You may click the link to switch the active language.<\/p><h3 style=\"text-align: justify;\"><em>Ce a decis Curtea Constitu\u0163ional\u0103 cu privire la starea de urgen\u0163\u0103; Ce se \u00eent\u00e2mpl\u0103 cu amenzile necontestate \u00een termen; Poli\u021bia poate amenda \u00een continuare; Ce trebuie s\u0103 fac\u0103 Parlamentul \u0219i Guvernul mai departe<\/em><\/h3>\n<p style=\"text-align: justify;\">\u00cen \u015fedin\u0163a din 6 mai 2020, Curtea Constitu\u0163ional\u0103 s-a pronun\u0163at cu privire la sesizarea Avocatului Poporului privind dou\u0103 ordonan\u0163e de urgen\u0163\u0103, respectiv OUG nr. 1\/1999 \u015fi OUG nr. 34\/2020, care reglementeaz\u0103 procedura instituirii st\u0103rii de urgen\u0163\u0103 \u015fi a st\u0103rii de asediu, precum \u015fi amenzile ce se pot aplica pentru nerespectarea m\u0103surilor stabilite pentru gestionarea st\u0103rii de urgen\u0163\u0103\/asediu.<\/p>\n<p style=\"text-align: justify;\">Pe scurt, potrivit comunicatului emis, Curtea Constitu\u0163ional\u0103 a decis, <em>cu unanimitate de voturi<\/em>, urm\u0103toarele:<\/p>\n<h2 style=\"text-align: justify;\"><strong><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">1<\/span> <span class=\"su-label su-label-type-important\">Starea de urgen\u021b\u0103 este constitu\u021bional\u0103<\/span><\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Starea de urgen\u0163\u0103 a fost instituit\u0103 \u00een mod constitu\u0163ional. Nu se pune problema \u201eanul\u0103rii\u201d ei.<\/strong> Curtea a stabilit c\u0103, \u00een mod corect, \u00een decretul preziden\u0163ial au fost identificate \u015fi indicate drepturile \u015fi libert\u0103\u0163ile al c\u0103ror exerci\u0163iu urma s\u0103 fie restr\u00e2ns.<\/p>\n<p style=\"text-align: justify;\">Dar \u00een decret au fost prev\u0103zute \u015fi unele m\u0103suri concrete, care au constat \u00een modificarea, completarea sau suspendarea unor dispozi\u0163ii legale. Aceste m\u0103suri concrete au dep\u0103\u015fit limita prev\u0103zut\u0103 de lege (OUG 1\/1999) \u00een care pre\u015fedintele putea ac\u0163iona. Parlamentul ar fi putut s\u0103 sanc\u0163ioneze dep\u0103\u015firea competen\u0163elor legale de c\u0103tre pre\u015fedinte, \u00eens\u0103 nu a f\u0103cut-o.<\/p>\n<p style=\"text-align: justify;\">(<em>Vom primi<\/em><em> mai multe clarific\u0103ri <\/em><em>despre<\/em><em> aceast\u0103 problem\u0103 re\u0163inut\u0103 de Curtea Constitu\u0163ional\u0103, privind dep\u0103\u015firea par\u0163ial\u0103 a competen\u0163elor legale prin decretul preziden\u0163ial, odat\u0103 cu publicarea motiv\u0103rii deciziei<\/em> <em>CCR)<\/em><\/p>\n<h2 style=\"text-align: justify;\"><span class=\"su-dropcap su-dropcap-style-light\" style=\"font-size:1.5em\">2<\/span><span class=\"su-label su-label-type-important\">Nu \u0219i amenzile date pentru nerespectarea ei<\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Toate amenzile aplicate pe durata st\u0103rii de urgen\u0163\u0103 pentru nerespectarea m\u0103surilor stabilite pentru combaterea pandemiei nu au o baz\u0103 