Eliminarea obligativit\u0103\u021bii declar\u0103rii unei adun\u0103ri publice<\/strong>, cu exceptia a dou\u0103 cazuri expres prev\u0103zute de lege:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Pentru competi\u0163iile\/manifest\u0103rile sportive interna\u0163ionale, indiferent de locul de desf\u0103\u015furare a acestora.<\/li>\n<li>\u00cen cazul \u00een care exist\u0103 un organizator al adun\u0103rii publice \u0219i acesta de\u021bine indicii temeinice sau dovezi c\u0103 desf\u0103\u015furarea adun\u0103rii publice s-ar putea solda cu acte de dezordine ori c\u0103 ar putea s\u0103 duc\u0103 la manifest\u0103ri violente.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>2. Reglementarea situa\u021biei \u00een care num\u0103rul participan\u021bilor<\/strong>\u00a0la o adunare public\u0103 este\u00a0<strong>mai mare dec\u00e2t capacitatea trotuarului<\/strong>:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Participan\u021bii pot sta\u021biona sau se pot deplasa \u00een spa\u021biile publice adiacente, precum \u0219i pe partea carosabil\u0103,\u00a0cu obliga\u021bia de a asigura c\u00e2te o band\u0103 de circula\u021bie pe sens, \u00een zona respectiv\u0103.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>3. Definirea no\u021biunii de \u201eorganizator al adun\u0103rii publice<\/strong>\u201d ca:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>\u201ePersoana sau grup de persoane care planific\u0103 \u0219i coordoneaz\u0103 desf\u0103\u0219urarea unei adun\u0103ri publice\u201d<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>4. Eliminarea prevederii care permite ca desf\u0103\u0219urarea unei adun\u0103ri publice s\u0103 fie \u00eempiedicat\u0103<\/strong><\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Pe motiv c\u0103 nu exist\u0103 sau nu poate fi identificat un organizator al acesteia<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>5. \u00cenlocuirea interdic\u021biei absolute de desf\u0103\u0219urare a unei adun\u0103ri publice \u00een anumite loca\u021bii<\/strong><\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>\u00cen imediata apropiere a unor obiective (g\u0103ri, porturi, aeroporturi, sta\u0163ii de metrou, spitale, obiective militare)<\/li>\n<li>Cu impunerea obliga\u021biei de a permite\/a nu \u00eempiedica accesul \u00een \u0219i din incinta acestora<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>6. Permiterea adun\u0103rilor publice simultane<\/strong><\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Dac\u0103 acestea se desf\u0103\u0219oar\u0103 \u00een mod pa\u0219nic<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>7. Introducerea obliga\u021biei pentru participan\u021bii la o adunare public\u0103 de a anun\u021ba unitatea de jandarmerie competent\u0103<\/strong>, prin apelarea num\u0103rului unic de urgen\u021b\u0103 (112)<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>\u00cen situa\u021bia \u00een care constat\u0103 c\u0103, \u00een acela\u0219i loc sau pe acela\u0219i traseu, se desf\u0103\u0219oar\u0103 o alt\u0103 adunare (cazul adun\u0103rilor publice simultane)<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>8. Interzicerea\/\u00eentreruperea desf\u0103\u0219ur\u0103rii adun\u0103rii publice<\/strong>\u00a0nu se poate dispune<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>\u00cen cazul unei o conduite violente a unui num\u0103r redus de participan\u021bi, ci doar \u00een situa\u021bia \u00een care num\u0103rul participan\u021bilor violen\u021bi este at\u00e2t de mare \u00eenc\u00e2t izolarea acestora de c\u0103tre for\u021bele de ordine nu este posibil\u0103.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>9. \u00cenl\u0103turarea unor interdici\u021bii caduce din lege privind scopul urm\u0103rit de adun\u0103rile publice<\/strong>:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Pentru def\u0103imarea \u021b\u0103rii \u0219i a na\u021biunii<\/li>\n<li>Pentru organizarea unei lovituri de stat sau a altei ac\u021biuni contrare siguran\u021bei na\u021bionale<\/li>\n<li>Pentru \u00eenc\u0103lcarea moralit\u0103\u021bii publice<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>10. \u00cenl\u0103turarea limitei orare fixat\u0103 acum la ora 23.00<\/strong><\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Simpla dep\u0103\u0219ire a unui reper orar nu poate transforma automat o adunare public\u0103 \u00eentr-un fapt ilicit.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>11. Introducerea obligativit\u0103\u021bii purt\u0103rii uniformei de c\u0103tre toate organele de ordine<\/strong>(poli\u021bia \u0219i trupele de jandarmi) participante la interven\u021bie (inclusiv de c\u0103tre cameramanii Jandarmeriei) \u0219i a purt\u0103rii unei veste\/ecuson cu num\u0103r de identificare vizibil:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>Num\u0103rul de identificare va trebui s\u0103 aib\u0103 minimum 15\u00d715 cm.<\/li>\n<li>Num\u0103rul de identificare este diferit de num\u0103rul matricol al jandarmului \u0219i va fi atribuit aleatoriu (prin tragere la sor\u021bi) \u00eenaintea fiec\u0103rei interven\u021bii.<\/li>\n<li>\u0218efului dispozitivului de ordine are obliga\u021bia ca, \u00eenainte de interven\u021bie, s\u0103 consemneze \u00eentr-un proces-verbal atribuirea aleatorie a numerelor de identificare \u0219i numele fiec\u0103rui jandarm care l-a primit.<\/li>\n<li>Procesele verbale vor fi \u00eenregistrate \u00eentr-un registru special al unit\u0103\u021bii de jandarmerie.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>12. Instituirea unor garan\u021bii, \u00een lege, pentru respectarea regulilor\u00a0<\/strong>privind desemnarea aleatorie a numerelor de identificare \u0219i pentru p\u0103strarea eviden\u021bei acestor desemn\u0103ri:<\/p>\n<div class=\"shortcode-unorderedlist arrow\">\n<p>&nbsp;<\/p>\n<ul>\n<li>\u00cen cazul \u00een care atribuirea aleatorie a num\u0103rului de identificare nu s-a realizat sau \u00een cazul \u00een care procesul-verbal nu este \u00eentregistrat \u00een registrul special.<\/li>\n<li>R\u0103spunderea civil\u0103 pentru prejudiciile produse de oricare dintre membrii organelor de ordine revine \u0219efului dispozitivului de ordine.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<p><strong>13.
