Ce op\u021biuni ar fi avut legiuitorul la dispozi\u021bie ca s\u0103 \u00een\u0103spreasc\u0103, totu\u0219i, pedepsele pentru cei care r\u0103sp\u00e2ndesc coronavirusul?<\/em><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Noaptea trecut\u0103, guvernul a adoptat<a href=\"http:\/\/www.just.ro\/wp-content\/uploads\/2020\/03\/Proiect-OUG-CP-agravare-infractiuni-COVID19_18.03.2020_dupa-sedinta-Guv-1.pdf\" target=\"_blank\" rel=\"noopener\"> o ordonan\u0163\u0103 de urgen\u0163\u0103 de modificare a Codului penal<\/a>, prin care e m\u0103rit num\u0103rul infrac\u0163iunilor \u00een leg\u0103tur\u0103 cu pandemia \u015fi, de asemenea, a majorat pedepsele pentru aceste infrac\u0163iuni.<\/p>\n<p style=\"text-align: justify;\">Necesitatea extinderii incrimin\u0103rii \u015fi la noi fapte privind pandemia, precum \u015fi majorarea pedepselor pentru aceste fapte, a fost prezentat\u0103 public \u0219i de APADOR-CH \u00een cursul zilei de ieri (<a href=\"https:\/\/www.apador.org\/pedepsele-pentru-cei-care-incalca-izolarea-si-carantina-trebuie-insaprite\/\" target=\"_blank\" rel=\"noopener\">documentul aici<\/a>).<\/p>\n<p style=\"text-align: justify;\">APADOR-CH solicitase luarea acestor m\u0103suri prin lege, de c\u0103tre Parlament, \u00een procedur\u0103 de urgen\u0163\u0103, \u00eentruc\u00e2t, potrivit Constitu\u0163iei, oricum Parlamentul trebuie s\u0103 func\u0163ioneze pe \u00eentreaga durat\u0103 a st\u0103rii de urgen\u0163\u0103. \u015ei ce alt\u0103 preocupare mai important\u0103 pentru Parlament ar fi, pe vreme de pandemie, dec\u00e2t s\u0103 adopte, urgent, legi despre pandemie?<\/p>\n<p style=\"text-align: justify;\">Desigur, Guvernul a fost animat de bune inten\u0163ii atunci c\u00e2nd a adoptat OUG de modificare a Codului penal, dar, exist\u0103 cel pu\u0163in 3 probleme care se ridic\u0103:<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">1<\/span>Referendumul na\u0163ional din 26 mai 2019, prin r\u0103spunsul la \u00eentrebarea nr. 2, a stabilit c\u0103 nu se pot adopta ordonan\u0163e de urgen\u0163\u0103 \u201e<strong><em>\u00een domeniul infrac\u021biunilor, pedepselor<\/em><\/strong><em> \u0219i al organiz\u0103rii judiciare<\/em>\u201d. Deci, pedepsele nu pot fi majorate \u0219i nici nu pot fi introduse noi infrac\u021biuni prin ordonan\u021b\u0103 de urgen\u021b\u0103, pentru c\u0103 a\u0219a s-a stabilit la referendumul amintit.<\/p>\n<p style=\"text-align: justify;\">\u00cen plus, nici \u00eenainte de referendumul din 2019 nu puteau fi introduse infrac\u0163iuni prin OUG, deoarece prin OUG nu pot fi afectate (=restr\u00e2nse) drepturi \u015fi libert\u0103\u0163i (sanc\u0163iunea \u00eenchisorii este o afectare a libert\u0103\u0163ii individuale, iar aceast\u0103 sanc\u0163iune este prev\u0103zut\u0103 \u00een cazul comiterii unei infrac\u0163iuni, adic\u0103 \u00een cazul adopt\u0103rii\/neadopt\u0103rii de c\u0103tre o persoan\u0103 a unei anumite conduite prev\u0103zute de Codul penal).<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">2<\/span>Modificarea adus\u0103 Codului penal prin noua OUG nu sanc\u0163ioneaz\u0103 ca infrac\u0163iune \u015fi \u00eenc\u0103lcarea m\u0103surii izol\u0103rii la domiciliu, ci doar \u00eenc\u0103lcarea carantinei\/spitaliz\u0103rii. Totu\u015fi, ambele fapte, \u015fi \u00eenc\u0103lcarea izol\u0103rii, \u015fi \u00eenc\u0103lcarea carantinei prezint\u0103 un pericol similar de extindere a pandemiei, \u00eentruc\u00e2t aceste m\u0103suri se iau fa\u0163\u0103 de persoane care prezint\u0103 riscul de a fi infecta\u0163i cu un virus care se transmite foarte repede \u015fi foarte u\u015for.<\/p>\n<p style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">3<\/span>Pedeapsa de maximum 3 ani \u00eenchisoare prev\u0103zut\u0103 prin noua OUG pentru \u00eenc\u0103lcarea carantinei nu permite luarea m\u0103surii arest\u0103rii preventive pe motiv c\u0103 respectiva persoan\u0103 constituie un pericol pentru ordinea public\u0103. Aceasta deoarece art. 223 al. 2 din Codul de procedur\u0103 penal\u0103 prevede c\u0103 este nevoie ca pedeapsa prev\u0103zut\u0103 de lege pentru o infrac\u0163iune s\u0103 fie de cel pu\u0163in 5 ani \u00eenchisoare sau s\u0103 fie comise anumite infrac\u0163iuni (printre care nu sunt prev\u0103zute \u015fi cele privind transmiterea bolilor infectocontagioase).<\/p>\n<p style=\"text-align: justify;\">Desigur, nu milit\u0103m pentru combaterea pandemiei prin arest\u0103ri, dar, dac\u0103, \u0163in\u00e2nd cont de experien\u0163a recentelor incidente, tot a fost prev\u0103zut\u0103 o nou\u0103 infrac\u0163iune legat\u0103 de transmiterea virusului pandemic, ea ar fi trebuit s\u0103 fie reglementat\u0103 \u00een a\u015fa fel \u00eenc\u00e2t, atunci c\u00e2nd este absolut necesar, s\u0103 se poat\u0103 lua \u015fi m\u0103sura extrem\u0103 a arest\u0103rii preventive. A\u015fa, textul din Codul penal este o sabie f\u0103r\u0103 lam\u0103. Dar, cu m\u00e2ner frumos.<\/p>\n<h2 style=\"text-align: justify;\">Alternativa?<\/h2>\n<p style=\"text-align: justify;\">Poate c\u0103 o solu\u021bie mai potrivit\u0103 era adoptarea urgent\u0103 de c\u0103tre Parlament a unei <strong><em>legi penale temporare<\/em><\/strong>, care s\u0103 prevad\u0103 infrac\u021biuni \u0219i pedepse severe, doar pe durata pandemiei.
