You may click the link to switch the active language.<\/p><p style=\"text-align: justify;\"><em>7 hibe ale viitoarei legi privind protec\u021bia avertizorilor de integritate, descoperite de APADOR-CH, \u0219i cum pot fi ele reparate<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">O nou\u0103 lege pentru avertizorii de integritate, care ar transpune Directiva european\u0103 2019\/1937, se afl\u0103 \u00een dezbatere public\u0103 pe <a href=\"http:\/\/www.just.ro\/proiect-de-lege-privind-protectia-avertizorilor-in-interes-public\/\" target=\"_blank\" rel=\"noopener\">site-ul Ministerului Justi\u021biei<\/a> \u0219i ar urma s\u0103 \u00eenlocuiasc\u0103 actuala Lege 571\/2004, prima de acest fel adoptat\u0103 \u00een Europa.<\/p>\n<p style=\"text-align: justify;\">De\u0219i revolu\u021bionar\u0103 la vremea ei, prima lege nu a reu\u0219it s\u0103 le ofere avertizorilor de integritate suficient\u0103 protec\u021bie, astfel \u00eenc\u00e2t s\u0103-i stimuleze \u0219i pe al\u021bii s\u0103-\u0219i pun\u0103 \u00een pericol via\u021ba, cariera sau starea de confort pentru a semnala o posibil\u0103 ilegalitate la locul de munc\u0103.<\/p>\n<p style=\"text-align: justify;\">Experien\u021bele ultimilor ani au ar\u0103tat c\u0103 avertizorii de integritate pl\u0103tesc deseori cu job-urile lor curajul de a \u201efluiera \u00een biseric\u0103\u201d pentru binele public. De aceea noua lege este o bun\u0103 ocazie de a \u00eendrepta lucrurile. La o analiz\u0103 atent\u0103 a proiectului, \u00eens\u0103, APADOR-CH a descoperit \u0219apte hibe care ar putea z\u0103d\u0103rnici bunele inten\u021bii europene sau na\u021bionale.<\/p>\n<ol style=\"text-align: justify;\">\n<li><strong>Ap\u0103rarea \u0219i securitatea, mai presus de lege?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00cenc\u0103 din art. 1, al. 4, noua lege exclude din categoria avertiz\u0103rilor de integritate divulgarea unor \u00eenc\u0103lc\u0103ri de lege din domeniul ap\u0103r\u0103rii sau securit\u0103\u0163ii na\u0163ionale, de exemplu, privind o achizi\u0163ie public\u0103. Asta \u00eenseamn\u0103 c\u0103 eventualele dezv\u0103luiri s-ar face \u201ef\u0103r\u0103 drept\u201d, \u0219i ar fi considerate infrac\u021biuni, pedepsite de Codul penal \u2013 art.303 \u0219i 407.<\/p>\n<p style=\"text-align: justify;\"><strong>D<\/strong><strong>ac\u0103 proiectul de lege va r\u0103m\u00e2ne \u00een forma actual\u0103, va comite o ilegalitate tocmai cel care va dezv\u0103lui o ilegalitate privind o achizi\u0163ie public\u0103 din domeniul ap\u0103r\u0103rii sau securit\u0103\u0163ii na\u0163ionale.<\/strong><\/p>\n<p style=\"text-align: justify;\">De aceea APADOR-CH a cerut Ministerului Justi\u021biei (MJ) s\u0103 elimine alineatul 4 din articolul 1 sau s\u0103-l redacteze mai clar. Textul a\u0219a cum e propus nu stabile\u0219te clar \u015fi previzibil grani\u0163a dintre permis \u015fi interzis \u00een materia avertiz\u0103rilor privind ap\u0103rarea \u015fi securitatea na\u0163ional\u0103, grani\u0163\u0103 pe care avertizorul este obligat s\u0103 o respecte, de\u015fi nu o poate cunoa\u015fte.<\/p>\n<ol style=\"text-align: justify;\" start=\"2\">\n<li><strong>Informa\u021biile clasificate ilegal pot fi divulgate?