APADOR-CH i-a transmis azi, 29 mai 2018, ministrului o solicitare de\u00a0<strong><u>abrogare a art. 2 din Instruc\u0163iunile nr. 24165\/15.05.2018,<\/u><\/strong>deoarece acesta \u00eencalc\u0103\u00a0articolul 8 alineatul 5 din Legea nr. 544\/2001 privind liberul acces la informa\u0163iile de interes public, care prevede c\u0103 \u201e<em>informa\u0163iile de interes public solicitate verbal de c\u0103tre mijloacele de informare \u00een mas\u0103 vor fi comunicate, de regul\u0103,\u00a0<strong>imediat<\/strong>\u00a0sau \u00een\u00a0<strong>cel mult 24 de ore<\/strong><\/em>.\u201d<\/p>\n<p><a href=\"http:\/\/www.apador.org\/blog\/wp-content\/uploads\/2018\/05\/ordin-MS-21-mai.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-4319\" src=\"http:\/\/www.apador.org\/blog\/wp-content\/uploads\/2018\/05\/ordin-MS-21-mai-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" \/><\/a>\u00a0<a href=\"http:\/\/www.apador.org\/blog\/wp-content\/uploads\/2018\/05\/ordin-MS-15-mai.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-4318\" src=\"http:\/\/www.apador.org\/blog\/wp-content\/uploads\/2018\/05\/ordin-MS-15-mai-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" \/><\/a><\/p>\n<p>Artcolul 2 din Instruc\u0163iunile ministrului nu prevede nici forma (scris\u0103, verbal\u0103) \u00een care trebuie cerut \u015fi primit avizul prealabil de la Ministerul S\u0103n\u0103t\u0103\u0163ii \u015fi nici termenul \u00een care acest aviz prealabil trebuie cerut \u015fi, respectiv, comunicat. Indiferent de termenul necesar de ob\u021binere a acestui aviz, oricum Legea 544 ar fi \u00eenc\u0103lcat\u0103, pentru c\u0103 astfel\u00a0<strong>devine imposibil\u0103 comunicarea\u00a0<u>imediat\u0103<\/u>\u00a0a informa\u0163iilor solicitate\u00a0<\/strong>de pres\u0103. Cu alte cuvinte, prin aceste instruc\u0163iuni ministrul vrea s\u0103 modifice o lege cu aplicabilitate general\u0103, ceea ce este ilegal.<\/p>\n<p>Chiar dac\u0103 s-ar asigura comunicarea informa\u0163iilor c\u0103tre pres\u0103 \u00een maximum 24 de ore (ceea ce, practic, nu este posibil, av\u00e2nd \u00een vedere, durata normal\u0103 \u00eentr-un circuit birocratic a ob\u0163inerii unui aviz, care presupune: formularea solicit\u0103rii, examinarea solicit\u0103rii, motivarea admiterii\/respingerii solicit\u0103rii, \u00eentocmirea \u015fi comunicarea avizului) tot s-ar \u00eenc\u0103lca Legea nr. 544\/2001, care prevede \u00een art. 8 al. 5 regula c\u0103 informa\u0163iile solicitate de pres\u0103 trebuie comunicate\u00a0<em>imediat<\/em>, \u015fi nu doar \u00een maximum 24 de ore.<\/p>\n<p>Mai mult dec\u00e2t \u00eenc\u0103lcarea Legii 544\/2001 instruc\u021biunile ministrului s\u0103n\u0103t\u0103\u021bii \u00eengr\u0103desc un drept fundamental, prev\u0103zut expres \u00een Constitu\u0163ie, \u015fi anume\u00a0<strong>dreptul la informa\u0163ie<\/strong>, garantat \u00een art. 31 din Constitu\u0163ie: \u201e<em>Dreptul persoanei de a avea acces la orice informa\u0163ie de interes public nu poate fi \u00eengr\u0103dit.<\/em>\u201d<\/p>\n<p>\u00cen plus,\u00a0<strong>dac\u0103 un func\u0163ionar public \u00eendepline\u015fte un act cu \u00eenc\u0103lcarea legii (de exemplu, a Legii nr. 544\/2001) \u015fi prin aceasta cauzeaz\u0103 o v\u0103t\u0103mare a drepturilor sau intereselor legitime ale unei persoane (de exemplu, a dreptului la informa\u0163ie, prev\u0103zut \u00een art. 31 din Constitu\u0163ie), fapta poate fi considerat\u0103 infrac\u0163iunea de\u00a0<u>abuz \u00een serviciu, prev\u0103zut\u0103 de art.\u00a0 297 al. 1 din Codul penal<\/u><\/strong>.<\/p>\n<h2><strong>Ce a r\u0103spuns Ministerul S\u0103n\u0103t\u0103\u021bii<\/strong><\/h2>\n[button link=&#8221;http:\/\/www.apador.org\/blog\/wp-content\/uploads\/2018\/05\/Raspuns-Ministerul-sanatatii-privind-adresa-nr.-39-din-29.05.2018.pdf&#8221;