constitu\u0163ional\u0103<\/strong> (fie pentru c\u0103 reglementarea este neclar\u0103 \u2013 cazul art. 28 din OUG 1\/1999 &#8211; fie pentru c\u0103 prin ordonan\u021b\u0103 de urgen\u021b\u0103 nu se pot restr\u00e2nge drepturi \u015fi libert\u0103\u0163i \u2013 cazul \u00eentregii OUG 34\/2020). Aceasta \u00eenseamn\u0103 c\u0103 <strong>nu au baz\u0103 constitu\u0163ional\u0103 nici amenzile <\/strong><strong>\u201e<\/strong><strong>mici\u201d<\/strong> (cele aplicate \u00een prima faz\u0103 a st\u0103rii de urgen\u0163\u0103) \u015fi <strong>nici amenzile <\/strong><strong>\u201e<\/strong><strong>mari\u201d<\/strong> (cele aplicate dup\u0103 majorarea amenzilor, care a fost stabilit\u0103 prin OUG nr. 34\/2020).<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"su-label su-label-type-warning\">Se mai pot da amenzi acum?<\/span><\/h2>\n<p style=\"text-align: justify;\">Decizia Cur\u0163ii Constitu\u0163ionale \u00ee\u015fi produce efectele numai dup\u0103 publicarea ei \u00een Monitorul Oficial, publicare care se va face, cel mai probabil, dup\u0103 \u00eencetarea st\u0103rii de urgen\u0163\u0103, deci dup\u0103 15 mai 2020.<\/p>\n<p style=\"text-align: justify;\"><strong>P\u00e2n\u0103 la publicarea acestei decizii \u00een Monitorul Oficial,<\/strong> ea nu produce nici un efect, <strong>a\u0219adar<\/strong><strong> se mai pot aplica amenzile stabilite prin ordonan\u0163ele care reglementeaz\u0103 starea de urgen\u0163\u0103<\/strong> (cele majorate). Din punct de vedere practic, \u00eens\u0103, aceste amenzi aplicate devin inutile, deoarece ele pot fi contestate la instan\u021b\u0103 \u015fi vor fi anulate pe motiv c\u0103 actul pe care s-au bazat a fost declarat neconstitu\u0163ional (p\u00e2n\u0103 la terminarea procesului din instan\u0163\u0103, decizia Cur\u0163ii Constitu\u0163ionale va fi publicat\u0103 \u00een Monitorul Oficial \u0219i va produce efecte pentru viitor, adic\u0103 pentru toate procesele care se vor finaliza dup\u0103 publicarea ei).<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"su-label su-label-type-warning\">Mai pot fi contestate amenzile?<\/span><\/h2>\n<p style=\"text-align: justify;\">Deci, <strong>Curtea Constitu\u0163ional\u0103 nu a anulat nicio amend\u0103<\/strong>, dar \u00een baza acestei decizii, fiecare persoan\u0103 dintre cei amenda\u0163i, dac\u0103 se mai afl\u0103 \u00een termenul de contesta\u0163ie, de 15 zile de la primirea procesului-verbal prin care a fost amendat\u0103, poate contesta amenda \u00een instan\u021b\u0103 \u015fi\u00a0 va c\u00e2\u015ftiga procesul. Dup\u0103 opiniile mai multor juri\u015fti, to\u0163i cei amenda\u0163i \u00eenc\u0103 se mai afl\u0103 \u00een termenul de contesta\u021bie, care este suspendat p\u00e2n\u0103 la \u00eencetarea st\u0103rii de urgen\u0163\u0103, conform unei prevederi din decretele preziden\u0163iale prin care a fost instituit\u0103 \u015fi apoi prelungit\u0103 starea de urgen\u0163\u0103.