You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><em>Responsabilizarea p\u0103rin\u021bilor nu afecteaz\u0103, ci protejeaz\u0103 dreptul la via\u021b\u0103 al copiilor<\/em><\/p>\n<p style=\"text-align: justify;\">APADOR-CH sus\u021bine vaccinarea obligatorie, \u00een cazul bolilor grave transmisibile, reiter\u00e2nd <strong><a href=\"https:\/\/www.apador.org\/obligativitatea-vaccinarii-in-cazul-bolilor-transmisibile-nu-incala-drepturile-si-libertatile-fundamentale\/\" target=\"_blank\" rel=\"noopener\">opinia exprimat\u0103 \u00een 2017<\/a><\/strong>, c\u00e2nd a fost depus\u0103 la Senat actuala lege care se discut\u0103 acum \u00een Camera Deputa\u021bilor. \u00cen pofida re\u021binerilor pe care <strong><a href=\"https:\/\/www.hotnews.ro\/stiri-sanatate-23695528-surse-proiectul-legii-vaccinarii-deblocat-dupa-2-ani-jumatate-stat-sertar-legea-nu-aduce-obligativitatea-vaccinarii-deoarece-nu-exista-consens-politic.htm\" target=\"_blank\" rel=\"noopener\">Comisia de S\u0103n\u0103tate le-a demonstrat ieri<\/a>,<\/strong> modific\u00e2nd proiectul de lege, asocia\u021bia <strong>consider\u0103 c\u0103 <\/strong><strong>obligativitatea vaccin\u0103rii,<\/strong><strong> pentru prevenirea r\u0103sp\u00e2ndirii bolilor grave transmisibile<\/strong><strong>,<\/strong><strong> nu constituie, \u00een sine, o \u00eenc\u0103lcare a drepturilor \u015fi libert\u0103\u0163ilor fundamentale<\/strong><strong>, \u0219i \u00eendeamn\u0103 deputa\u021bii s\u0103 voteze responsabil, a\u0219a cum ar trebui s\u0103-\u0219i vaccineze \u0219i copiii<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Iat\u0103 de ce:<\/p>\n<p style=\"text-align: justify;\"><strong><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">1<\/span> Dreptul la respectarea vie\u0163ii private \u015fi de familie<\/strong> (pe scurt, dreptul la via\u0163a privat\u0103), <strong>prev\u0103zut \u00een art. 8<\/strong> par. 1 din Conven\u0163ia European\u0103 a Drepturilor Omului (CEDO), invocat de unii contestatari ai conceptului de vaccinare obligatorie, <strong>nu este un drept absolut, care s\u0103 nu permit\u0103 excep\u0163ii\/limit\u0103ri \u015fi nu justific\u0103 lezarea dreptului la via\u0163\u0103 (dreptul de a tr\u0103i), garantat \u00een art. 2 din CEDO<\/strong>, drept ce trebuie recunoscut at\u00e2t copilului a c\u0103rui vaccinare se refuz\u0103, c\u00e2t \u015fi celorlal\u0163i copii din colectivitate, care vor intra \u00een contact cu cel nevaccinat nu numai la \u015fcoal\u0103, gr\u0103dini\u0163\u0103 etc, ci \u015fi \u00een parc, la cinema, \u00een mijloace de transport sau \u00een alte locuri publice din afara institu\u0163iilor de \u00eenv\u0103\u0163\u0103m\u00e2nt.<\/p>\n<p style=\"text-align: justify;\">\u00cen acest sens, art. 8 par. 2 din CEDO prevede c\u0103 dreptul la via\u0163a privat\u0103 poate fi \u00eengr\u0103dit dac\u0103 \u00eengr\u0103direa este prev\u0103zuta de lege \u015fi dac\u0103 constituie o m\u0103sur\u0103 care, \u00eentr-o societate democratic\u0103, este necesar\u0103, printre altele, pentru <strong>protejarea s\u0103n\u0103t\u0103\u0163ii<\/strong>, individuale sau publice, precum \u015fi pentru <strong>protejarea drepturilor \u015fi libert\u0103\u0163ilor altora<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">2<\/span><\/strong>De