Cine e de vin\u0103 \u0219i ce se poate face ca s\u0103 repar\u0103m legea?<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Conducerea unei persoane la sediul poli\u0163iei<\/strong> este o m\u0103sur\u0103 administrativ\u0103 care poate fi dispus\u0103 de poli\u0163ist \u00eempotriva unei persoane, \u00een anumite cazuri (conduit\u0103 violent\u0103\/agresiv\u0103, preg\u0103tirea sau comiterea unei fapte ilegale, probleme privind stabilirea identit\u0103\u0163ii etc.).<\/p>\n<p style=\"text-align: justify;\">Aceast\u0103 m\u0103sur\u0103 este prev\u0103zut\u0103 \u00een art. 31 al. 1 lit. b \u015fi art. 36-40 din Legea nr. 218\/2002 privind organizarea \u015fi func\u0163ionarea Poli\u0163iei Rom\u00e2ne.<\/p>\n<p style=\"text-align: justify;\">\u00cen esen\u0163\u0103, conducerea la sediul poli\u0163iei <strong>este o privare de libertate<\/strong> similar\u0103, prin \u00eengr\u0103direa libert\u0103\u0163ii de mi\u015fcare, cu re\u0163inerea sau arestarea preventiv\u0103, care se dispun \u00een dosarele penale.<\/p>\n<p style=\"text-align: justify;\">Nu spunem noi asta, ci art. 4 al. 2 din Protocolul op\u0163ional la Conven\u0163ia \u00eempotriva torturii \u015fi a altor pedepse ori tratamente cu cruzime, inumane sau degradante (OPCAT), protocol ratificat de Rom\u00e2nia prin Legea nr. 109\/2009, care define\u015fte <strong>privarea de liberate <\/strong>ca fiind <strong>orice form\u0103 de deten\u0163ie sau \u00eenchisoare ori plasarea\u00a0 unei persoane \u00eentr-un loc public s<\/strong><strong>a<\/strong><strong>u privat de re\u0163inere pe care nu \u00eel poate p\u0103r\u0103si dup\u0103 voia sa, prin ordinul oric\u0103rei autorit\u0103\u0163i judiciare, <em>administrative<\/em> sau de alt\u0103 natur\u0103<\/strong>.<\/p>\n<p style=\"text-align: justify;\">La 26 ianuarie 2020, au intrat \u00een vigoare cele mai recente modific\u0103ri ale Legii nr. 218\/2002 privind organizarea \u015fi func\u0163ionarea Poli\u0163iei Rom\u00e2ne. Noile modific\u0103ri con\u0163in \u015fi o reglementare detaliat\u0103 a regimului juridic al m\u0103surii <strong><em>conducerii administrative la sediul poli\u0163iei<\/em><\/strong>: procedura conducerii, drepturile persoanei conduse, c\u0103ile de atac \u00eempotriva m\u0103surii etc. Din p\u0103cate, \u00een legea astfel modificat\u0103 <strong>nu se mai prevede<\/strong><strong> \u0219i<\/strong><strong> durata maxim\u0103 a m\u0103surii conducerii administrative<\/strong><strong>, care \u00een <\/strong><strong>vechea variant\u0103 a legii, era<\/strong> <strong>de 24 de ore. <\/strong><\/p>\n<p style=\"text-align: justify;\">Este adev\u0103rat c\u0103 \u00een art. 36 al. 4 al. 5 din actuala form\u0103 a Legii 218\/2002 se prevede c\u0103 poli\u0163istul are obliga\u0163ia ca, <strong>de \u00eendat\u0103<\/strong>, s\u0103 fac\u0103 verific\u0103rile necesare \u0219i s\u0103 ia m\u0103surile legale, dup\u0103 care s\u0103 permit\u0103 persoanei s\u0103 p\u0103r\u0103seasc\u0103 sediul poli\u0163iei. Dar, \u00een lipsa unei limit\u0103ri de timp prev\u0103zute \u00een lege pentru finalizarea activit\u0103\u0163ilor sau m\u0103surilor de la sediul poli\u0163iei ori pentru durata m\u0103surii administrative, conducerea administrativ\u0103 nu mai are o durat\u0103 de timp determinat\u0103. Din acest motiv, este posibil ca, \u00een practic\u0103, aceast\u0103 omisiune s\u0103 lase loc arbitrariului, \u00een sensul unei priv\u0103ri de liberate pe durat\u0103 de timp nedeterminat\u0103, care ar putea dep\u0103\u0219i, de exemplu, chiar \u0219i 24 de ore. Un poli\u021bist are de efectuat numeroase activit\u0103\u021bi \u0219i este posibil ca, \u00een practic\u0103, alte activit\u0103\u021bi s\u0103 aib\u0103 prioritate fa\u021b\u0103 de cea legat\u0103 strict de conducerea administrativ\u0103.