You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Peste c\u00e2teva zile, la 1 martie 2020, \u00ee\u015fi va produce efectele Hot\u0103r\u00e2rea Consiliului General al Municipiului Bucure\u015fti nr. 539 din 24 octombrie 2019, prin care a fost introdus\u0103 \u201cTaxa Oxigen\u201d. Probabil, de la 1 martie 2020 vor urma zile de neuitat \u00een capital\u0103, pline de \u00eenc\u0103rc\u0103tur\u0103 pozitiv\u0103 \u015fi bun\u0103 dispozi\u0163ie general\u0103, pentru c\u0103 o problem\u0103 serioas\u0103 a fost rezolvat\u0103 cu mult\u0103 simplitate, deosebit\u0103 \u00een\u0163elepciune \u015fi extraordinar\u0103 pricepere. \u00cen fine\u2026<\/p>\n<p style=\"text-align: justify;\">Pe l\u00e2ng\u0103 <strong><a href=\"https:\/\/www.apador.org\/ce-zice-avp-despre-taxa-oxigen-si-cum-poate-fi-ea-contestata\/\" target=\"_blank\" rel=\"noopener\">problemele de legalitate ale acestei hot\u0103r\u00e2ri pe care le-am prezentat anterior<\/a><\/strong>, se ridic\u0103 \u015fi o alt\u0103 problem\u0103 din aceea\u015fi categorie, \u015fi anume nesolicitarea avizului poli\u0163ei rutiere cu privire la <em>proiectul<\/em> acestei hot\u0103r\u00e2ri.<\/p>\n<p style=\"text-align: justify;\">Astfel, potrivit art. 5 al. 7 \u015fi art. 128 al. 1 lit. c din OUG nr. 195\/2002 privind Codul rutier, <em>orice m\u0103sur\u0103 de restric\u0163ie a circula\u0163iei<\/em> pe drumurile publice, precum \u0219i <em>organizarea circula\u0163iei pentru localit\u0103\u0163ile urbane<\/em> se dispun de c\u0103tre administratorul drumului\/autorit\u0103\u0163ile administra\u0163iei publice locale <em><u>numai cu avizul poli\u0163iei rutiere<\/u><\/em>.<\/p>\n<p style=\"text-align: justify;\">Din textele legale citate mai sus, rezult\u0103 c\u0103 solicitarea avizului poli\u0163iei rutiere cu privire la proiectul Hot\u0103r\u00e2rii nr. 539\/2019 este <em>obligatorie<\/em>, \u00eentruc\u00e2t prin aceast\u0103\u00a0 hot\u0103r\u00e2re se organizeaz\u0103 \u015fi se restric\u0163ioneaz\u0103 circula\u0163ia autovehiculelor pe raza municipiului Bucure\u015fti.<\/p>\n<p style=\"text-align: justify;\">Ce se \u00eent\u00e2mpl\u0103 dac\u0103 proiectul unei hot\u0103r\u00e2ri de consiliu local\/general nu a fost avizat de c\u0103tre entit\u0103\u021bile prev\u0103zute de lege (de exemplu, de poli\u0163ia rutier\u0103)? Potrivit art. 3 al. 2, art. 9 al. 1 \u015fi art. 81 al 2 din Legea 24\/2000 privind tehnica legislativ\u0103, <strong>hot\u0103r\u00e2rea poate fi considerat\u0103 ca adoptat\u0103 ilegal \u015fi, ca urmare, poate fi desfiin\u0163at\u0103 de c\u0103tre instan\u0163a de judecat\u0103<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Pentru a verifica dac\u0103 poli\u0163ia rutier\u0103 a avizat sau nu proiectul Hot\u0103r\u00e2rii nr. 539\/2019, am solicitat informa\u0163ii at\u00e2t de la Inspectoratul General al Poli\u0163iei Rom\u00e2ne (IGPR), c\u00e2t \u015fi de la Direc\u0163ia General\u0103 de Poli\u0163ie a Municipiului Bucure\u015fti (DGPMP).