asemenea, contestatarii vaccin\u0103rii obligatorii invoc\u0103 <strong>libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie<\/strong>. Este adev\u0103rat, art. 9 par. 1 din CEDO prevede libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie. Dar, la fel ca \u015fi \u00een cazul dreptului la via\u0163a privat\u0103 prev\u0103zut \u00een art. 8 din CEDO, nici libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie, prev\u0103zut\u0103 \u00een art. 9 din CEDO, nu are caracter absolut \u015fi permite, \u00een anumite condi\u0163ii, excep\u0163ii\/limit\u0103ri.<\/p>\n<p style=\"text-align: justify;\">Astfel, art. 9 par. 2 din CEDO prevede c\u0103 libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie poate suporta anumite limit\u0103ri\/\u00eengr\u0103diri, dac\u0103 acestea sunt prev\u0103zute de lege \u015fi dac\u0103 sunt m\u0103suri necesare, \u00eentr-o societate democratic\u0103, \u00eentre altele, pentru <strong>protec\u0163ia s\u0103n\u0103t\u0103\u0163ii<\/strong>, individuale sau publice ori pentru protejarea drepturilor \u015fi libert\u0103\u0163ilor altora.\u00a0 \u00cen spe\u0163\u0103, limitarea acestei libert\u0103\u0163i apare ca fiind necesar\u0103 pentru protejarea s\u0103n\u0103t\u0103\u0163ii \u015fi chiar a vie\u0163ii at\u00e2t a copilului nevaccinat, c\u00e2t \u015fi a celorlal\u0163i copii, din colectivitate.<\/p>\n<p style=\"text-align: justify;\"><strong><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">3<\/span><\/strong>Totodat\u0103, articolul\u00a0<strong>17 din CEDO<\/strong>, care <strong>interzice abuzul de drept<\/strong>, prevede c\u0103 niciun drept\/libertate dintre cele prev\u0103zute \u00een cuprinsul CEDO (deci, nici dreptul la via\u0163a privat\u0103 sau libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie) nu poate fi exercitat abuziv, adic\u0103 <strong>nu poate fi folosit de nimeni (stat, grup sau individ) pentru \u00eendeplinirea de acte care urm\u0103resc distrugerea celorlalte drepturi sau libert\u0103\u0163i fundamentale ori pentru \u00eengr\u0103direa acestora<\/strong> \u00eentr-o m\u0103sur\u0103 mai mare dec\u00e2t o face CEDO.<\/p>\n<p style=\"text-align: justify;\">\u00cen consecin\u0163\u0103, dac\u0103 dreptul la via\u0163a privat\u0103\/libertatea de g\u00e2ndire, de con\u015ftiin\u0163\u0103 \u015fi de religie este exercitat printr-un refuz arbitrar al vaccin\u0103rii, el poate fi considerat ca fiind exercitat abuziv, \u00een raport de art. 17 din CEDO, deoarece o astfel de exercitare poate distruge\/pune \u00een pericol grav dreptul la via\u0163\u0103 (al copilului nevaccinat \u015fi al copiilor din colectivitate, de exemplu), garantat \u00een art. 2 din CEDO, prin crearea condi\u0163iilor de instalare \u015fi proliferare a unor boli mortale, care nu pot fi prevenite dec\u00e2t pe calea vaccin\u0103rii.