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ce spune Ministerul Afacerilor Interne?<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00cen 2019, \u00een timpul modific\u0103rii legii, <strong><a href=\"https:\/\/www.apador.org\/ce-drepturi-ai-cand-esti-condus-la-sectia-de-politie\/\" target=\"_blank\" rel=\"noopener noreferrer\">APADOR-CH a f\u0103cut unele recomand\u0103ri cu privire la reglementarea conducerii administrative<\/a><\/strong>, \u00een sensul introducerii unor garan\u021bii de respectare a drepturilor omului (dreptul de a fi consultat de un medic sau de a da un telefon), iar poli\u0163ia a dovedit deschidere \u015fi a acceptat multe dintre aceste modific\u0103ri. A\u0219a \u00eenc\u00e2t, la promulgarea legii a ap\u0103rut oarecum surprinz\u0103toare \u201edispari\u0163ia\u201d din lege tocmai a termenului maxim pentru care poate fi dispus\u0103 m\u0103sura, termen care nu fusese pus deloc \u00een discu\u021bie \u00een momentul dezbaterilor organizate de MAI.<\/p>\n<p style=\"text-align: justify;\">Am \u00eentrebat poli\u0163ia, <a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/03\/Sesizare-MAI-lipsa-termen-cond-admin.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">printr-o sesizare adresat\u0103 MAI<\/a>, cum de termenele maxime pentru conducerea administrativ\u0103 (8\/12 ore), care existau \u00een proiectul de lege, au disp\u0103rut din varianta final\u0103 a legii?<\/p>\n<p style=\"text-align: justify;\">R\u0103spunsul a fost prompt \u015fi clar: proiectul de lege a plecat de la poli\u0163ie (MAI) cu termene maxime pentru conducerea administrativ\u0103 (8\/12 ore) \u015fi a fost adoptat de Senat tot cu aceste termene maxime. Dar, la Camera Deputa\u0163ilor au fost eliminate termenele maxime, \u00een urma admiterii unui amendament \u00een acest sens.<\/p>\n<a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/03\/Sesizare-MAI-lipsa-termen-cond-admin.pdf\" class=\"su-button su-button-style-default su-button-wide\" style=\"color:#324645;background-color:#fde306;border-color:#cbb605;border-radius:6px\" target=\"_blank\" rel=\"noopener noreferrer\" title=\"Cite\u0219te sesizarea c\u0103tre MAI\"><span style=\"color:#324645;padding:6px 18px;font-size:14px;line-height:21px;border-color:#feec51;border-radius:6px;text-shadow:none\"><i class=\"sui sui-book\" style=\"font-size:14px;color:#FFFFFF\"><\/i> Cite\u0219te sesizarea c\u0103tre MAI<\/span><\/a>\n<a href=\"https:\/\/www.apador.org\/wp-content\/uploads\/2020\/03\/raspuns-IGPR-conducere-administrativa.pdf\" class=\"su-button su-button-style-default su-button-wide\" style=\"color:#324645;background-color:#06b2fd;border-color:#058fcb;border-radius:6px\" target=\"_blank\" rel=\"noopener noreferrer\" title=\"Cite\u0219te r\u0103spunsul MAI\"><span style=\"color:#324645;padding:6px 18px;font-size:14px;line-height:21px;border-color:#51cafe;border-radius:6px;text-shadow:none\"><i class=\"sui sui-book\" style=\"font-size:14px;color:#FFFFFF\"><\/i> Cite\u0219te r\u0103spunsul MAI <\/span><\/a>\n<h2 style=\"text-align: justify;\"><strong>Ce s-a \u00eent\u00e2mplat la Camera Deputa\u021bilor?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Verific\u00e2nd traseul legislativ al PL-x nr. 254\/2019 pe site-ul Camerei Deputa\u0163ilor, am aflat c\u0103 \u00een <a href=\"http:\/\/www.cdep.ro\/comisii\/juridica\/pdf\/2019\/rp254;2.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Raportul comun suplimentar din 2.07.2019 al comisiei juridice<\/strong><\/a> \u015fi al comisiei pentru ap\u0103rare se men\u0163ioneaz\u0103 c\u0103 au fost aprobate mai multe amendamente ale domnului\u00a0<strong>Marton Arpad, deputat UDMR, care se refereau exact la eliminarea termenelor maxime de 8 sau, dup\u0103 caz, 12 ore prev\u0103zute de lege pentru m\u0103sura conducerii administrative.