trebuie p\u0103strat un echilibru.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH reafirm\u0103 c\u0103 niciun guvern de dup\u0103 1989 nu a luat m\u0103surile necesare pentru a asigura condi\u0163ii corespunz\u0103toare de deten\u0163ie.\u00a0 \u00cen cazul \u00een care num\u0103rul de condamna\u0163i la pedeapsa \u00eenchisorii este mare \u015fi dep\u0103\u015fe\u015fte capacitatea spa\u0163iilor de deten\u0163ie, solu\u0163ia normal\u0103 este crearea de noi spa\u0163ii \u015fi \u00eentre\u0163inerea corespunz\u0103toare a celor deja existente. Dac\u0103, \u00een cei aproape 30 de ani din 1989, la nivelul\u00a0 guvernelor care s-au perindat ar fi existat un minim interes pentru asigurarea unor spa\u0163ii de deten\u0163ie suficiente \u015fi corespunz\u0103toare, problema ar fi fost rezolvat\u0103 de mult.<\/p>\n<p style=\"text-align: justify;\">\u00cen m\u0103sura \u00een care s-ar fi apreciat ca absolut necesar\u0103 eliberarea unor persoane aflate \u00een deten\u0163ie, pentru rezolvarea problemei supraaglomer\u0103rii, eliberarea ar fi trebuit s\u0103 se rezume la persoanele care prezentau un pericol mai sc\u0103zut, raportat la \u00eentregul mediu penitenciar. Eliberarea acestora ar fi creat spa\u0163iile necesare pentru men\u0163inerea \u00een deten\u0163ie a condamna\u0163ilor cu grad de pericol mai ridicat, de exemplu cei condamna\u0163i pentru infrac\u0163iuni comise cu violen\u0163\u0103. Or, <strong>Legea 169\/2017 a permis eliberarea <em>la termen<\/em>, mai devreme dec\u00e2t \u00een mod normal, \u015fi a persoanelor care au fost condamnate pentru infrac\u0163iuni grave.\u00a0 <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Ce solu\u021bii exist\u0103<\/strong><\/p>\n<p style=\"text-align: justify;\">Este nevoie ca aceste erori s\u0103 \u00eenceteze. C\u00e2teva dintre solu\u0163iile posibile ar fi urm\u0103toarele, cu precizarea c\u0103, \u00een primul r\u00e2nd, este obliga\u0163ia guverna\u0163ilor s\u0103 caute \u015fi s\u0103 ofere solu\u0163ii care s\u0103 nu creeze bulvers\u0103ri \u00een societate \u015fi nu s\u0103 a\u015ftepte ca \u201esocietatea civil\u0103\u201d s\u0103 fac\u0103 brainstorming \u00een locul lor:<\/p>\n<div class=\"su-note\"  style=\"border-color:#c7d6d7;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\"><div class=\"su-note-inner su-u-clearfix su-u-trim\" style=\"background-color:#e1f0f1;border-color:#ffffff;color:#333333;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\">\n<ol style=\"text-align: justify;\">\n<li><strong>Abrogarea Legii 169\/2017<\/strong> \u2013 deoarece ea a permis eliberarea la termen, mult prea gr\u0103bit\u0103, a unor condamna\u0163i, f\u0103r\u0103 a se \u0163ine cont de gravitatea infrac\u0163iunilor pentru care fuseser\u0103 condamna\u0163i. \u00cen lipsa Legii 169\/2017, ei nu mai erau elibera\u0163i la termen, ci ar fi trebuit s\u0103 solicite liberarea condi\u0163ionat\u0103. Astfel, ar mai fi existat o \u015fans\u0103, e adev\u0103rat, mai mult teoretic\u0103, pentru ca ace\u015ftia s\u0103 fie verifica\u0163i de instan\u0163a de judecat\u0103, \u00een procedura liber\u0103rii condi\u0163ionate pe care ar fi trebuit s\u0103 o urmeze, dac\u0103 s-au \u00eendreptat \u015fi dac\u0103 se pot reintegra \u00een societate.