You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\">C\u00e2teva<em> probleme de constitu\u021bionalitate \u0219i nu numai ale proiectului de ordonan\u021b\u0103 a Guvernului privind c\u0103utarea persoanelor disp\u0103rute<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\">A trecut mai bine de un an de la cazul Caracal, moment de mare emo\u021bie na\u021bional\u0103 \u00een care autorit\u0103\u021bile au promis adoptarea cu celeritate a unei legi mai bune pentru c\u0103utarea persoanelor disp\u0103rute, \u00eens\u0103 legea nu a fost adoptat\u0103. \u00cen prag de alegeri, se apeleaz\u0103 tot la o ordonan\u021b\u0103 de urgen\u021b\u0103, un instrument at\u00e2t de drag tuturor guvernelor.<\/p>\n<p style=\"text-align: justify;\">Ca \u0219i \u00een urm\u0103 cu un an, c\u00e2nd a f\u0103cut <a href=\"https:\/\/www.apador.org\/propunerile-apador-ch-pe-marginea-proiectului-de-lege-privind-cautarea-persoanelor-disparute\/\">\u0219ase propuneri de \u00eembun\u0103t\u0103\u021bire a legii<\/a> privind c\u0103utarea persoanelor disp\u0103rute, APADOR-CH vine \u0219i la dezbaterea proiectului de ordonan\u021b\u0103 de la Ministerul Afacerilor Interne (de vineri, 11 septembrie ora 10.00), cu alte \u0219ase sugestii. Atragem, \u00eens\u0103 aten\u021bia, c\u0103 cel pu\u021bin dou\u0103 dintre modific\u0103rile anun\u021bate nu se pot face prin ordonan\u021b\u0103, \u00eentruc\u00e2t ar fi neconstitu\u021bionale.<\/p>\n<p style=\"text-align: justify;\"><strong>Problemele de neconstitu\u021bionalitate ale ordonan\u021bei<\/strong><\/p>\n<p style=\"text-align: justify;\">Prima vizeaz\u0103 <strong>articolul 38<\/strong> din OUG, unde sunt prev\u0103zute \u201emetode speciale de c\u0103utare a unei persoane disp\u0103rute\u201d, adic\u0103 m\u0103suri care afecteaz\u0103 drepturi \u015fi libert\u0103\u0163i fundamentale nu doar ale persoanei c\u0103utate, ci \u0219i ale altor persoane vizate de activit\u0103\u021bile respective &#8211; de exemplu, dreptul la via\u0163\u0103 privat\u0103, inviolabilitatea domiciliului,interceptarea coresponden\u021bei etc.<\/p>\n<p style=\"text-align: justify;\">A doua este la <strong>articolele 73 \u0219i 74<\/strong> din OUG, unde sunt introduse infrac\u021biuni pentru sesizarea nejustificat\u0103 a dispari\u021biei unei persoane \u0219i pentru obstruc\u021bionarea procedurilor de c\u0103utare.<\/p>\n<p style=\"text-align: justify;\">De\u0219i utile \u00een context, cele dou\u0103 prevederi contravin articolului 115, alineatul 6 din Constitu\u021bie, care spune c\u0103 <strong>nu pot fi restr\u00e2nse prin ordonan\u021b\u0103 de urgen\u021b\u0103 drepturi fundamentale ale omului<\/strong>. \u00cen plus, \u00een cazul introducerii de noi infrac\u021biuni, acestea nu se pot face prin ordonan\u021b\u0103 de urgen\u021b\u0103 pentru c\u0103 poporul a stabilit asta \u00een cadrul referendumului na\u021bional din 2019: c\u0103 nu se pot adopta ordonan\u0163e de urgen\u0163\u0103 \u201e<em>\u00een domeniul <strong>infrac\u021biunilor<\/strong>, pedepselor \u0219i al organiz\u0103rii judiciare<\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\"><strong>Propunerile APADOR-CH de \u00eembun\u0103t\u0103\u021bire a ordonan\u021bei<\/strong><\/p>\n<p style=\"text-align: justify;\">Indiferent dac\u0103 va fi adoptat prin ordonan\u021b\u0103 sau printr-o lege \u00een regim de urgen\u021b\u0103 (ceea ce ar fi mai indicat), proiectul con\u021bine \u0219i alte sc\u0103p\u0103ri care ar trebui corectate:<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Reducerea de la 3 luni la 1 lun\u0103 a perioadei dup\u0103 care trebuie evaluat dosarul fiec\u0103rei dispari\u0163ii de c\u0103tre \u015feful unit\u0103\u0163ii de c\u0103utare<\/strong>.