<\/strong><\/p>\n<p style=\"text-align: justify;\">A\u0219a se face c\u0103 a r\u0103mas \u00een lege o m\u0103sur\u0103 privativ\u0103 de libertate (conducerea administrativ\u0103 la poli\u0163ie) f\u0103r\u0103 s\u0103 fie prev\u0103zut\u0103 \u0219i o durat\u0103 maxim\u0103 pentru asta.<\/p>\n<p style=\"text-align: justify;\">Este posibil ca eliminarea termenelor maxime pentru conducerea administrativ\u0103 s\u0103 se bazeze pe bune inten\u0163ii. Poate c\u0103 termenele de 8 sau 12 ore au p\u0103rut prea lungi, \u015fi atunci s-a apreciat c\u0103 este mai bine s\u0103 fie eliminate \u015fi s\u0103 r\u0103m\u00e2n\u0103 doar prevederea c\u0103 poli\u0163istul trebuie s\u0103 ia m\u0103surile <strong><em>de \u00eendat\u0103<\/em><\/strong>, dup\u0103 care s\u0103-i permit\u0103 persoanei s\u0103 plece.<\/p>\n<p style=\"text-align: justify;\">Numai c\u0103, experien\u0163a de dat\u0103 relativ recent\u0103, ne \u00eenva\u0163\u0103 c\u0103 sintagma \u201e<strong><em>de \u00eendat\u0103<\/em><\/strong>\u201d poate \u00eensemna uneori, \u00een practic\u0103\/realitate, chiar \u015fi mai mult de 30 de zile. Atunci, de ce nu ar putea \u00eensemna, pentru unii poli\u0163i\u015fti, \u00een anumite situa\u0163ii, \u00een care trebuie desf\u0103\u015furate foarte multe alte activit\u0103\u0163i specifice, 4 sau 5 zile, de exemplu?<\/p>\n<h2 style=\"text-align: justify;\"><strong>Cum judec\u0103 CEDO?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Tocmai de aceea, pentru evitarea arbitrariului ce intervine \u00een astfel de situa\u021bii, <strong>CEDO a subliniat c\u0103 \u00een cazul oric\u0103rei m\u0103suri privative de libertate este necesar<\/strong><strong> ca \u00een lege<\/strong><strong> s\u0103 se prevad\u0103 <u>durata<\/u><\/strong><strong><u> maxim\u0103<\/u><\/strong><strong><u> de timp<\/u><\/strong><strong> pentru care aceast\u0103 privare de libertate poate fi dispus\u0103 <\/strong>(spre exemplu, hot\u0103r\u00e2rea CEDO \u00een cazul <em>J.N. \u00eempotriva Regatului Unit<\/em>, pct.77).<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul nostru, <strong>arbitrariul poate fi evitat printr-o dubl\u0103 condi\u0163ionare a duratei m\u0103surii conducerii administrative<\/strong>, la fel cum exist\u0103 \u015fi \u00een cazul m\u0103surilor preventive de drept penal (re\u0163inere, arestare preventiv\u0103): ea poate s\u0103 dureze numai at\u00e2t c\u00e2t este necesar pentru luarea m\u0103surilor, dar f\u0103r\u0103 a dep\u0103\u015fi o anumit\u0103 durat\u0103 maxim\u0103.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 8 sau 12 ore sunt prea mult ca durat\u0103 maxim\u0103, sigur c\u0103 termenul poate fi scurtat, la 2 ore, la 4 ore sau la 6 ore. Dar, indiferent de durata termenului maxim 2, 4, 6, 8, 10, 12, este necesar ca \u00een lege s\u0103 se prevad\u0103 expres o durat\u0103 maxim\u0103 a m\u0103surii conducerii administrative.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ce e de f\u0103cut?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Solu\u0163ia pare simpl\u0103, dac\u0103 exist\u0103 \u015fi voin\u0163\u0103 politic\u0103: o modificare a legii \u00een sensul introducerii la art. 36 al. 4 \u015fi 5 din Legea 218\/2002 a duratei maxime a conducerii administrative \u015fi a obliga\u0163iei de a permite plecarea persoanei din sec\u0163ie la expirarea acelui termen. Dac\u0103 exist\u0103 cel pu\u0163in un parlamentar care dore\u015fte acest lucru, el poate depune \u00een parlament un proiect de lege \u00een acest sens.