<\/p>\n<p style=\"text-align: justify;\"><strong>At\u00e2t IGPR, c\u00e2t \u015fi DGPMB au r\u0103spuns c\u0103 nu li s-a solicitat \u015fi nici nu au emis aviz pentru proiectul Hot\u0103r\u00e2rii nr. 539\/2019, privind \u201cTaxa Oxigen\u201d<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/02\/Raspuns-politie.pdf\" class=\"su-button su-button-style-default su-button-wide\" style=\"color:#324645;background-color:#fde306;border-color:#cbb605;border-radius:6px\" target=\"_blank\" rel=\"noopener noreferrer\" title=\"Vezi r\u0103spunsul poli\u021biei la \u00eentrebarea APADOR-CH\"><span style=\"color:#324645;padding:6px 18px;font-size:14px;line-height:21px;border-color:#feec51;border-radius:6px;text-shadow:none\"><i class=\"sui sui-book\" style=\"font-size:14px;color:#FFFFFF\"><\/i> Vezi r\u0103spunsul poli\u021biei la \u00eentrebarea APADOR-CH<\/span><\/a>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00cen plus, DGPMB a precizat c\u0103 \u201e<em>M\u0103surile prev\u0103zute de Hot\u0103r\u00e2rea Consiliului General al Municipiului Bucure\u015fti nr. 539\/2019 <strong>nu presupun instalarea de indicatoare rutiere de restric\u0163ie<\/strong> conform Normativului SR 1848\/1 \u2013 2011 \u201eSemnalizarea rutier\u0103. Indicatoare \u015fi mijloace de semnalizare rutier\u0103. Clasificare, simboluri \u015fi amplasare\u201d, motiv pentru care consider\u0103m c\u0103 acestea nu constituie m\u0103suri de restric\u0163ie \u00een sensul prev\u0103zut de Ordonan\u0163a de Urgen\u0163\u0103 a Guvernului nr. 195\/2002 privind circula\u0163ia pe drumurile publice<\/em>.\u201d<\/p>\n<div id=\"attachment_7279\" style=\"width: 635px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/02\/indicator-zaca2.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-7279\" class=\"wp-image-7279 size-large\" src=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/02\/indicator-zaca2-631x355.jpg\" alt=\"\" width=\"625\" height=\"352\" \/><\/a><p id=\"caption-attachment-7279\" class=\"wp-caption-text\">Prim\u0103ria a amplasat, f\u0103r\u0103 avizul poli\u021biei, indicatoare pentru delimitara zonei ZACA<\/p><\/div>\n<p style=\"text-align: justify;\">Sunt discutabile argumentele prezentate de c\u0103tre DGPMB, \u00eentruc\u00e2t art. 5 al. 7 \u015fi art. 128 al. 1 lit. c Codul rutier prev\u0103d c\u0103 <strong>avizul poli\u0163ei rutiere este obligatoriu ori de c\u00e2te ori se dispune <em>orice m\u0103sur\u0103 de restric\u0163ie a circula\u0163iei<\/em> pe drumurile publice sau de <em>organizare a circula\u0163iei pentru localit\u0103\u0163ile urbane<\/em><\/strong>, f\u0103r\u0103 ca legea (Codul rutier) s\u0103 limiteze obliga\u0163ia de a solicita avizul poli\u0163iei rutiere numai \u00een cazurile care presupun instalarea de indicatoare rutiere de restric\u0163ie.<\/p>\n<p style=\"text-align: justify;\"><div class=\"su-note\"  style=\"border-color:#df5156;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\"><div class=\"su-note-inner su-u-clearfix su-u-trim\" style=\"background-color:#f96b70;border-color:#ffffff;color:#333333;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\">\n<p style=\"text-align: justify;\"><strong>Astfel, art. 5 al. 7 din OUG 195\/2002 (Codul rutier) prevede:<\/strong><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>(7) Orice m\u0103sur\u0103 de restric\u0163ie a circula\u0163iei pe drumurile publice se dispune de c\u0103tre administratorul drumului numai cu avizul poli\u0163iei rutiere.