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Art. 5 lit. a din proiect este de asemenea redactat ambiguu. APADOR-CH cere modificarea art. 5 lit. a pentru a rezulta \u00een mod clar c\u0103 nu exist\u0103 o interdic\u021bie absolut\u0103 de divulgare a informa\u021biilor clasificate \u0219i c\u0103 pot fi divulgate acele informa\u021bii care au fost\u00a0\u00a0clasificate cu \u00eenc\u0103lcarea legii.<\/p>\n<p style=\"text-align: justify;\">Spre exemplu, \u00een Legea 182\/2002 privind protec\u021bia informa\u021biilor clasificate exist\u0103 art. 24 al. 5 \u0219i 6, cu urm\u0103torul con\u021binut:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><i>Se interzice clasificarea ca secrete de stat a informa\u021biilor, datelor sau documentelor \u00een scopul ascunderii \u00eenc\u0103lc\u0103rilor legii, erorilor administrative, limit\u0103rii accesului la informa\u021biile de interes public, restr\u00e2ngerii ilegale a exerci\u021biului unor drepturi ale vreunei persoane sau lez\u0103rii altor interese legitime.&#8221;\u00a0<\/i><\/p>\n<\/blockquote>\n<p>\u00cen cazul unor astfel de informa\u021bii, clasificate cu \u00eenc\u0103lcarea legii, divulgarea lor nu ar trebui s\u0103 fie interzis\u0103 de legea avertizorilor. \u00cens\u0103, din actuala redactare a art. 5 lit. a din proiect, se poate \u00een\u021belege c\u0103 \u0219i informa\u021biile clasificate cu \u00eenc\u0103lcarea legii nu ar putea fi dezv\u0103luite.<\/p>\n<ol style=\"text-align: justify;\" start=\"3\">\n<li><strong>Presa poate fi informat\u0103 \u00eenaintea \u0219efului sau invers?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00cen art. 18 din proiect este reglementat\u0103 \u201e<em>divulgarea public\u0103<\/em>\u201d a unei informa\u0163ii privind \u00eenc\u0103lcarea legii, ca form\u0103 distinct\u0103 de avertizare \u00een interes public. Celelalte forme de avertizare sunt raportarea intern\u0103 \u015fi raportarea extern\u0103. Cea mai frecvent\u0103 \u0219i eficient\u0103 form\u0103 de divulgare public\u0103 este, desigur, sesizarea presei.<\/p>\n<p style=\"text-align: justify;\">Legea 571\/2004 prevede c\u0103 dezv\u0103luirea poate fi f\u0103cut\u0103 direct presei, f\u0103r\u0103 ca avertizorul s\u0103 fi sesizat \u00eenainte autorit\u0103\u021bile sau superiorii. Actuala lege \u00eei ofer\u0103, a\u0219adar, acestuia un drept de op\u021biune. Nu acela\u0219i lucru se prevede \u0219i \u00een viitoarea lege.<\/p>\n<p style=\"text-align: justify;\">Proiectul dezb\u0103tut condi\u0163ioneaz\u0103 sesizarea presei at\u00e2t de sesizarea <em>prealabil\u0103<\/em> a autorit\u0103\u0163ilor competente, c\u00e2t \u015fi de neluarea de c\u0103tre autorit\u0103\u0163i a m\u0103surilor corespunz\u0103toare, \u00een urma sesiz\u0103rii formulate.<\/p>\n<p style=\"text-align: justify;\">Ca excep\u0163ie, avertizorul se va putea adresa <em>direct<\/em> presei doar dac\u0103 el va face dovada c\u0103 a avut motive \u00eentemeiate s\u0103 cread\u0103 c\u0103 \u00eenc\u0103lcarea dezv\u0103luit\u0103 poate constitui un pericol iminent sau evident pentru interesul public sau c\u0103 exist\u0103 un risc de represalii sau o probabilitate redus\u0103 ca \u00eenc\u0103lcarea s\u0103 fie remediat\u0103 \u00een mod eficace.<\/p>\n<p style=\"text-align: justify;\">APADOR-CH recomand\u0103 modificarea art. 18, al. 1 \u0219i 2 astfel \u00eenc\u00e2t avertizorul s\u0103 p\u0103streze \u00een continuare op\u021biunea liber\u0103 c\u0103tre cine se \u00eendreapt\u0103 cu dezv\u0103luirea si, \u00een consecin\u021b\u0103, s\u0103 aib\u0103 dreptul de a se adresa direct presei.