<\/li>\n<\/ol>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><strong>Modificarea Codului penal \u00een sensul \u00een\u0103spririi condi\u0163iilor pentru liberarea condi\u0163ionat\u0103<\/strong> \u00een cazul condamn\u0103rilor pentru anumite infrac\u0163iuni grave (\u00een special, cele comise prin violen\u0163\u0103 \u2013 oricum, trebuie enumerate \u00een lege, \u00een mod explicit, toate infrac\u0163iunile grave avute \u00een vedere). \u00cen cazul acestor infrac\u0163iuni, pot fi prev\u0103zute \u00een Codul penal, separat sau \u00eempreun\u0103, urm\u0103toarele:<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>A &#8211; majorarea frac\u0163iilor de pedeaps\u0103<\/strong> care trebuie executate efectiv \u00een cazul infrac\u0163iunilor grave, eventual p\u00e2n\u0103 la 4\/5 sau 5\/6 din pedeapsa aplicat\u0103;<\/p>\n<p style=\"text-align: justify;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>B<\/strong> &#8211; introducerea unei prevederi \u00een Codul penal \u00een sensul c\u0103 pentru infrac\u0163iunile grave (care trebuie enumerate \u00een mod explicit) <strong>condamnarea poate fi dispus\u0103 f\u0103r\u0103 posibilitatea de liberare condi\u0163ionat\u0103.<\/strong> Cu alte cuvinte, introducerea unei prevederi \u00een Codul penal care s\u0103 dea dreptul instan\u0163ei de judecat\u0103 care dispune condamnarea s\u0103 stabileasc\u0103 \u015fi dac\u0103 acea condamnare se dispune cu sau f\u0103r\u0103 drept de liberare condi\u0163ionat\u0103.<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li>Guvernul trebuie s\u0103 acorde prioritatea necesar\u0103 pentru <strong>construirea, \u00een regim de urgen\u0163\u0103, a noi locuri de deten\u0163ie<\/strong> \u015fi pentru reamenajarea celor existente, \u00een scopul asigur\u0103rii unor condi\u0163ii corespunz\u0103toare pentru executarea pedepsei \u00eenchisorii.<\/li>\n<li>Guvernul trebuie s\u0103 organizeze \u015fi s\u0103 dezvolte, cu prioritate, \u00een penitenciare, <strong>programe eficiente destinate \u00eendrept\u0103rii \u015fi reintegr\u0103rii \u00een societate a celor condamna\u0163i<\/strong>, programe \u00een care s\u0103 fie implicat\u0103 marea majoritate a celor condamna\u0163i.<\/li>\n<li>Guvernul trebuie s\u0103 creeze mecanismele de cooperare institu\u021bionale care <strong>s\u0103 stimuleze reintegrarea fo\u0219tilor de\u021binu\u021bi \u00een societate dup\u0103 eliberare<\/strong>, prin facilit\u0103\u021bi la angajare \u0219i protec\u021bie social\u0103 pentru a pre\u00eent\u00e2mpina recidiva, precum \u0219i programe de educa\u021bie public\u0103 pentru toleran\u021b\u0103 \u0219i antidiscriminare a fo\u0219tilor condamna\u021bi.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><\/div><\/div>\n<p style=\"text-align: justify;\">Asocia\u021bia consider\u0103 c\u0103 efectele legii \u201erecursului compensatoriu\u201d sunt negative deopotriv\u0103 pentru societate \u0219i pentru de\u021binu\u021bi, dou\u0103 \u201etabere\u201d antagonizate \u00een acest fel f\u0103r\u0103 ca vreuna (sau Rom\u00e2nia \u00een ansamblu) s\u0103 aib\u0103 un real folos de pe urma acestei m\u0103suri pripite \u0219i prost gestionate.<\/p>","protected":false},"excerpt":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\">Sorry, this entry is only available in <a href=\"https:\/\/apador.org\/ro\/wp-json\/wp\/v2\/posts\/6515\" class=\"qtranxs-available-language-link qtranxs-available-language-link-ro\" title=\"Rom\u00e2n\u0103\">Rom\u00e2n\u0103<\/a>.