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.apador.org\/cum-se-contesta-o-amenda-de-covid-19\/\" class=\"su-button su-button-style-default su-button-wide\" style=\"color:#324645;background-color:#cdd4db;border-color:#a4aab0;border-radius:7px\" target=\"_blank\" rel=\"noopener noreferrer\" title=\"bla\"><span style=\"color:#324645;padding:7px 20px;font-size:16px;line-height:24px;border-color:#dce1e6;border-radius:7px;text-shadow:none\"><i class=\"sui sui-hand-o-right\" style=\"font-size:16px;color:#FFFFFF\"><\/i> Vezi cum se poate contesta amenda Covid 19<\/span><\/a><\/strong><\/p>\n<h2><span class=\"su-label su-label-type-warning\">Amenzile pentru tulburarea ordinii publice r\u0103m\u00e2n \u00een vigoare<\/span><\/h2>\n<p style=\"text-align: justify;\">Aceasta nu \u00eenseamn\u0103 c\u0103 faptele prin care se tulbur\u0103 lini\u015ftea \u015fi ordinea public\u0103 vor r\u0103m\u00e2ne nesanc\u0163ionate \u00een urma declar\u0103rii neconstitu\u0163ionale a art. 28 din OUG 1\/1999 \u015fi a OUG 34\/2020, deoarece pentru astfel de fapte (<strong>petreceri zgomotoase, s\u0103v\u00e2r\u0219irea \u00een public de fapte, acte sau gesturi obscene, proferarea de injurii, expresii jignitoare sau vulgare etc.) pot fi aplicate \u00een continuare sanc\u0163iunile contraven\u0163ionale prev\u0103zute de Legea nr. 61\/1991<\/strong> pentru sanc\u021bionarea faptelor de \u00eenc\u0103lcare a unor norme de convie\u021buire social\u0103, a ordinii \u0219i lini\u0219tii publice<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"su-label su-label-type-warning\">La fel \u0219i dosarele penale pentru r\u0103sp\u00e2ndirea bolilor<\/span><\/h2>\n<p style=\"text-align: justify;\">De asemenea, <strong>cei care nu respect\u0103 m\u0103surile de combatere a pandemiei \u015fi cauzeaz\u0103 infectarea altor persoane vor putea fi urm\u0103ri\u0163i penal, pentru comiterea infrac\u0163iunii de z\u0103d\u0103rnicire a combaterii bolilor<\/strong>. Dar, este de subliniat c\u0103 \u015fi \u00een acest domeniu exist\u0103 o mare problem\u0103: printr-o ordonan\u0163\u0103 de urgen\u0163\u0103, Guvernul a majorat pedepsele pentru aceast\u0103 infrac\u0163iune \u015fi a extins incriminarea cu privire la alte fapte. \u015ei \u00een leg\u0103tur\u0103 cu acea ordonan\u0163\u0103 de urgen\u0163\u0103 exist\u0103 pericolul ca, dac\u0103 va fi atacat\u0103 la Curtea Constitu\u0163ional\u0103, s\u0103 fie declarat\u0103 neconstitu\u0163ional\u0103 (deoarece restr\u00e2nge drepturi \u015fi libert\u0103\u0163i \u015fi \u00eencalc\u0103 un referendum na\u0163ional).<\/p>\n<h2 style=\"text-align: justify;\"><span class=\"su-label su-label-type-info\">Ce trebuie s\u0103 fac\u0103 Parlamentul \u0219i Guvernul mai departe?<\/span><\/h2>\n<p style=\"text-align: justify;\">Dar, c\u00e2t mai repede posibil, <strong>Parlamentul va trebui s\u0103 reglementeze clar \u015fi previzibil regimul st\u0103rii de urgen\u0163\u0103, printr-o lege care s\u0103 \u0163in\u0103 cont de recenta decizie a Cur\u0163ii Constitu\u0163ionale<\/strong>. \u00cen prezent, ca urmare a acestei decizii, regimul st\u0103rii de urgen\u0163\u0103 poate fi considerat ca fiind unul haotic. Iar pandemia \u00eenc\u0103 nu s-a terminat.