Acest drept are 3 componente \u015fi, pentru fiecare dintre cele 3 componente exist\u0103 c\u00e2te o prevedere \u00een protocoalele nr. 4 \u015fi 7 la <a href=\"https:\/\/www.echr.coe.int\/documents\/convention_ron.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Conven\u0163ia European\u0103 a Drepturilor Omului<\/a>. Prevederile cu privire la expulzare sunt:<\/p>\n<ul style=\"text-align: justify;\">\n<li>A.\u00a0<strong>Interzicerea expulz\u0103rii propriilor cet\u0103\u0163eni<\/strong>\u00a0(art. 3 din Protocolul nr. 4). Aceasta \u00eenseamn\u0103 c\u0103 nimeni nu poate fi expulzat printr-o m\u0103sur\u0103 individual\u0103 sau colectiv\u0103, de pe teritoriul statului al c\u0103rui cet\u0103\u0163ean este. De asemenea, \u00een mod corelativ, nimeni nu poate fi privat de dreptul de a intra pe teritoriul statului al c\u0103rui cet\u0103\u0163ean este.<\/li>\n<li>B.\u00a0<strong>Interzicerea expulz\u0103rii\u00a0<em>colective<\/em>\u00a0de str\u0103ini<\/strong>\u00a0(art. 4 din Protocolul nr. 4). Aceasta \u00eenseamn\u0103 c\u0103 str\u0103inii nu pot fi expulza\u0163i dec\u00e2t individual, nu \u015fi colectiv. Preciz\u0103m c\u0103 prin art. 4 din Protocolul nr. 4 a fost interzis\u0103 expulzarea colectiv\u0103 de str\u0103ini.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Articolul prevede c\u0103 un str\u0103in care \u00ee\u015fi are re\u015fedin\u0163a \u00een mod legal pe teritoriul unui stat nu poate fi expulzat dec\u00e2t \u00een temeiul execut\u0103rii unei hot\u0103r\u00e2ri luate conform legii \u015fi el trebuie s\u0103 poat\u0103:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ul>\n<li>S\u0103 prezinte motivele care pledeaz\u0103 \u00eempotriva expulz\u0103rii sale;<\/li>\n<li>S\u0103 cear\u0103 examinarea cazului sau; \u015fi<\/li>\n<li>S\u0103 cear\u0103 s\u0103 fie reprezentat \u00een acest scop \u00een fa\u0163\u0103 autorit\u0103\u0163ilor competente sau a uneia ori a mai multor persoane desemnate de c\u0103tre aceast\u0103 autoritate<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">.<\/p>\n<p style=\"text-align: justify;\">Cu titlu de excep\u0163ie, un str\u0103in poate fi expulzat printr-o procedur\u0103 simplificat\u0103 atunci c\u00e2nd expulzarea este necesar\u0103 \u00een interesul ordinii publice sau se \u00eentemeiaz\u0103 pe motive de securitate na\u0163ional\u0103.
