{"id":7548,"date":"2020-04-03T16:42:12","date_gmt":"2020-04-03T14:42:12","guid":{"rendered":"https:\/\/www.apador.org\/?p=7548"},"modified":"2020-04-03T16:42:12","modified_gmt":"2020-04-03T14:42:12","slug":"transparenta-si-urgenta","status":"publish","type":"post","link":"https:\/\/apador.org\/en\/transparenta-si-urgenta\/","title":{"rendered":"Transparen\u021ba \u0219i urgen\u021ba"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><em>Transparen\u0163a decizional\u0103 \u015fi dialogul social \u00een vreme de pandemie<\/em> <\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Articolul I pct. 5 din OUG nr. 34\/2020 prevede o modificare \u00een sensul c\u0103,\npe perioada st\u0103rii de asediu sau a st\u0103rii de urgen\u021b\u0103, normele legale referitoare\nla transparen\u021ba decizional\u0103 \u0219i dialogul social nu se aplic\u0103 \u00een cazul\nproiectelor de acte normative prin care se stabilesc m\u0103suri aplicabile pe\ndurata st\u0103rii de asediu sau a st\u0103rii de urgen\u021b\u0103 ori care sunt o consecin\u021b\u0103 a\ninstituirii acestor st\u0103ri.<\/p>\n\n\n\n<p>\u00cen linii mari, \u00een cazul adopt\u0103rii de acte normative, \u201etransparen\u021ba decizional\u0103\u201d\n\u00eenseamn\u0103 c\u0103 un proiect de act normativ este supus consult\u0103rii opiniei publice\ncu 30 de zile \u00eenainte de a fi adoptat (conform Legii nr. 52\/2003). Iar \u201edialog\nsocial\u201d \u00eenseamn\u0103 c\u0103 un proiect de act normativ este supus, cu 10 zile \u00eenainte\nde adoptare, avizului prealabil \u015fi consultativ al Consiliului Economic \u015fi\nSocial (organism tripartit, format din reprezentan\u0163i ai societ\u0103\u0163ii civile, ai\nsindicatelor \u015fi ai patronatelor), conform Legii nr. 248\/2013.<\/p>\n\n\n\n<p>Justificarea acestei excep\u0163ii de la regula transparen\u0163ei \u015fi dialogului este\nc\u0103, \u00een stare de asediu sau de urgen\u0163\u0103, exist\u0103 m\u0103suri care trebuie luate\nimediat, f\u0103r\u0103 nicio \u00eent\u00e2rziere, \u00een caz contrar efectul lor fiind anulat sau\nnegativ ori chiar opus celui urm\u0103rit.<\/p>\n\n\n\n<p>Spre exemplu, instituirea carantinei \u00een municipiul Suceava \u015fi \u00een opt comune\nlimitrofe, prin Ordonan\u0163a militar\u0103 nr. 6\/2020, dac\u0103 ar&nbsp; fi f\u0103cut obiectul unor consult\u0103ri publice\nanterior adopt\u0103rii, ar fi putut duce la migra\u0163ii \u00een mas\u0103 din acea zon\u0103, pentru\nevitarea carantinei.&nbsp; A\u015fa s-a \u00eent\u00e2mplat\n\u00een Italia, c\u00e2nd un proiect de instituire a carantinei \u00eentr-o zon\u0103 a fost f\u0103cut\npublic cu dou\u0103 zile \u00eenainte de adoptare \u015fi a dus la un exod al popula\u0163iei din\nzona ce urma s\u0103 fie carantinat\u0103 \u00een restul \u0163\u0103rii, ceea ce a dus la o extindere a\ncontamin\u0103rii.<\/p>\n\n\n\n<p>De altfel, chiar Legea nr. 52\/2003 privind transparen\u0163a decizional\u0103 prevede\n\u00een art. 7 al. 13 c\u0103 \u00een cazul reglement\u0103rii unei situa\u021bii care, din cauza\ncircumstan\u021belor sale excep\u021bionale, impune adoptarea de solu\u021bii imediate, \u00een\nvederea evit\u0103rii unei grave atingeri aduse interesului public, proiectele de\nacte normative se supun adopt\u0103rii \u00een procedura de urgen\u021b\u0103 prev\u0103zut\u0103 de\nreglement\u0103rile \u00een vigoare. \u00cen spe\u0163\u0103, procedura de adoptare \u00een regim de urgen\u0163\u0103\na fost prev\u0103zut\u0103 prin OUG nr. 34\/2020. <\/p>\n\n\n\n<p>Este de observat faptul c\u0103 regulile transparen\u0163ei decizionale \u015fi dialogului\nsocial nu sunt \u201esuspendate\u201d permanent, ci numai pe durata st\u0103rii de\nurgen\u0163\u0103\/asediu \u015fi c\u0103 \u201esuspendarea\u201d <strong><em>nu se aplic\u0103 \u00een cazul tuturor\nproiectelor de acte normative<\/em><\/strong>, ci doar al celor care au leg\u0103tur\u0103\ndirect\u0103 cu starea de urgen\u0163\u0103\/asediu.<\/p>\n\n\n\n<p>\u00cen consecin\u0163\u0103, dac\u0103 pe durata st\u0103rii de urgen\u0163\u0103 sunt elaborate proiecte de\nacte normative care nu stabilesc m\u0103suri aplicabile doar pe durata acestei st\u0103ri\nexcep\u0163ionale sau care nu decurg din instituirea acestei st\u0103ri, ci alte m\u0103suri,\ncu aplicabilitate \u015fi dup\u0103 \u00eencetarea st\u0103rii de urgen\u0163\u0103, normele legale\nreferitoare la transparen\u021ba decizional\u0103 \u0219i dialogul social se aplic\u0103 \u00een\ncontinuare, \u015fi pe durata st\u0103rii de urgen\u0163\u0103, \u00een cazul acestei categorii de\nproiecte de acte normative.<\/p>\n\n\n\n<p>Poate c\u0103 era mai potrivit\u0103 o nuan\u0163are \u00een noua reglementare introdus\u0103 prin\nOUG nr. 34\/20202, \u00een sensul c\u0103 exceptarea de la regula transparen\u0163ei \u015fi\ndialogului s\u0103 nu se fac\u0103 \u00een toate cazurile de acte normative prin care se\nstabilesc m\u0103suri aplicabile pe durata st\u0103rii de asediu sau a st\u0103rii de urgen\u021b\u0103\nori care sunt o consecin\u021b\u0103 a instituirii acestor st\u0103ri, ci doar \u00een cazul\nproiectelor pentru care, \u00een mod real \u015fi demonstrabil, \u00eent\u00e2rzierea \u00een adoptare sau\ndezv\u0103luirea \u00een faza de proiect ar avea consecin\u0163e negative. <\/p>\n\n\n\n<p>Pentru celelalte proiecte de acte normative, ce ar urma s\u0103 fie adoptate \u00een\nleg\u0103tur\u0103 cu starea de asediu sau urgen\u0163\u0103 \u015fi pentru care transparen\u0163a sau\ndialogul nu ar putea produce consecin\u0163e negative, \u00een raport de caracterul\nurgent sau special al m\u0103surii ce urmeaz\u0103 s\u0103 fie adoptate, ar fi putut fi\nprev\u0103zute termene scurte sau foarte scurte, de nivelul uneia sau c\u00e2torva zile,\npentru consultare public\u0103 \u015fi dialog.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Transparen\u0163a