<\/p>\n<p style=\"text-align: justify;\"><strong>Obliga\u021biile statului trebuie definite mai clar<\/strong><\/p>\n<p style=\"text-align: justify;\">Desigur, obliga\u0163ia de a se supune vaccin\u0103rii pentru prevenirea bolilor transmisibile nu \u00eenseamn\u0103 \u015fi obliga\u0163ia de a suporta\/accepta gre\u015felile medicale legate de administrarea vaccinului. Sau de a fi cobaiul unor experimente medicale. Din acest motiv, trebuie prev\u0103zut\u0103 \u00een mod clar obliga\u0163ia statului de a asigura vaccinurile la timp, \u00een cantitate suficient\u0103 \u015fi de calitate corespunz\u0103toare. De asemenea, tot statul este cel care trebuie s\u0103 ia m\u0103surile necesare \u015fi s\u0103 r\u0103spund\u0103 \u015fi pentru administrarea corect\u0103 a vaccinurilor, \u00een principal prin stabilirea unor proceduri care s\u0103 exclud\u0103 sau s\u0103 reduc\u0103 la minimul posibil efectele negative care ar putea ap\u0103rea \u00een cazul unor persoane.<\/p>\n<p style=\"text-align: justify;\">\u00cen acest sens, proiectul de Lege privind vaccinarea persoanelor \u00een Rom\u00e2nia,<em> \u00een varianta adoptat\u0103 de Senat,\u00a0<\/em>prevede \u00een art. 9 c\u0103 statul asigur\u0103 vaccinuri eficace \u015fi sigure, autorizate \u00een mod corespunz\u0103tor. Dar, art. 9 nu prevede \u015fi obliga\u0163ia statului de a\u00a0 asigura aceste vaccinuri la timp (pentru efectuarea lor conform calendarului stabilit) \u015fi \u00een cantit\u0103\u0163i suficiente pentru toate persoanele vizate de m\u0103sura vaccin\u0103rii. Este necesar\u0103 completarea art. 9 \u00een sensul celor men\u0163ionate mai sus.<\/p>\n<p style=\"text-align: justify;\">De asemenea, <em>proiectul de lege adoptat de Senat<\/em> prevede \u00een art. 22 condi\u0163iile \u00een care persoana este scutit\u0103 de vaccinare (vaccin\u0103rile obligatorii sunt indicate \u00een art. 13), deci c\u00e2nd \u00a0<strong>se poate refuza <em>justificat<\/em> vaccinarea<\/strong>, \u015fi anume atunci c\u00e2nd <strong>Comisia jude\u0163ean\u0103 de vaccinare de la domiciliul persoanei certific\u0103 faptul c\u0103 acesta are o contraindica\u0163ie definitiv\u0103 la un anumit vaccin sau la toate vaccinurile.<\/strong><\/p>\n<p style=\"text-align: justify;\">Cu alte cuvinte, proiectul de lege nu prevede o vaccinare \u201eautomat\u0103\u201d a tuturor persoanelor vizate, f\u0103r\u0103 s\u0103 se \u0163in\u0103 cont de cazurile care prezint\u0103 riscul punerii \u00een primejdie a s\u0103n\u0103t\u0103\u0163ii, ci dimpotriv\u0103, \u00eei excepteaz\u0103 de la aceast\u0103 obliga\u0163ie pe cei pentru care, din motive medicale certificate de c\u0103tre o comisie de specialitate, sunt contraindicate definitiv un anumit vaccin sau toate vaccinurile.<\/p>\n<p style=\"text-align: justify;\"><strong>\u00cen concluzie<\/strong>, APADOR-CH consider\u0103 c\u0103 adoptarea f\u0103r\u0103 \u00eent\u00e2rziere a unei legi care s\u0103 prevad\u0103 <strong>vaccinarea obligatorie<\/strong>, \u00een vederea prevenirii \u015fi limit\u0103rii bolilor transmisibile cu mare risc pentru colectivitate, poate contribui la \u00eembun\u0103t\u0103\u0163irea st\u0103rii de s\u0103n\u0103tate public\u0103. \u00cen acela\u0219i timp, adoptarea unei legi ambigue, laxe \u0219i aproximative, care s\u0103 nu asigure luarea \u0219i respectarea strict\u0103 a m\u0103surilor de profilaxie necesare \u00een cazul bolilor grave transmisibile \u00een colectivitate, nu va face dec\u00e2t s\u0103 creeze confuzie \u00een domeniul important al s\u0103n\u0103t\u0103\u021bii publice.<\/p>","protected":false},"excerpt":{"rendered":"<p>Sorry, this entry is only available in Rom\u00e2n\u0103.
