You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><em>Regulile esen\u0163iale din legisla\u0163ia electoral\u0103 nu pot fi schimbate cu mai pu\u0163in de 1 an \u00eenaintea alegerilor<\/em><\/p>\n<p style=\"text-align: justify;\">\u00cen plin\u0103 pandemie de coronavirus, la 12 martie 2020, Curtea Constitu\u0163ional\u0103 \u015fi-a v\u0103zut de treab\u0103 \u015fi <strong><a href=\"http:\/\/www.ccr.ro\/download\/comunicate_de_presa\/Comunicat-de-presa-12-martie-2020.pdf\" target=\"_blank\" rel=\"noopener\">a declarat neconstitu\u0163ional\u0103 \u00eentreaga OUG nr. 26\/2020 privind alegerile anticipate<\/a>. <\/strong>Aceasta face parte din cele 25 de ordonan\u0163e de urgen\u0163\u0103 adoptate \u00een noaptea de 4 februarie 2020, de c\u0103tre <a href=\"https:\/\/www.apador.org\/daca-guvernul-pica-ordonantele-raman\/\" target=\"_blank\" rel=\"noopener\">un guvern care era sigur c\u0103 a doua zi va fi demis<\/a> de parlament (ceea ce s-a \u0219i \u00eent\u00e2mplat).<\/p>\n<p style=\"text-align: justify;\">La 17 februarie <strong>APADOR-CH <a href=\"https:\/\/www.apador.org\/cerem-avocatului-poporului-sa-atace-la-ccr-opt-din-cele-25-de-ordonante-de-urgenta-adoptate-de-guvernul-orban\/\" target=\"_blank\" rel=\"noopener\">a cerut Avocatului Poporului s\u0103 atace la Curtea Constitu\u0163ional\u0103 8 din cele 25 de ordonan\u0163e de urgen\u0163\u0103 adoptate la 4 februarie 2020<\/a><\/strong>, printre ele afl\u00e2ndu-se \u015fi OUG nr. 26\/2020 privind alegerile anticipate.<\/p>\n<p style=\"text-align: justify;\">Sesizat \u0219i de alte entit\u0103\u021bi, pe aceea\u0219i tem\u0103, \u00een februarie Avocatul Poporului a atacat la Curtea Constitu\u0163ional\u0103 OUG nr. 26\/2020, iar la data de 12 martie 2020 CCR a declarat ordonan\u021ba neconstitu\u021bionat\u0103 \u00een ansamblul s\u0103u.<\/p>\n<p style=\"text-align: justify;\">Printre motivele de neconstitu\u021bionalitate, CCR a stabilit c\u0103, prin derularea alegerilor locale \u0219i parlamentare \u00een acela\u0219i timp, sunt \u00eenc\u0103lcate:<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>drepturile aleg\u0103torului<\/strong> &#8211; care este pus \u00een situa\u021bia de a parcurge ni\u0219te proceduri greoaie ce-i vor afecta dreptul la vot,<\/li>\n<li style=\"text-align: justify;\">precum \u0219i <strong>dreptul de a fi ales al persoanei<\/strong> care ar dori s\u0103 candideze at\u00e2t la func\u021bii locale c\u00e2t \u0219i na\u021bionale.<\/li>\n<li style=\"text-align: justify;\">CCR a sanc\u021bionat \u0219i <strong>inten\u021bia Guvernului de a redefini circumscrip\u021biile electorale<\/strong> prin permiterea votului \u00een orice sec\u021bie, indiferent de localitata de re\u0219edin\u021b\u0103 sau domiciliu.<\/li>\n<li style=\"text-align: justify;\">De asemenea, CCR a mai constatat c\u0103 Guvernul nu a respectat obliga\u021bia de a se ab\u021bine de la modificarea cadrului normativ \u00een materie electoral\u0103, cu mai pu\u021bin de un an \u00eenainte de alegeri, \u015fi nici recomand\u0103rile Codului bunelor practici \u00een materia electoral\u0103 elaborat de Comisia de la Vene\u0163ia.<\/li>\n<\/ul>\n<div class=\"su-note\"  style=\"border-color:#df5156;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\"><div class=\"su-note-inner su-u-clearfix su-u-trim\" style=\"background-color:#f96b70;border-color:#ffffff;color:#333333;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\">\n<p style=\"text-align: justify;\"><strong>Reamintim \u0219i motivele invocate de APADOR-CH cu privire la neconstitu\u0163ionalitatea OUG nr. 26\/2002, expuse \u00een sesizarea adresat\u0103 Avocatului Poporului la 17 februarie 2020:<\/strong><\/p>\n<p style=\"text-align: justify;\">&#8230;adoptarea intempestiv\u0103 a OUG 26\/2020, privind alegerile, a generat numeroase dispute \u015fi suspiciuni \u00een sensul c\u0103 Guvernul \u00ee\u015fi folose\u015fte dreptul de a emite ordonan\u0163e de urgen\u0163\u0103 pentru a crea avantaje electorale unor forma\u0163iuni politice, inclusiv prin <strong>redefinirea indirect\u0103 a no\u0163iunii de circumscrip\u0163ie electoral\u0103<\/strong>. Astfel de modific\u0103ri de substan\u0163\u0103 ale legisla\u0163iei electorale trebuie f\u0103cute doar prin lege \u015fi s\u0103 fie precedate de dezbateri publice cu o anvergur\u0103 pe m\u0103sura importan\u0163ei problemei ce face obiectul legifer\u0103rii.