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>APADOR-CH consider\u0103 c\u0103 dosarul fiec\u0103rei dispari\u0163ii de persoane trebuie evaluat cel pu\u0163in din lun\u0103 \u00een lun\u0103, iar nu o dat\u0103 la 3 luni, cum prevede proiectul.<\/em><\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><strong>Reducerea de la 30 zile la 5 zile a termenului \u00een care se va r\u0103spunde la cererea membrilor familiei\/reprezentantului legal cu privire la stadiul procedurilor de c\u0103utare<\/strong>.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>APADOR-CH\u00a0 consider\u0103 c\u0103 termenul de 30 de zile este nejustificat de mare pentru o simpl\u0103 informare cu privire la stadiul c\u0103ut\u0103rii, un termen de 5 zile fiind suficient, \u00een mod rezonabil, pentru o astfel de informare.<\/em><\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><strong>Introducerea \u00een bazele electronice de date a semnal\u0103rii privind dispari\u0163ia persoanei trebuie s\u0103 se fac\u0103 de \u00eendat\u0103 ce a fost sesizat\u0103 dispari\u0163ia unei persoane<\/strong>, \u015fi nu dup\u0103 ce sesizarea a fost verificat\u0103 \u015fi s-a constatat c\u0103 este temeinic\u0103. Altfel, se pierde timpul cel mai pre\u0163ios \u00een caz de dispari\u0163ie, respectiv cel din perioada imediat urm\u0103toare dispari\u0163iei persoanei.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>Rolul principal al semnal\u0103rii dispari\u0163iei \u00een bazele de date este tocmai diseminarea c\u00e2t mai rapid\u0103 printre organele care au competen\u0163e legate de procedura c\u0103ut\u0103rii a informa\u0163iilor privind dispari\u0163ia persoanei respective. De aceea, momentul potrivit ar fi chiar acela ar semnal\u0103rii dispari\u021biei. \u00cen cazul \u00een care sesizarea se va dovedi ne\u00eentemeiat\u0103, semnalarea va putea fi \u015ftears\u0103 din bazele electronice de date.<\/em><\/p>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li><strong>Definirea prin lege (ordonan\u021b\u0103 de urgen\u021b\u0103) a no\u0163iunilor de \u201everificare \u00een imobil\u201d \u015fi de \u201everificare \u00een locuit\u0103\u201d \u015fi delimitarea con\u0163inutului acestora de cel al no\u0163iunii de \u201eperchezi\u0163ie domiciliar\u0103\u201d.<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>APADOR-CH recomand\u0103 ca \u00een proiect s\u0103 se prevad\u0103 expres c\u0103 verific\u0103rile \u00een locuin\u0163\u0103 \u015fi cele \u00een imobil se rezum\u0103 la verificarea prezen\u0163ei fizice \u00een acel spa\u0163iu a persoanei c\u0103utate, f\u0103r\u0103 efectuarea de alte activit\u0103\u0163i care intr\u0103 \u00een con\u0163inutul perchezi\u0163iei domiciliare \u0219i care are nevoie de acordul unui judec\u0103tor.<\/em><\/p>\n<ol style=\"text-align: justify;\" start=\"5\">\n<li><strong>Reducerea de la 6 luni la 2 luni a duratei maxime pentru care se pot dispune unele metode speciale de c\u0103utare (printre care, interceptarea comunica\u0163iilor \u015fi a coresponden\u0163ei), \u00een cadrul procedurii administrative de c\u0103utare a unei persoane disp\u0103rute<\/strong>.<\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><em>\u015eansele de g\u0103sire \u00een via\u0163\u0103 a unei persoane disp\u0103rute scad direct propor\u0163ional cu num\u0103rul orelor trecute de la dispari\u0163ie. Ca atare, \u00eentr-un caz de c\u0103utare a persoanei disp\u0103rute, folosirea mijloacelor tehnice de supraveghere (de exemplu, interceptarea convorbirilor telefonice) ar avea eficien\u0163\u0103 \u00een primele ore sau zile, \u00een prima lun\u0103, eventual cu posibilitatea prelungirii cu \u00eenc\u0103 o lun\u0103.