<\/p>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li><strong>Care sunt avertizorii proteja\u021bi de lege?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">La art. 19 al. 1 din proiect sunt prev\u0103zute condi\u0163iile \u00een care un avertizor poate beneficia de protec\u0163ia legal\u0103. Av\u00e2nd \u00een vedere c\u0103 aceste condi\u0163ii sunt prev\u0103zute <em>cumulativ<\/em>, rezult\u0103 c\u0103 ne\u00eendeplinirea unei singure condi\u0163ii duce la excluderea protec\u0163iei prev\u0103zute de lege. De aceea, referirea din art. 19 al. 1 lit. a \u0219i b nu ar trebui f\u0103cut\u0103 doar la cei care raporteaz\u0103 (intern \u015fi extern) \u00eenc\u0103lc\u0103ri ale legii, ci \u015fi la cei care divulg\u0103 public (\u00een pres\u0103 de exemplu) astfel de \u00eenc\u0103lc\u0103ri, \u00eentruc\u00e2t \u0219i ei fac tot acte de avertizare.<\/p>\n<ol style=\"text-align: justify;\" start=\"5\">\n<li><strong>Cum \u00ee\u0219i face rost avertizorul de dovezi?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Sunt situa\u0163ii \u00een care avertizorul are nevoie de dovezi pentru dezv\u0103luirile sale: documente care nu-i apar\u0163in, date informatice la care nu are drept de acces, \u00eenregistr\u0103ri audio-video etc. Dac\u0103 nu \u00ee\u015fi asigur\u0103 dovezi, va fi discreditat \u015fi probabil exclus de la protec\u0163ia legal\u0103, pe motiv c\u0103 face afirma\u0163ii f\u0103r\u0103 acoperire.<\/p>\n<p style=\"text-align: justify;\">Dac\u0103 \u00ee\u015fi asigur\u0103 dovezi, la care, de cele mai multe ori, nu are acces \u00een mod legal, va comite una sau mai multe infrac\u0163iuni. De aceea APADOR-CH cere completarea art. 20 al. 2 din proiect astfel \u00eenc\u00e2t avertizorul s\u0103 nu fie acuzat de furt, a\u0219a cum s-a \u00eent\u00e2mplat \u00een cazul Bucur vs. Rom\u00e2nia.<\/p>\n<ol style=\"text-align: justify;\" start=\"6\">\n<li><strong>De ce ar mai putea fi acuzat avertizorul?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">Acela\u0219i articol 20 ar trebui completat \u0219i cu o prevedere din Directiva european\u0103, care se refer\u0103 la solu\u0163ii rezonabile pentru situa\u0163ii sensibile, f\u0103r\u0103 de care s-ar putea ca avertizorii s\u0103 ezite la dezv\u0103luirea \u00eenc\u0103lc\u0103rilor de lege. De exemplu ar trebui ca legea s\u0103 prevad\u0103 c\u0103 avertizorul nu r\u0103spunde pentru def\u0103imare, pentru \u00eenc\u0103lcarea drepturilor de autor, pentru \u00eenc\u0103lcarea secretului profesional, pentru \u00eenc\u0103lcarea normelor de protec\u021bie a datelor, pentru divulgarea secretelor comerciale?<\/p>\n<ol style=\"text-align: justify;\" start=\"7\">\n<li><strong> Sanc\u021bionarea avertizorului, l\u0103sat\u0103 la voia companiei?<\/strong><\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\u00cen articolul 22 din proiect ar trebui <span lang=\"RO\">introdus testul de propor\u021bionalitate a sanc\u021biunilor aplicate avertizorului<\/span><span lang=\"X-NONE\">. <\/span>Legea \u00een vigoare prevede c\u0103 aceste sanc\u021biuni disciplinare trebuie s\u0103 fie propor\u021bionale cu cele pentru fapte similare aplicate altor persoane.