<\/em>\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">De asemenea, art. 128 al. 1 lit. c din OUG nr. 195\/2002 (Codul rutier) prevede:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>Art. 128. &#8211; (1) Autorit\u0103\u0163ile administra\u0163iei publice locale au urm\u0103toarele atribu\u0163ii:<\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">\u2026<\/p>\n<ol style=\"text-align: justify;\">\n<li><em>c) \u00eentocmesc \u015fi actualizeaz\u0103 planurile de organizare a circula\u0163iei pentru localit\u0103\u0163ile urbane \u015fi iau m\u0103suri pentru realizarea lucr\u0103rilor ce se impun \u00een vederea asigur\u0103rii fluen\u0163ei \u015fi siguran\u0163ei traficului, precum \u015fi a reducerii nivelurilor de emisii poluante, cu avizul poli\u0163iei rutiere<\/em>;\u201d<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><\/div><\/div>\n<p style=\"text-align: justify;\">Pe de alt\u0103 parte, zona ZACA prev\u0103zut\u0103 \u00een Hot\u0103r\u00e2rea nr. 539\/2019, este deja delimitat\u0103 prin instalarea pe drumurile publice de panouri care se refer\u0103 la circula\u0163ia rutier\u0103 \u015fi care <strong><a href=\"https:\/\/www.hotnews.ro\/stiri-administratie_locala-23658253-foto-cum-pot-amendati-soferii-taxa-oxigen-chiar-daca-nu-intra-masina-centrul-bucurestiului.htm\" target=\"_blank\" rel=\"noopener\">indic\u0103 restric\u021bii de circula\u0163ie pentru anumite categorii de autovehicule<\/a><\/strong>, care au interdic\u0163ia de a circula \u00een acea zon\u0103 dac\u0103 nu au pl\u0103tit vinieta.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/02\/indicator-zaca.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-7278\" src=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/02\/indicator-zaca-631x355.jpg\" alt=\"\" width=\"625\" height=\"352\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">Dar, r\u0103spunsul final la \u00eentrebarea dac\u0103 Hot\u0103r\u00e2rea nr. 539\/2019 trebuia sau nu avizat\u0103 de poli\u0163ia rutier\u0103, \u015fi dac\u0103 lipsa aviz\u0103rii proiectului acestei hot\u0103r\u00e2ri are sau nu ca efect nulitatea respectivei hot\u0103r\u00e2ri, nu va fi dat \u00eens\u0103 de DGPMB sau de altcineva, ci doar de <em>instan\u0163a de judecat\u0103<\/em>, dac\u0103 \u015fi dup\u0103 ce va fi sesizat\u0103 cu aceast\u0103 problem\u0103 de c\u0103tre o persoan\u0103 care se consider\u0103 v\u0103t\u0103mat\u0103 \u00eentr-un drept al s\u0103u ori \u00eentr-un interes legitim, prin Hot\u0103r\u00e2rea Consiliului General al Municipiului Bucure\u015fti nr. 539\/2019.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Ce demersuri a mai f\u0103cut APADOR-CH pe acest subiect:<\/strong><\/p>\n<ol>\n<li><a href=\"https:\/\/www.apador.org\/cerem-avocatului-poporului-sa-conteste-taxa-oxigen-impusa-de-primaria-capitalei\/\" target=\"_blank\" rel=\"bookmark noopener\">Am cerut Avocatului Poporului s\u0103 conteste Taxa Oxigen impus\u0103 de Prim\u0103ria Capitalei<\/a><\/li>\n<li><a href=\"https:\/\/www.apador.org\/ce-zice-avp-despre-taxa-oxigen-si-cum-poate-fi-ea-contestata\/\" target=\"_blank\" rel=\"bookmark noopener\">Ce ne-a r\u0103spuns AVP despre \u201etaxa oxigen\u201d \u0219i cum poate fi ea contestat\u0103<\/a><\/li>\n<li><a href=\"https:\/\/www.apador.org\/taxa-oxigen-sau-cum-ii-scoate-primaria-capitalei-pe-saraci-din-oras\/\" target=\"_blank\" rel=\"bookmark noopener\">Taxa Oxigen sau cum \u00eei scoate Prim\u0103ria Capitalei pe s\u0103raci din ora\u0219<\/a><\/li>\n<li><a href=\"https:\/\/www.apador.org\/taxa-oxigen-a-fost-suspendata-la-geneva\/\" target=\"_blank\" rel=\"bookmark noopener\">Taxa oxigen a fost suspendat\u0103!