<\/p>\n<p style=\"text-align: justify;\">\u00cen acest context, APADOR-CH atrage aten\u0163ia asupra faptului c\u0103 \u00een cazul anun\u0163atei \u201e<em>st\u0103ri de alert\u0103<\/em>\u201d, care, \u00eencep\u00e2nd cu 15 mai 2020, ar putea s\u0103 \u00eenlocuiasc\u0103 actuala stare de urgen\u0163\u0103, nu pot fi restr\u00e2nse drepturi cet\u0103\u0163ene\u015fti prin ordine de ministru, planuri de ac\u0163iune \u015fi ale acte administrative cu caracter normativ inferioare legii. \u00cen m\u0103sura \u00een care, \u00een starea de alert\u0103, se va dispune restr\u00e2ngerea de drepturi \u015fi libert\u0103\u0163i prin alte acte normative dec\u00e2t prin <strong><em>lege<\/em><\/strong>, m\u0103surile vor fi neconstitu\u0163ionale, pentru c\u0103 vor \u00eenc\u0103lca art. 53 din Constitu\u021bie.<\/p>\n<p style=\"text-align: justify;\">Din acest motiv, APADOR-CH consider\u0103 c\u0103 Guvernul ar fi trebuit s\u0103 prezinte Parlamentului, p\u00e2n\u0103 la aceast\u0103 dat\u0103, un proiect de lege privind m\u0103surile necesare pe durata <strong>st\u0103rii de alert\u0103<\/strong> pentru combaterea pandemiei, m\u0103suri care presupun restr\u00e2ngeri de drepturi \u015fi libert\u0103\u0163i. A mai r\u0103mas o s\u0103pt\u0103m\u00e2n\u0103 p\u00e2n\u0103 la \u00eencetarea st\u0103rii de urgen\u0163\u0103 \u015fi p\u00e2n\u0103 la posibilul debut al st\u0103rii de alert\u0103, dar un astfel de proiect de lege nu a fost trimis Parlamentului. Proiectul de lege, dac\u0103 exist\u0103, ar trebui trimis chiar \u015fi acum Parlamentului, pentru a evita crearea unei st\u0103ri de incertitudine normativ\u0103, de genul celei create prin reglementarea deficitar\u0103 a amenzilor din starea de urgen\u0163\u0103, relevat\u0103 prin recenta decizie a Cur\u0163ii Constitu\u0163ionale.<\/p>\n<p style=\"text-align: justify;\"><div class=\"su-note\"  style=\"border-color:#a6a6a6;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\"><div class=\"su-note-inner su-u-clearfix su-u-trim\" style=\"background-color:#c0c0c0;border-color:#ffffff;color:#333333;border-radius:2px;-moz-border-radius:2px;-webkit-border-radius:2px;\">\n<p style=\"text-align: justify;\">Reamintim c\u0103, \u00een urma acestei decizii a Cur\u0163ii Constitu\u0163ionale, <a href=\"https:\/\/www.apador.org\/se-impune-o-amnistie-fiscala-pentru-degrevarea-instantelor\/\">APADOR-CH a solicitat adoptarea urgent\u0103 a unei m\u0103suri de <strong><em>amnistie fiscal\u0103<\/em><\/strong><\/a> pentru cei amenda\u0163i \u00een baza textelor legale declarate neconstitu\u0163ionale. Scopul amnistiei fiscale este de a evita supraaglomerarea instan\u021belor de judecat\u0103 cu cele peste 300.000 de contesta\u021bii ale celor amenda\u0163i, contesta\u0163ii care vor avea succes \u00een instan\u021b\u0103.<\/p>\n<p style=\"text-align: justify;\">\u00cen cazul \u00een care aceast\u0103 problem\u0103 nu va fi rezolvat\u0103 pe plan intern, exist\u0103 riscul de supraaglomerare a CEDO, deoarece este foarte posibil ca cei peste 300.000 de amenda\u0163i s\u0103 se adreseze CEDO.