<\/p>\n<p style=\"text-align: justify;\">\u00cen preambulul ordonan\u021bei sunt prezentate elemente de oportunitate, dar nu \u015fi elemente de fapt \u015fi de drept care s\u0103 contureze o situa\u0163ie extraordinar\u0103 ce impune recurgerea la aceast\u00e3 cale de reglementare. \u00cen acest context, men\u0163iunea f\u0103cut\u0103 \u00een preambulul OUG 26\/2020 \u00een sensul c\u0103 la caracterul excep\u0163ional al situa\u0163iei ar concura \u201e&#8230; <em>eventualitatea adopt\u0103rii mo\u0163iunii de cenzur\u0103<\/em>\u201d este \u00een egal\u0103 m\u0103sur\u0103 \u015fi netemeinic\u0103 \u015fi comic\u0103, \u00eentruc\u00e2t iminen\u0163a demiterii unui guvern nu justific\u0103 intensificarea activit\u0103\u0163ii de legiuitor delegat, ci dimpotriv\u0103, o re\u0163inere generat\u0103 de indiciile puternice c\u0103 acel guvern este pe cale de a-\u015fi pierde legitimitatea.<\/p>\n<p style=\"text-align: justify;\">\u00cen plus, \u00een cazul legisla\u0163iei electorale ar trebui avute \u00een vedere \u015fi recomand\u0103rile Comisiei de la Vene\u0163ia \u00een sensul c\u0103 nu ar trebui f\u0103cute modific\u0103ri cu mai pu\u0163in de 1 an \u00eenainte de data la care se vor desf\u0103\u015fura alegerile. Recomand\u0103rile Comisiei de la Vene\u0163ia privind termenul de 1 an \u00eenainte de alegeri nu fac distinc\u0163ie dup\u0103 cum modific\u0103rile legisla\u0163iei electorale sunt \u201ebune\u201d sau \u201erele\u201d, adic\u0103 dup\u0103 cum scopul lor declarat este sau nu de a aduce mai mult\u0103 democra\u0163ie, mai mult\u0103 participare, \u00eenlesniri la vot etc. Ideea acestor recomand\u0103ri este stabilitatea legisla\u0163iei electorale, stabilitate care este afectat\u0103\u00a0 atunci c\u00e2nd se aduc \u201e\u00eembunat\u0103\u0163iri\u201d cu mai pu\u0163in de 1 an \u00eenainte de alegeri.<\/p>\n<p style=\"text-align: justify;\">\u00cen acest sens, la pct. 65 din raportul explicativ care \u00eenso\u0163e\u015fte Codul bunelor practici \u00een materie electoral\u0103 elaborat de Comisia de la Vene\u021bia, se precizeaz\u0103 c\u0103:<\/p>\n<p style=\"text-align: justify;\">\u201e<em>65. Ceea ce trebuie evitat, este nu at\u00e2t modificarea sistemelor de scrutin &#8211;\u00a0 ele pot\u00a0 fi \u00eentotdeauna \u00eembun\u0103t\u0103\u0163ite\u00a0 \u2013\u00a0 ci\u00a0 <strong>modificarea\u00a0 lor\u00a0 frecvent\u0103\u00a0\u00a0\u00a0 sau\u00a0 cu\u00a0 pu\u0163in\u00a0 timp\u00a0 (mai\u00a0 pu\u0163in\u00a0 de\u00a0 un\u00a0 an)\u00a0 \u00eenainte\u00a0 de\u00a0 alegeri<\/strong>.\u00a0 Chiar\u00a0 \u00een\u00a0 absen\u0163a\u00a0 unei\u00a0 inten\u0163ii\u00a0 de\u00a0 manipulare,\u00a0 modific\u0103rile\u00a0 vor\u00a0 fi\u00a0 dictate\u00a0 de\u00a0 interesele\u00a0 iminente ale partidului politic.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\"><\/div><\/div>\n<p style=\"text-align: justify;\">Deci, <strong>nu pot fi invocate \u201ebunele inten\u0163ii\u201d (cre\u0219terea particip\u0103rii la vot \u015fcl.) ca pretext pentru \u00eenc\u0103lcarea termenului de 1 an<\/strong>. Important este, conform Comisiei de la Vene\u0163ia, ale c\u0103rei recomand\u0103ri se reg\u0103sesc \u0219i \u00een decizia de azi a Cur\u0163ii Constitu\u0163ionale, ca regulile esen\u0163iale ale alegerilor s\u0103 nu se modifice cu mai pu\u021bin de 1 an \u00eenaintea alegerilor, nici chiar dac\u0103 se invoc\u0103 nevoia de \u201ebine&#8221;, de \u00eembun\u0103t\u0103\u0163ire a regulilor esen\u0163iale.
